I am rejecting this response because: the landlord should have compromised with my roommate and I when we had first talked with her about ending our lease at the end of MayInstead, she said she was unable to do so and wanted us to continue paying rent for June and July after we had told her we were both moving out of town after graduation in MayHowever, when I went back to Las Cruces for a couple days and pay July rent, there was other tenants living in our apartmentAccording to the landlord, she said she was able to rent out our apartment because my roommate had returned her keys, in which I found out that my roommate had not done soAs I looked over the lease, I did not find any information stating that the landlord could rent out our apartment if the apartment keys were returned nor could she rent out the apartment if it is vacatedTherefore, I think that I should get my rent money back for June ($325) and July ($325) if other tenants are living in our apartment and paying the same amount of rentAdditionally, The landlord is very unorganized when it comes to her book keeping and is quick to charge myself and my roommate for unnecessary feesI believe that all of this could have been avoided if she would have came to an agreement with us and would have never given us problems while renting from Casa Bella Apartments

As I previously answered with Ms*** on 7/5/16: Maintenance went into apt to follow up on drywall work done on ceiling The unit was completely empty and appeared vacatedAnother tenant wanted to transfer from a br to a 2br
so Salas-Zuhl, LLC charged them the difference on the apartment when they moved into the 2br unit from June 17th thru the end of month They paid $62.40. On 6/I spoke to *** on the phone and offered to pay her the prorate that ** paid to MOVE INTO ** As of today 7/11/unit ** is still vacant They paid which was the difference from a br unit to a 2br unit (days x = 62.40) I offered to let her keep her items in ** since she told me she needed the unit to store her things She didn't want an upstairs unit, so I offered *** Place #which was a downstairs unit that she could store her items Ms*** declined the offer of the apartment to store her items as well as the pro-rate ($62.40), which I offered to credit her. The previous problems that Ms*** is referring to is I had sent her a notice that rent was due a few months ago I made a mistake (saw that she had already paid her half), let *** know, told her she was good and apologized for the mistake ***'s lease ended at the end of July She asked me if she needed to pay for the entire month This was early June prior to the 17th I told her that she could pay half of the month as a courtesy I don't know why *** is asking for $as she was credited $for July rent leaving a balance of $for July rent, which Salas-Zuhl, LLC is willing to pay to *** Thank you

I did NOT pressure Ms*** or any of the people accompanying her that day We don't every employ high pressure tactics The units are popular due to the fact that they are well maintained, close to the university and reasonably priced They liked unit Aand chose to secure the unit on their own free will as demonstrated by Ms*** filling out both a Rental Application and a Co-signer Form, signing both documents and remitting money to secure the unit The application was approved (checked info on-line as part of application process) and I informed Ms*** and all present that the application was approved for her son *** with her listed as co-signer Prior to receiving any monies to secure unit, I pointed to page of the Rental Application (right above where Ms*** agreed to the terms that say, "If I DO NOT move into an apartment and am approved then the money given is non-refundable".) and emphasized, DO NOT GIVE ME MONEY UNLESS you will be MOVING INTO AN APARTMENT All the money remitted was received from Ms*** It was not a joint application Each prospective tenant fills out their own applications I gave Kaelen another application and informed all parties that we could add Kaelen to lease In conclusion, High pressure tactics are never employed by us The unit was secured by Ms*** of her own free will and she was aware of the policy as demonstrated by her signature on both the Rental Application and Co-signer form

