These people sell puppies. I paid over $2500 for a puppy. I was going to have to drive 9 hrs to get it. I asked if we could pick it up seven days before the 29th which is the day she has listed , but "is not set in stone." She refused to accommodate us. We are a great family. We have one Chihuahua. We paid in full in good faith and were doing everything appropriately. These people refused to abide by their website rules for no reason but to be difficult. Then they refused to say anything or return my money for the second time. For $2596 and 9 hrs of driving to be placed in a wonderful home, these people held the line even though they state it is not firm for no reason but to be jerks. I want a full refund of $2500 plus 96 plus 96.

To whom it may concern,

Yes, I do sell Chihuahua puppies. I require that an application for consideration of interested parties to submit a puppy application. The application can be found on our website. If you own a home, I require proof of home ownership. If you rent your home, I require permission from the landlord. I ask what current pets you have and then ask for a current Veterinarian for reference to contact. I also ask for one to two personal references. I also prefer to connect with the applicant on a social media platform, but I understand that not all families are a part of social media and that’s okay. I try to get to know the applicant via emails, text messages, and phone calls. If they have pets already, I usually ask for some photos and ask if they can show me what kind of living environment they could provide to a puppy if I were to approve their application. On my website, it does state that I can refuse service to anyone at my discretion and I can cancel a sale if I feel it is necessary. This is also stated in a puppy contract that is provided to every single customer who purchases a puppy from us.

Moving forward, *** submitted an application off of my website for a puppy named ***. I processed her application like I have processed many other applications previously. I went ahead and pre-approved her application for the adoption of *** after all areas were checked out. *** is in a litter of pups that were born in late December and they are very small in size. My puppies do not leave my care until a minimum of 9 weeks of age or later. For this particular puppy, she was ready to go home on February 29th or later. I had asked *** via a phone call if this date worked on her end and she said yes. I post a potential go home date on my website but also indicate that dates are only estimates. The date posted was February 29th.

*** lives a total of 3.5 hours from me one way. She had chosen to pick up the puppy in person when we discussed the pick up arrangements.

The night that *** submitted the payment price of $2500.00 on 02/19/2020, she began texting me and stating that the pick up date would not work on her end and she was explaining all these personal reasons. I informed her that the following weekend would be fine. She proceeded to ask if she could pick up the puppy a week earlier than her estimated release date. The text messaging followed into the next day, 02/20/2020. I explained my policy and the reasons why I don’t take my puppies away from their mom/litter mates before 9 weeks of age. I also mentioned that it’s not uncommon for breeders to hold small breed pups until 12 weeks of age, just to ensure they are thriving. Despite what I had informed Michelle, she couldn’t understand why I wouldn’t release the puppy earlier than the planned agreement. She said she had contacted her Veterinarian and they had informed her that allowing pups to leave at 7 weeks is completely normal. I finally said that my answer to her was firm. I offered to hold the puppy an additional week, allowing the following weekend to be open for pick up, as well as time frames during the week. None of these options were working for Michelle. She only wanted to accept that picking up the puppy a week earlier would work. On 02/21/2020, *** then proceeded to tell me that I was not being accommodating of her family and their schedule and they own the puppy because they paid in full and I can’t hold the puppy from them. I sent one final text message to *** on 02/21/2020 stating, “It is upsetting that you think I am not being accommodating when I have offered to open up my schedule after the pick up date to work you since the 29th does not work for your schedule. I really think you should have read over the paperwork I sent to you before quickly paying for the puppy. I really do not appreciate the tone of your text message and the fact that you would state that I am not considering a good home. Thank you for your time- I will be issuing a refund to you that you had paid via PayPal. It is possible that the PayPal refund may take several business days to be transferred back to your account.”

The text messages from *** continued as well as phone calls. She went as far as finding my husband’s personal cell phone number and called him and texted him multiple times. I mean multiple times.

I submitted the refund, $2500.00, minus PayPal fees, for *** on 02/21/2020 through PayPal and it was applied back to her immediately.

*** then sent the $2500.00 back to me, regardless that I had cancelled the sale between us. *** threatened to call the police on me, contact the Revdex.com, the FDC, get a lawyer, etc.

*** has been harassing my husband all day, via text message and phone calls as well as myself. (02/21/2020).

*** then demanded a refund, which I happily sent back to her on 02/21/2020. Due to the payment being sent to me through “goods & services” off of PayPal, PayPal deducted a 2.9% service fee. The amount refunded was a reduction of their own fees. I did not keep any portion of her payment.

Due to PayPal having protections on fraudulent activity, I have refunded the same person twice in one day. The second refund was submitted on my end but has not been placed back into Michelle’s account and she is accusing me of keeping her money. I don’t want her money. I want this transaction to be complete and over. Her money will show back up in her account once PayPal releases the funds for her.

I have proof of refunding *** for both payments that she submitted. The proof has been attached here.

*** has also gone as far as going on my public advertisements of my pups and using a false name, as “***”. *** is Michelle’s middle name.

I reserve the right to not place my puppies in homes when I feel uncomfortable. I am not keeping anyone’s money and not providing a puppy. I have done nothing wrong here, but keep my puppy safe.
