Complainant did not purchase the vehicle from Lone Star Motosports.

Complainant did not purchase the vehicle from Lone Star Motosports.   The true buyer/purchaser was Mr. Albert R[redacted], on 06/24/2015  Vehicle was sold for $ 2094.00 on an " AS-IS " basis.Complainant states vehicle was acquired from new owner Albert R[redacted] on 06/26/2015.   Albert R[redacted], signed Purchase Agreement with Lone Star Motosports and paid for his vehicle with his credit card and agreed to do his own transfer of Registration & Certificate of Ownership which was given to him.  Lone Star Motosports does not recognize complainant as the purchaser, and has heard nothing from new owner Albert R[redacted] in regards to transaction which was sold "AS-IS".We can only discuss facts of the sale with Albert R[redacted], the Purchaser.

I am rejecting this response because: business failed to respond to some of the complaints and some of their responses were inaccurate. 
I feel it is unconscionable and probably illegal for a car dealer to sell a junk car for $5000 to an elderly woman knowing there is so much wrong with the car that it is unsafe to drive and that the repair cost, $9085.88, would be so prohibitive that it would not be worth it to make the repairs. This dealer, Lonestar Mortorsports, posted an advertisement on Craigslist falsely describing the car as the top "SE" model with "all options" and "new tires" and that it ran "great."  When I phoned to inquire about the car, Mr. L[redacted] added to the misrepresentations saying the car had leather seats, running boards, a tow hitch, and a fancy stereo system.  This was all false.  All false.  I purchased this car under very false pretenses finding out that it needs so many costly repairs just to make it safe and drivable that it is essentially only worth what a junkyard would pay.  Mr. L[redacted], the owner of a used car business for over 35 years with a fully equipped car repair/maintenance facility on the premises, surely knows the condition of the cars he sells at least so he can determine the value and determine that the car is safe to drive.  He is a licensed dealer, it is his business to know the condition of the cars he sells and he is required to disclose any major problems to the buyer.  Yet, he denies all knowledge and says I bought the car 'as is' and should have inspected it myself.  On the phone prior to my coming to Honolulu, he said that buyers from the outer islands usually "trust" his descriptions of his cars and usually purchase them sight unseen, implying that I could "trust" his word.  I have tried to resolve this personally with Mr. L[redacted] for some time, having had several phone conversations with him prior to my filing this Revdex.com complaint, but he will not discuss this, saying only I purchased the car "as is."  
 
To respond to Mr. L[redacted]'s written response of 12/9/17:
First, Mr. L[redacted] failed to address the issues of his incorrect Craigslist advertisement offering a Nissan Xterra 'SE' top model car with "all options", 'new tires', that 'runs great.'  All of this is not true and amounts to false advertising. Lonestar Motorsports must be held accountable for this misrepresentation.  Although I believed I was buying this car, the car I was sold was, in reality, the cheapest model in an unsafe condition with old and worn out tires, no radio or sound system, and without 'all options.'
 
"This vehicle, based on advertised prices, typically range in value from $6850 - $ $9550, "AS-IS" with 125,000 miles."  I assume he is using the Kelley Blue Book values and is quoting the price range for cars sold at car dealerships.  This is an unfair comparison since these prices reflect "certified used cars" that the dealers have thoroughly inspected and repaired and which are usually sold with a limited warranty.  That was absolutely not the case with this car.  Also, the average mileage for this car at the time I purchased it was 118,000 miles, not 125,000.  The KBB private party values for this car in fair condition is $4,152.  And this car is so unsafe it shouldn't be driven without repairs which would reduce the value to practically nothing.
"Mrs. [redacted] test drove our vehicle and on her return to the dealership she complained only that it "stalled" and that she restarted it and continued on."  As I explained in my complaint, the car'e engine died while I was driving in traffic at an even speed of about 30-35 mph.  It simply stopped running leaving me with no power steering or brakes to control the car.  It was with very great effort that I managed to slow the car down and turn the car into a side street and bring it to a stop.  This was very difficult for me, a 74 year old woman, to do with no power steering or power brakes.  This is dangerous and should not be trivialized; I could have caused an accident and I was greatly upset by the experience.  I managed to start the car and drove it, slowly, back to the lot.  I was worried and made a big fuss, but the promise by the mechanics and salesman, Lan, to conduct a diagnostic scan of the engine and to repair the problems so it wouldn't happen again reassured me that the car would be in good and safe driving condition. I was told that the engine died because of a faulty fuel gauge and they would replace the fuel pump assembly and that would fix the problem. I knew that dealers are required to disclose to the buyer any serious problems with the car and I trusted that they would fix the problem.  
 
"She agreed to purchase the vehicle "AS-IS" for the asking price of $5495 if we would give her a discount to only $4900, and repair the vehicle as to her only complaint.  We agreed to accept her offer and put every promise in writing."  I asked the salesman if he would give me a cash discount or a 'senior discount' considering I had flown over from Hilo and had to pay for shipping the car to the Big Island, and had the problem with the car dying on me, and offered $4900 contingent on the car's engine problem being repaired.  He agreed. I knew I was purchasing the car "As is" but I felt confident knowing the vehicle would be repaired. I knew that smaller car repairs come up:  my 2000 Nissan Xterra SE has had only a few issues in the 11 years I have owned it which is why I wanted this model. I was not given a copy of the diagnostic engine scan or the "repair work order" but I assumed that they were telling the truth, especially since it concerned my driving safety.  I was also not shown or given a copy of the vehicle title (which I got when I picked up the car in Hilo port on 8/22.)  I believed I was purchasing the car that had been advertised with the advertised features.  I did not agree to purchase a cheap model without the features and condition advertised;  no other problems were disclosed, only the engine problem that I experienced which was to be fully repaired.   
 
