[redacted] please accept my apologies for the scheduling issues you have encounteredThis is absolutely no excuse but I did want to explain the reason we haven't been able to get your project completedThe problems are primarily weather related which started with us pouring concrete later than expected in the springThe weather didn't cooperate in the early part of spring then in June and most of July when we are at our best, we had almost non-stop rainThat set us back in our production and schedulingwhich we never recovered fromI checked on your refund and the staff told me yesterday that you called on 10-20-that was the only record they have of you calling about a refundI am the one who approves the refunds and yesterday was the first time I had heard any knowledge of your requesting a refundthe check was cut yesterday and is being mailed today for the $Our reputation for the quality of work and the size of projects we are capable of is one of the reasons we have been over booked when there are weather delaysIf we can be of help in the future please let us knowThank you

We are rejecting this response because: The desired outcomes have not been attainedFirst, we have not received a balance of $in writingThe second and most important outcome that our home is fixed has not been resolvedWe continue to have water entering our home through cracks in the outside wall and permeating into the inside wallWe still have water entering our home from the base of the steel beams that were installedThe patch work done to the walls and the installation of the sump pump has not rectified the situation caused by A-As indicated in the initial complaint, the original work done on our home created more issues than it resolvedWe understand that the warranty is for the support systemWe also understand that having water flowing into our home from the wall where the majority of the work was done and up through the floor where steel beams were installed is unacceptable by anyone's standardsWe expected some residual impact of the foundation being leveled such as the cracked drywall and damage to the lawnWe are not complaining about these reasonable residual effectsWe are complaining about unreasonable effects which resulted from negligence - lack of quality control, lack of response, lack of detailAccording to the weather records as measured at the Port Columbus airport (less than miles from our home), the actual mean temperature outside during the time period that the A-crew worked on our home (excludes the weekend and coldest day when A-did not work due to the mean temperature of degrees) are as follows: 21, 8, 13, 18, 28, and Temperatures plummeted to as low as degree Fahrenheit on a day that the crew was at our homeWe truly couldn't believe that they would do this type of work in these low temperaturesAs stated in our original complaint, we are not professionals in this arena and followed the advice given to us by those that we thought were experts in this fieldWe trusted that they knew what they were doingWe argue that it is reasonable to conclude that the consistently well-below freezing temperatures may have contributed significantly to the issues we are still experiencingWe ask - Where was the quality control to perform the work during a more optimal time period? Where was the follto check the quality of the work? Where was the response to issues that were reported? Point-by-point responses to A-1's statement:Thank you for the apologyWe appreciate it more than you knowThe issues are still not remediedWe have been monitoring the area since the sump pump was installed and took a video and pictures on 9/12/- the first rainfall after the sump pump was installedWe will try to attach the videoWe have not reached out to A-directly after filing this complaint through the Revdex.com because we feel like it is time for them to take the initiative to resolve these issuesWe are through calling, leaving messages, etcwith little or no responseWe are the consumer, the customer, the victimsA company that claims to have integrity (as the TV commercials indicate) would folland monitor for quality without having to be constantly called by the customer, especially in a case like thisThe foreman on the project advised us that a sump pump was not necessary, but the steel beams were which is why we had the beams installedHe told us the drain pipe to the footer would be sufficientLater we were told (by the owner) that the drain pipe wasn't even installed properly and that more dirt needed to be brought in because the dirt sloped toward the house (within a month dirt was moved around, but it continues to slope toward the house)We are not sure who to believe since representatives from A-questioned work done by their own companyAs indicated in the original complaint, there was no water to be stopped when this project startedWe never said we didn't want it excavated againWe were told by the foreman that he was confident that he could eradicate the problem with a less invasive approach (addressing the problem from the inside), instead of digging up the yard againWe followed this adviceWe were also assured that if it didn't work, they would re-excavate to fix the problemWe called many times to inform A-that it did not work over the course of several months without any response or actionIt was only after we had another flood (and an upset voice mail we left directly to one of the owners) in which we received any actionNo re-excavation occurred or was even offered to us, but instead a sump pump was installedThe same foreman who installed the sump pump told us that he would requisition additional dirt to re-grade that side of the house so that it would slope away from the foundationThis never occurredWhen the owner called, he said they would come out to install a sump crock to address the problemHe NEVER mentioned anything about the cost at any point in time - not during the phone call, the scheduling, or the installationWe thought finally they were going to do something about this...we still didn't understand why re-excavation was not mentioned as an option anymore, but again we trusted the professionalsSee original complaint for more details about this lack of communicationThere was no follof any sort to see if the issues had been resolved after the installation of the sump pumpNot even a courtesy phone call to either of usAs for the original estimate referred to by the owner it states, "Awill need to attach new pvc footer tile to some type of drain for natural drainage or sump pump." There was no "recommended option" of a sump pump, only that access to natural drainage or a sump pump would be necessaryThe pipe that was installed into the existing footer drain is what the foreman opted to doDue to the fact that the ground was frozen solid in chunks of dirt when the project occurred, re-grading more than once is not unusualWe were never told that "we only come back once" to re-gradeThe last thing we were told by the foreman when the sump pump and crock were installed was that he would order more dirt and re-gradingObviously, he acknowledged that additional re-grading was necessary, but the second re-grading never occurredThis is a very unprofessional response by the ownerIt is degrading and a personal attack, which is unfounded and unnecessaryWe are trying to resolve a dispute professionally hereWe acknowledge that both of us would take turns calling to report issues we were experiencing and asking for action to be takenWe would also call to find out when to the work had been rescheduled because they were always canceling on us even after we would take time off of work to be at the houseWe even had a time where they didn't call and didn't show upYes, there were times when we were upset because we've had several floodsAt no time did we call people names, degrade them, or act "rude"In fact, [redacted] cried on the phone because she was so sad about the lack of response and the ongoing damage occurring to her homeAt times, members of the office staff were very understanding, but they didn't have any power to assist usWe were always told that they would pass on the informationIt's not like we would call and they would jump into actionIt would typically take several weeks before we received a return phone call and even that rarely transpired into any action.This complaint comes from BOTH [redacted] and [redacted] We jointly sat down to write it and again, we are both sitting here to record our responseWe would appreciate a timely response to address these ongoing concerns once and for all Regards, [redacted] and [redacted] Note: We tried to attach the video of the area with the water still coming into the house, but we received a server error message (404)The file may be too largeIn the past, we tried to share files via Dropbox, but neither of the two people we emailed with a link ever accessed the videosIf you are interested in viewing it, please let us know and we we upload it to the Dropbox folder and give you access