I am rejecting this response because:
As the lady ( Mrs ***) mentioned 1) It was a joint applicationThe fact that the other party DID NOT even complete an application by itself indicates that the application process WAS NOT COMPLETED2) The Lady also very clearly stated that during the process of the application, prior to approval she would have to run the drivers licenses through the court databases to ensure that they were fit renters ( which is a routine practice apparently to ensure safety)We filled out application on a Friday so prior to approval she still needed to do that.3) The lady INSISTED THAT THE MONEY WAS ONLY to ensure that the apartment would be HELD until the application process is completed ( the other applicant's mother still needed to fill the paperwork) especially as she very emphatically stated to us ( AND SHE HAS CONFIRMED IN HER RESPONSE HERE) that her apartments were in high demand and that we CANNOT BE ENSURED of consideration unless we put down the moneyIT was this HIGH PRESSURE tactics which made me leave the money with herShe gave me example upon example of how the apartments were so great and how safe my son would be thereNaturally as a caring parent I wanted to make sure that the apartment was still available by the time the ***'s mom ( who lives in chicago) had a chance to complete the application and the lady had a chance to run the drivers licenses through the court databases as she explained to us.4) We filled the form and paid the money a little after one pm on Friday afternoonMy husband called her within hours to tell her that ***'s mom was not happy with the placeBy the time of the call ***'s mom had not even received the paperwork that was promised by the lady to be delivered via email...AND I HAD NOT RECEIVED ANY VERBAL OR WRITTEN CONFIRMATION OF MY PART OF THE APPLICATION BEING ACCEPTEDSo when the lady says we called her after a couple of days...she is lyingI can give you my phone record of the call made on saturdayAdditionally on Monday my husband visited the office personally only to be told by her son that the lady was on a cruise in the Bahamas and couldn't be reached for a week,so for her to say that we spoke to her after a couple of days is a lie as well.WHAT I OBJECT TO IS THE HIGH PRESSURE DECEPTIVE SALES TACTICS EMPLOYED by Casa Bella and Mrs ***She was talking fast and pushing papers and urging us to sign...even AFTER I REPEATEDLY ASKED...why do I have to pay nowShe kept repeating...THIS IS THE VERY LAST ONE I have and it will definitely be goneI have so many calls to returnBy putting the money down you are ensuring that I will not give it away to someone elseIF THIS IS NOT DECEPTIVE BUSINESS PRACTICE I DONT KNOW WHAT ISThe fact that she never even emailed Mrs *** ( ***'s mom) the paperwork indicates to me all along that her primary intention was to pocket depositsI still maintain that in a JOINT application....by definition BOTH parties need to complete the application before the application can even be considered for approvalI would very much like Revdex.com to ensure that such corrupt business practices be stopped in the interest of the consumerI will be making an appeal to the local TV station in the Las Cruces area and the NMSU campus students to beware of such practicesAlso the fact that this company also builds homes ( *** HOMES) in the las cruces area leads me to fear for the consumer who is preyed upon by such businesses whose primary goal is to make a fast buck at the cost of caring parents and homeownersI would urge Revdex.com to talk to the business to repay my deposit because it was obtained fraudulentlyMy next step will be the Small Claims CourtI am sure there are many folks like me who have fallen victim to these practices and the public needs to be made aware of such companies

Mrand Mrs*** came by the Casabella apartments with their son *** and friend *** looking for a two bedroom apartment It is high-season for the apartments as they are located two blocks from NMSU This particular unit was the only downstairs unit with a backyard and all tile
for I showed Mrand Mrs***, their son and friend the unit and they liked itMrs*** proceeded to fill out a rental application and co-signer form for the unit and signed both formsI followed up on the application and they were approved Prior to receiving money, I informed all parties DO NOT GIVE ME MONEY unless you will be moving into an apartment! The rental application clearly states, "If I DO NOT move into an apartment and am approved then the money given is nonrefundable Mrs*** signed and dated both the application and co-signer form and gave me money and a check to secure the unitI received a call a few days later and Mr*** told me that his sons friend *** didn't want to move into the apartmentI reiterated that I told them NOT to give me money to hold the unit if they weren't going to move inI offered to apply the money towards a one bedroom unit for *** and they declined I informed all parties that were present verbally prior to remitting money Mrs*** remitted the money and she agreed in writing by signing the application I emphatically told them not to remit money if they were not going to move into the apartment Later that day, I turned down two potential tenants that were interested in A(one of our model units) because I had already received a commitment from Mrs***

