I am rejecting this response because:
For the sake of anyone who may someday seek a landscaping
contractor, the accuracy of the Revdex.com record of a customer complaint is
important. As indicated in the Revdex.com history relative to SAGC, I am
not the first of SAGC's customers to experience problems. I have learned an expensive, albeit valuable
lessonIn the future, I will always check with the Revdex.com before engaging any
other contractor. Had I done so in this
case, the history of complaints and SAGC’s ‘F’ rating would have allowed me to avoid
all contact with SAGC
SAGC’s reply to the Revdex.com begins by stating, “SAGC has
done everything we could to work things out with Mr***.” They may have me confused for another
customer of theirs. From the moment the
project manager called me the morning of 1/28, neither he nor anyone else at
SAGC did anything to assuage my concerns over the sequence of work. The sequence of work had been established unilaterally
by SAGC with no input from me until the morning of 1/28. My input and inquiries that morning were not welcomed
by the project manager and no effort was made by SAGC to re-consider the
scheduleAs anyone would reasonably expect changes to develop in the course of
a project, even the SAGC contract contemplates changes Parareads:
Changes or Additional Work - Changes or additional work must be approved by the
Owner and SAGC in writingThe price for a change in the Work must also be
agreed to in writingIf the Owner and SAGC cannot agree to a price for a
change in the Work, SAGC will invoice the customer on a time and materials
basis where all required labor will be charged at a rate of $per hour and
all material costs are subject to a 10% handling charge
Despite the above, the SAGC project manager resisted my
efforts to discuss the schedule, arguing that he was not going to be “micro-managed”
It was obvious to me that I had made a
mistake hiring this company. Our
discussion on the morning of 1/resulted in our on-the-spot agreement to
terminate the contracts. That same morning,
I notified SAGC in writing that I was cancelling the contracts that I had
signed on 1/and 1/27. SAGC did not
acknowledge my communication to themOn 1/29/15, I placed a stop payment on
the deposit check for the 2nd contract(My deposit check for the 1st
contract had already cleared the bank.)
I notified SAGC that that day I had done so
The only outstanding issue between SAGC and me is SAGC’s
failure to refund deposits as specified in SAGC’s contracts. The SAGC contract provides that refund checks
will be sent by mail within days of cancellation. Parareads:
Cancellations - There is s cancellation fee of 10% of total contract
Cancellations must be made within hours of scheduled service dateIf customer
decides to cancel this agreement after the hours of scheduled date of
service, the customer will only receive 50% of their deposit back to cover any
costs that SAGC has made including materials, deposits, scheduling, plans, permits, employee
compensation etcRefund
checks will be sent by mail within days of cancellation
I cancelled the SAGC contracts within hours. SAGC did not mail a refund check within
days of cancellationProof of that is in my possession. It is the SAGC envelope that enclosed the
refund check. It is postmarked 2/19/
Further, I contacted SAGC on 2/11/to check on the
status of the refund check. I received
this reply, dated 2/11/15:

Not having receipt the refund check, I made my
complaint to the Revdex.com on 2/19/SAGC’s mailing of the check was postmarked
2/19/15. SAGC was either mistaken or
purposely misrepresented their 2/reply that the check had been mailedEither
way, SAGC is not truthful in its reply to the Revdex.com and it violated the terms of
its own contract by not mailing the refund within days of the 1/28/cancellation
Despite this, SAGC has responded to the
Revdex.com by saying is not reimbursing the cancellation fees.
SAGC violated the terms of their own contract, i.e., delaying
the refundI will now consider pursuing the recovery of the $in cancellation
fees in small claims court. I appreciate
the involvement of the Revdex.com in this matter.

SAGC has done everything we could to work things out with Mr***He hired SAGC to do a job for him that he would not let our crew doThe project Manager & Mr*** came to the agreement to cancel both contracts & part waysThe Project Manager had discussed with Mr*** on site
1/28/that he would submit cancellation paperwork & process check within business daysWhen Mr*** placed a stop payment the next day on one of the checks that was submitted to SAGC we had to re-submit new cancellation paperwork to payroll/accounting with the different total to be refundedSAGC did process his refund check for the amount agreed on and mailed it out within the business days. SAGC will not be paying any additional fee's to Mr***SAGC has already exhausted several man hours, materials & paperwork on this clientI have attached email correspondence since cancellation process beganIf you have any further questions, please contact our office or email address on record

This is in response to Mr. [redacted]'s complaint about SAGC. We had made several attempts to schedule a time with client to address his complaint, but none of the times we had available worked for him. We had to place other jobs on hold just to go to his house...

so we could as the situation and get it taken care of ASAP. The day we were schedule to come he called our project manager a half hour prior to our arrival to tell him not to step foot on his property. Client then proceeded to make unreasonable requests and ended up hanging up on our project manager as well as our office manager. Clients wife ended up calling us to apologize for her husbands behavior and asked that we come on a day when her husband was not home. We agreed, but with her schedule she wouldn't be able to meet with us for another two weeks. We are currently  working with Mrs. [redacted] and getting the necessary repairs.
