Review: The masonry contractor began stucco work on my home on Sept. 5, 2014. It was to take approximately one week to 10 days for completion. Per the proposal, payments were to be made in thirds: 1/3 at start, 1/3 when 1/2 done, and 1/3 when complete. The 2/3 payment was paid in advance of half the work done because the contractor told me he needed the advanced funds in order to proceed because he could not move forward until he received payment from a former job. The 2/3 payment was paid on Sept. 7,2014 only 3 days after the first payment, without the required work done per contract (breach of contract?) On Sept. 22,2014 the contractor asked for another advance payment on the final 1/3 payment and I refused. He then told me I may then have to wait for completion of work until he receives monies from a past job. I'm felling exploited. It is now 6 weeks and the work is only about 1/2 done. The contractor will not give me a completion date in writing. He ignores texts and emails. He has been on my property only 7 out of the last 42 days since work began. His tools, scaffolding, cement bags, trash, etc. are spread all over my property. This could go on indefinitely.Desired Settlement: I'd like to know if I can fire him and find someone else to complete the job. If yes, how do I go about having him remove his equipment from my property? I have given him notice that if the work was not completed by 10/16/2014, I would file complaints. I need to find a way to get the work done. I would expect that I am not obligated to honor the final payment since he never completed the purposed work per contract. Correct?
