As Ms *** knows, the management of this property changed recently. Beck was given a very incomplete set of books and records and is some cases reflected funds missing from owner's accounts. She has been in contact directly with our offices and the matter in question was cleared
up. It is my understanding that this was to her satisfaction. We regret the situation and we are doing everything in its power to overcome prior years of mismanagement and poor record keeping

The complaint to *** ***, is un founded, we have addressed many issues, with this residence over the last few months, but some items he is complaining about are excluded from our contract, items bought and furnished by home owner, are not warrantied itemsCheap products are just thatWe are
working with the lumber supplier to fix one item on their deck, we are dealing with a product that will be fixed by pro - build We do have another item about a window, that will be under warranty from the window companyOther items we have tried to address as they come upDamage to the residence from hail this summer is a home owner insurance item, we have fixed some of the items caused by the hailWe are still waiting on monies owed to us by home owner for extended road base to their barnItems such as a crack in exterior concrete is not a warranty item, we have language in our contract to address such a itemThere is no life threating items at this residence, the owner is being very dramatic on this issue

I fully understand the frustration indicated by Ms*** (and in reality all the residents in this condominium community) related to the long an difficult process of getting gas and subsequently hot water restored to this propertyI can only say we did all we could do to work within the physical
limitations of a property approximately years old, availability of plumbing contractors, gas company and City of *** services, etcUnfortunately, as detailed on the attached copy of the many emails sent to owners, it was a long and arduous processNote in particular the email of August from the President of the HOA explaining the circumstances to that pointService was restored finally on August and we are all in hopes none of us will have to go through this type of difficulty and inconvenience

I have talked with some of the staff at the office and have been informed that a recent conversation took place clarifying the collection related issues, late charges and account status I believe that this matter has been resolved

