Sailthru understands that the consumer initially believed he was receiving unsolicited email from Sailthru. However, Sailthru is not sending him these unsolicited emails. A third-party is forwarding emails to the consumer; Sailthru, on behalf of its client, originally sent these emails to an email...

address that is presumably maintained by this third party. However, the third party forwarding service left the email header intact to make the message appear as if it came from Sailthru. We have reviewed the header from an email the consumer provided us, and have concluded that the email was sent from the third-party forwarding directly to the consumer’s email address. This third-party is not a Sailthru client and has no affiliation with us. We are aware that many other email service providers are having similar issues with these types of forwarding services. Sailthru is working with our industry peers to identify the third-party actors engaged in these practices so that we may disallow their addresses from our clients’ lists. However there is no definitive way for Sailthru to stop a subscriber from forwarding an email to another party. Prohibiting our clients from sending to all email addresses with a specific top level domain (“TLD”) is neither practical nor appropriate. There are many legitimate domains using the TLD used by this third-party and this third-party can simply use a different TLD going forward. We recommend the consumer unsubscribe from this third-party forwarding service. If this third-party continues to send him unsolicited email, he may wish to refer them to authorities that may have jurisdiction over this type of matter, including the Federal Trade Commission.

I am not subscribed to ANYTHING. The fact that the top level domains are international and that your clients are domestic newsletters means that by blocking these domains you will not be blocking any legitimate subscribers. This is nothing more than a weak cop out. The FTC does not have jurisdiction over international spammers. YOU do but you refuse to take appropriate action.
