assessments that were received after the due date (payments are due by the 15th of the month and the Association’s collection policy is published on the website and mailed to Mr. [redacted] each November). He presently owes two $10 late fees (in addition to 2 monthly assessment payments and an NSF fee as follows: December 2015 A $1 credit is on the account January 15, 2016 No payment received - $10 late fee added January 29, 2016 $72 payment received February 4, 2016 $73 payment received February 5, 2016 $72 January payment bounced – added $25 NSF fee to account February 15, 2016 No payment received - $10 late fee added March 15, 2016 No payment received - $10 late fee added “…their enforcement fines are a complete fraud…they charge $50.00 for a trash can violation…They charge $250.00 dollars for not having your garbage cans separated more than 3 inches…” – The Big Horn Master Association Board of Directors imposes fines – not [redacted]. Mr. [redacted]’s violations of the governing documents are as follows (the Association’s Enforcement Policy and Fine Schedule are published on the website and mailed to Mr. [redacted] each November): 12/20/12 Trash can left outside – warning letter mailed to Mr. [redacted] 12/28/12 Trash can left outside again 2/3/13 Trash can left outside again – hearing letter mailed to Mr. [redacted] 2/14/13 Trash can left outside again 2/21/13 Trash can left outside again 3/7/13 Trash can left outside again 4/11/13 Trash can left outside again 4/19/13 Trash can left outside again 5/1/13 Hearing held – Board of Directors imposed $245 fine for repeated trash can storage violations, BUT they waived the fine IF there were no further violations within the next 6 months. 10/8/13 Trash can left outside again - $245 fine from 5/1/13 hearing now imposed by Board of Directors 10/21/13 Trash can left outside again 3/3/14 Mr. [redacted] put his trash can in his neighbor’s assigned space 3/25/14 Trash can left outside again – warning letter mailed to Mr. [redacted] 9/2/14 Trash can left outside again – hearing letter mailed to Mr. [redacted] 11/5/14 Hearing held – Board of Directors imposed $100 fine for repeated trash can storage violations. So, the Board of Directors imposed a $245 fine (not the claimed $250) on 5/1/13 and then a second $100 fine on 11/5/14 all for trash can storage violations. Mr. [redacted] was never fined by the Board of Directors for having his trash cans closer than 3” – although the City of Elk Grove and [redacted] do have such a restriction. The Association Rules require trash cans be stored in a manner not viewable from the common area on non-trash pick-up days and they can only be on the street from Sunday evening to Monday. Mr. [redacted]’s trash cans have been repeatedly either left on the street after Monday’s pick-up day and/or left in front of his garage door. The trash cans are easily identifiable as they have Mr. [redacted]’s address “8350” clearly written in black sharpie on the lid. All of the information in this response is on the Association’s website and is available to Mr. [redacted] to review 24/7. The only fraud being committed here is Mr. [redacted]’s complaint. All of the items in his complaint are controlled by and under the direction of the Big Horn Master Association and have nothing to do with my company – [redacted].