I disagree with the rejection of complaint I did compromise ***'s lease ended and end of July and ***s end of June I credited back days x to both *** and *** from the 17th of June to the end of month.I also only charged *** 1/of July which was before anyone moved into ** as a courtesy The vast majority of leases near the university end in July I also remitted to *** after the unit was rented so she's been credited forthe entire month of July I also previously apologized when I told her that she owed one of the month's but it doesn't appear that she is willing to accept my apology Thank you

I am rejecting this response because:The simple fact of the matter is that the rental agreement was for two people to share the apartment. The fact that the other party DID not complete the application would indicate that the application process in of itself wasnt complete. Secondly, I was told REPEATEDLY that this was the LAST apartment available that WAS non CARPETED ( my son is an asthmatic and I was very happy about it being tiled)  AND that they were in high demand. I was NEVER told that I was approved, in fact I was not even given a copy of the application. Had I been approved , should I not have received a copy of the application marked approved? I even asked her that the application fee was $35 so why did I have to pay a deposit and her response was to guarantee that I would have it. In her words it was " TO hold the apartment for you until Mrs [redacted] fills out the form and is approved". if this is NOT high pressure tactics, then I don't know what is. She is using fine print as an excuse to make a fast buck and her intent is apparent given that she did not even bother to send an application over to Mrs [redacted]. She figured either way she had my money and her fine print would let her keep it. Moreover the deposit was $400 and if her intentions were stellar as she claims, then she should have ONLY taken $200 from me but she asked me to put down the entire amount and actually asked me if I was willing to out down money for the other kid as well. she was prepared to take $800 from me. The entire time I was filling it out, she kept me in conversation regarding vacation and travel and such in order to prevent me from really paying attention and kept reassuring me that the payment was a formality.The fact that she abjectly lied that I called her " SEVERAL" days later and spoke to her on the phone and cancelled when the fact of the matter is that I called the very next day speaks volumes of her integrity. I have attached here a copy of my bill showing a 4 min conversation on Saturday Aug 15 at 1.34 pm which is less than 24 hours after we filled the application. If she were an honest person she would want to resolve this and pay me back all or at least $300 of my deposit. I am willing to let go of a $100 for my assumption that she was a genuine person. I have been a businesswoman for most of my life. There is the letter of the law and the spirit of the law and such a thing as customer service. As a business owner I have put the customer first on many an occasion simply because it is the right thing to do. It is not like she lost renters because my pending application caused her loss of business. Mrs [redacted] knows it as well as I do that if she really meant to rent that apartment , she would have sent the application over to Mrs [redacted] ( I am willing to get a sworn deposition from Mrs [redacted] to attest to that fact). Mrs [redacted] figured that she had my deposit money, so even if the application was not completed she could keep my  money ( which is almost equivalent to one month rent) and rent it out to someone else and make money all over again.Kindly ask her that if I was indeed approved, why didn't she take rent money from me. As you can very well judge from her responses what kind of business practices she employs. Like I said before, if she really is an upstanding businesswoman she would compromise and refund me all or part of my money.

difference on the apt when they moved into the 2br.    On 6/22 at 10:34, I spoke to [redacted] on the phone and offered to pay her the pro-rate that ** paid to move into ** (the difference from a 1 bedroom unit ([redacted]) and a two bedroom unit ([redacted])).  As of today, 6/27/16 unit ** is still vacant.  They paid 62.40 which was the difference from a 1 br unit ([redacted]) to a 2br unit ([redacted]) 15 days x 4.16 = 62.40.  I offered to let her keep her items in ** since she told me she needed the unit to store her things. She did not want an upstairs unit, so I offered [redacted]. She declined this offer of the apartment to store her items as well as the pro-rate, which I am still offering.The deposit return ([redacted] remitted) form will be returned to the tenants within 30 days after the lease has ended, as stated by the contract. The contract states “upon termination of the residency, owner shall deliver or mail to the resident, at the location designated by the resident, and within thirty days of said termination, the deposit, together with a written itemization of deduction, if any, from said deposit, and reasons thereof.”  I don’t know what [redacted] is referring to regarding a $60 filing fee.  I made a mistake and noticed that her roommate had paid her half of rent and apologized for the mistake.