I have sent a separate letter to Mr*** ***This letter is in response to *** ***I do want to apologize to the ***'s for the amount of time it took to remedy the issuesI am only going by what the foreman at the project told me early on in the project when I asked why we didn't
install the sump crockHe said the homeowner didn't want itI mentioned to him that I could appreciate them not wanting it but was it needed or was he able to stop the waterHe informed me he thought he did stop the waterThe homeowners called and told us that the water hadn't stoppedI went out to look at the issue myselfThis was the first time I had seen the project (my brother quoted this job)I told Mr*** that the way my guy put the footer tile in and with the disturbed soil next to and under the footing that what he did would not stop the waterThat we would need to re-excavate the side of the house and install the drain tile differentlyI sent the same guy out that had done the initial project to correct the problemHe went out and spent a day there came back and said it was doneI asked him how he excavated, put the tile in and backfilled so quicklyHe told me the homeowner didn't want it excavated againSo he did some tuck pointing and applied some water proofing materialI told him that wasn't going to work but we would wait to see if a combination of that repair and the ground consolidating would shed the water enough to stop the issueMrs*** called and said later that the repair did not stop the water. I called and talked with Mr*** and told him that we would have to put in the sump crock and pump with interior tileThat I would do it for the original estimate, which now it was a stand alone project but it should have been done originallyHe said fine, so we scheduled and put in the sump crock.We billed the work as I stated early working off the original invoiceI have not communicated with the homeowners since they filled this complaintI would assume that the water problem is fixedThe homeowner states that they never had a water problem, there was enough original water that a sump crock and pump was a recommended option in the beginning.Mrs*** didn't mention that we came out and re-gradeed the area once after the original work was completedWe do re-grading one time after a project of this natureIt is more than any of our competitors do but we tell them that we only come back onceOtherwise we would return to a home or times because the soil will settle for years, less and less each time. We had a very difficult time communicating with the ***s*** would call the office and we would tell him what was going to happenThen Mrs*** would call and be very rude asking why we hadn't contacted them when we had already talked with ***This happened several timesAs a matter of fact the last time I had talked to ***, I called Mrs*** first and she never returned my call. In conclusion I will take a good portion of the responsibility for the time table but it wasn't all because of usMy office said Mrs*** was very rude whenever she would call, *** was always respectful and reasonable. If Mrs*** doesn't want to pay the invoice then I will set her balance to $but I am not going to do any additional work at her home with the exception that if the helical anchors we installed were to fail we will stand behind the warrantyThat is what the lifetime warranty is for not the water issueAsk her to please read her warrantyHopefully the sump crock, sump pump, interior drain and tuck pointing corrected her water problem

I return to Columbus the later part of the week of 2-8-I will have my office call the ***s to set up a time for my production manager and myself to come out and go over the issues. during our meeting we will set a date for the repairs to be madeOnce we start the repairs we will stay on site until they are completed. Someone from my office will be calling one of you on Monday Feb8th to set our meeting timeI will personally watch this go through the process so that I don't get bad information from anyone on my team. Sorry for the confusion and I look forward to a fair and equitable solution

***, please accept my apologies for not getting you the estimate for the items we discussed at your rental on ***I was out of town for two weeks shortly after you and I meetWhile out of town I experienced some medical issues that have caused me to slow my response time for getting
estimates out. The size of the project is not a determining factor for whether or not someone receives an estimate.