"She asked us to ship it to Hilo, and we agreed."  I asked them to deliver the car to the port; they said it was a courtesy they extend to all off-island buyers.  I paid the shipping charge of $422 to the shipping company.
 
"When road tested, no "Service Engine Soon" lights were evident, good to go."  The Service Engine Soon warning light was on when I picked up the car at the the port on 8/22.  I called Mr. L[redacted] about this at that time and he said it was probably needing a tune up.  Later, after experiencing a repeat of the car's engine dying while I was driving, I brought the car to [redacted] and then to [redacted] for a diagnostic to determine why the SES light was on.  The [redacted] Service manager warned me about the overall bad condition of the car.  The [redacted] Service manager confirmed the serious radiator-transmission problem that had triggered the warning light sensor.  He said the problem has undoubtedly existed for some time considering the miles on the car, and that the 'Service Engine Soon' would have come on as soon as the sensor detected the problem. I told him the warning light had not been on when I test drove the car but that it was on when I took possession of the car at the port.  He was surprised.  I asked if the warning light can be manually turned off; he said yes, but that it will come on again as soon as the sensor reads the problem.  I believe that the warning light had been on and that somehow it was turned off when I test drove the car and purchased it "As-is".   I didn't take possession of the car until 8/22 and the warning light was on.
 
Note: this vehicle Passed Hawaii State Safety Inspection less tha 5 month earlier, and only 633 miles ago.   As Mr. L[redacted] must well know, a car doesn't have to be operational to pass an inspection, it just has to have intact and working head and tail lights, turn indicators, horn, windshield wipers, and have safe tires.  Inspections are usually done by private car maintenance facilities.  You could tow the car in and still pass inspection.  
To repeat my desired resolution,  I was sold a worthless car under false pretenses and I would like Mr. L[redacted] to refund my money and take the car back.  The car is so bad that it is impossible he was unaware of the condition. This car is unsafe to drive and is not worth the cost to repair it.  This car, which I haven't driven since the Nissan diagnostic on September 22, 2017, is continuing to cost me money.  In addition to the cost of the car, I paid for the shipping to Hilo, for car maintenance and inspection at [redacted], for a diagnostic inspection at Nissan, and am paying for full insurance coverage for this undriveable car (in addition to my own car),  Mr L[redacted] would be able to repair the car at his facility at low cost, (he told me he pays his mechanics $20/hour,) and resell it.  That is the best solution since, after paying $5000 for this car, I do not have an additional $9085.88 to repair a car which would only be worth $4,152 after repairs.

establishment and want compensation. Unless they're the type of business that purposely sells terrible cars that only work for a month, then maybe that's what needs to be advertised. If I need to show proof I have proof.

Mrs. [redacted] purcsaed "AS-IS" a used 2007 Nissan Xterra V6 Sport Utility vehicle from our inventory of over 80 units to choose from. She flew over from Hilo for the day to inspect and pick a vehicle that she was familiar with similar to the older 2000 Nissan Xterra she currently...

This vehicle, based on advertised prices, typically range in value from $6850 - $ $9550, "AS-IS" with 125,000 miles. This one had only 114,000 miles.We replaced the fuel pump, and crank sensor. Complaint fixed at over $500, no charge to customer. Also replaced worn out tailgate hydraulic struts for good measure. When road tested, no "Service Engine Soon" lights were evident, good to go.   She asked us to ship it to Hilo, and we agreed.Mrs [redacted] understands tht this vehicle is sold "AS-IS" , and she will have to pay for any repairs needed after the sale.  She agreed to the standard terms and conditions of the contract and signed in 4 places on the documents attesting to the "AS-IS" nature of the deal.  She also signed the Federal Buyers Guide.  All common and usual for vehicles older than 6 years and over 75,000 miles. Her purchase was 11 years old ans 114,014 miles.We expressly disclaim all warranties, express and implied, including the implied warranties of fitness for aparticular purpose.  Note: this vehicle Passed Hawaii State Safety Inspection less tha 5 month earlier, and only 633 miles ago.On 9/25/2017, 52 days after purchasing and driving it over 400 miles "safely" Mrs [redacted] called with new expanded complaints. She demanded redress, refund, cancellation, etc.  We declined.  ShAt no tim, during the hours she was at the dealership, did she ask us if she may have a pre purchase inspection by her independent mechanic, either on or off the lot.  Which we of course always gladly allow our customers to do, encouraging full dislosure to her contentment.  We have nothing to hide.  Her claims are unwarranted and for all the reasons stated we Decline her demands.  We are now sorry that Mrs. [redacted] did not shop around and choose a fully reconditioned "certified" vehicle perhaps costing twice as much as she paid,  at some of the over 120 Dealerships on  Oahu, and take the time to do a more exhaustive pre purchase inspection, as no used car is perfect !            Good Luck !   Sincerely,  Linne'