I am rejecting this response because: His quote I agree some items have been taken care of. We have had nothing but a endless list from this client since he has moved in over a year ago (we moved in November 1st 2015 as that’s only 9 months ago), he is the type of person that can not be satisfied. We have done countless trips to this residence to fix , and re do items that have been on his endless punch list. There is a reason why they have had to come out and redo things, as they can’t seem to get it correct the first time.  A perfect example is when [redacted] came out this last trip to do the paint touch up, he still missed spots, that my wife pointed out, and he just walked off and did not go back and fix the issue.  He also was well aware of the high ceiling area that needed painting and he forgot to bring the correct size latter, and declined use of our latter to remedy the situation – thus requiring another trip.  This is a perfect example of them having to redo things time and time again.  Sagewood has been out a couple times to fix tiles that are lose.  Again, the tiles are lose, and we have only been in the house for 9 months.  Yes our expectation is that these tiles should not move when stepped on, such that either the tile layer needs to fix it, or it is a subfloor issue that Sagewood needs to fix.  So yes this is another example of an issue that takes multiple trips to get it corrected.  Tis latest has been worked on many of the items are just plain home maintance, done by home owners except this one.  Items on our list such as His doors that dont lock ,  door one, the main bolt system to the door works fine, its the main security devise for this door, his handle lock is not operating, this was turned over to the window manufacutor, for a new door handle, he has been notified that it is ready. but he wants the company to come out on a weekend. they dont. The main bolt ing system to this door, would be very hard to break in, just a bit of over drama again.  Bob Barrows has only been personally involved (i.e. on site) for the last couple months.  Prior to that, there was another Sagewood representative responsible for our house.  This representative told us that over the course of the first year, that we should expect some dry-wall cracks, areas that need paint touchups, as well as doors having issues shutting, etc. and that this is normal, and Sagewood would take care of these items in the first year.   It sounds like Bob Barrows needs to communicate with his employees, such that Sagewood does not have major communication disconnects. The other exterior door was a 30 second adjustment to the strike plate, the door still had a lock other than the dead bolt. A home owner with a simple screw driver could have fixed this just as easy as we did.  Fire door issue, this took all of 2 seconds with two fingers to adjust the the door insulating strip. the gap was less than a 1/4 inch not much of a fire issue.The patch we did on some minor drywall cracks, normal for a new home, needed to be painted over, these patches were about the size of a dinner plate, The lower patch took about 2 minutes to paint over, and the upper one will only take a couple of minuets  tools were a small paint brush. The amount of time it took [redacted] to complain about this would have far exceeded the time to take to paint the little area, and frankly not much talent would be needed to do this;  Reference my point above where Bob came out and did the paint  touchup, and missed spots, forgot the right ladder, etc., so he must not have the talent to correctly touch up the paint so he should consider bringing in the people that painted the first time to get it done correctly.The deck issue , is as is. We used pressure treated 2x10 deck joist, at 12" on center, when we should have been 16" on center, these deck joist of pressure treated wood, are expensive, and we did not have to use them, but I always use this product for lasting quality and endurance. BUT these joist are wood, wood is not perfect, it has crowns and dips, ITS WOOD. The Trex type material used for the decking was again a high priced decking material, but it does not have much in the way of resisting the ups and downs of wood joists, so the top finish decking has some waves, in it, being very minor, and in no way reflects any kind of defective material and or workmanship, the trex material is on wood joists. Wood is imperfect. If this owner wanted a absolute level deck he should have paid for a metal joist deck.  I will have a third party inspect the deck and get their opinion.  The fact that the deck needs to be cleaned has been an issue in emails to Sagewood for months now with no response.  The no response is very typical of Sagewood, so at this time we are still awaiting a response as to when they will have the deck cleaned.  Again, the previous Sagewood representative indicated the deck would be cleaned.On the porch base for the posts, these have been in place for well over a year and half. The over hang that [redacted] is referring to is the stone vener on the lower column. The porch cement follows the foundation under the porch. The plans called for 24" base, we build 24" base, the post is as  it should be. if the owner wanted smaller bases, he had the opportunity to request this way back when his home was being framed and it would have been changed then. We have in our contract items such as this that are in place for more that 30 days, it is deemed acceptable to the owner. We have not heard of this item till a couple of months ago, almost a year after they have moved in.  I have had two different people now ask me why the one pillar hangs over the front porch, as it looks unbalanced.  I guess Sagewood is indicating they would buy a brand new car with one headlight off center.  This is likely another case where there was no supervision of the house as it was being built and an issue that should have been caught by Sagewood and was not.On the minor crack in the porch, it has a minor crack in a control joint, the control joint is put into the slab just for that reason to control minor cracking in a slab of cement. Concrete slabs crack in colorado, no getting around this, with our constant changing temps, and freeze and thaw, concrete slabs crack. We put control joints in to direct the cracking. We poured ,steel reinforced ,4000 psi cement with fiber mesh, in all our slabs of cement, well above the standard used in the industry.  On the hand rail, the building dept in this county did not require us to provide one, and nor does the working prints call for one, if the owner would like to pay for this, he is more than welcome to do so. The issue [redacted] keeps bring up, about notification on items, and not being responded to, is totally off line, [redacted] is a constant complainer, and to satisfy his unrealistic conception of us being johnny on the spot for every little item is far above the industry standard. We have done countless punch items for this person, and have been to his house many many times. ( I have emails that can prove Sagewood would not even reply to my list of punch list items for weeks and sometimes months at a time.  I would be glad to supply this information such that other people that might be as unfortunate as us understand what they are getting into dealing with Sagewood. ) Most builders give the owners a punch list warranty for the first 30 days. we have been trying to take care of this client over a year now. Again – reference above where a Sagewood representative said that these are normal issues and Sagewood takes care of them in the first year.  Most of his items are homeowner and home maintance   items. So he is using a venue that will print out his constant and endless little items, that any homeowner would do them selfs. We have built 12 homes during these last two years, homes that far exceed this home, both in size and quality. We have a list of very satisfied clients. But every once in awhile we get a [redacted], who cannot be satisfied no matter how much we do, and how often we show up.  For a custom home, we would have expected our experience to be much better than what we have had with Sagewood.  I can only guess that Sagewood would buy a brand new car with dings and dents and be satisfied, however we would not, and are not.The below list is what Sagewood needs to get fixed or reply to.  I conveyed last week that Thursday September 8th is when inside items could be fixed. I also indicated that outside things such as getting the deck properly cleaned could be done anytime with notice.·         Screen in back bedroom needs to be replaced as sub-contractors tore it up – Sagewood notified in January 2016 and numerous times since then with no response as to a path forward.  On Tues. 8/16/16 Sagewood was shown the wrong broken screen – a picture of the correct screen that needs to be replaced was sent to Sagewood.·         Patch foundation crack on south side of house – Sagewood notified in January 2016 and numerous times since then with no response as to a path forward.  At one point Sagewood said they would have a foundation person inspect the patch job that was done to ensure it will not leak into our finished part of the basement.·         East wall stucco leaks severely - Sagewood last notified June 8 2016 – Sagewood indicated they weren’t sure if this was fixed or not.  If they don’t know – how am I supposed to know.·         Deck was never properly cleaned after contractors spilled paint/stucco on it - Sagewood last notified June 8 2016 and numerous times before and after that date – no response from Sagewood.·         Floor tile grout cracking again in kitchen by deck door and by laundry room, and master bath.  Sagewood notified on 8/7/16 and they are working with tile guy to get this resolved.  No path forward as of yet but I suggested Thursday September 8th when other inside things are getting done.·         There is no door stop on the right side of the master bath linen closet door - Sagewood last notified June 8 2016 – no response from Sagewood.
