I wanted to reject the offer from the businessThis paper work shows all the time *** and his business have taken with this issueMany promises to fix the situation and only extending the waiting periodTo resolve the situation, we would like to have a third party company we choose complete the work *** is proposing be done in order to cover the stains his company left on our concrete to what he claims will, "have the entire rear yard concrete sealed with a product that would make their yard look better than it ever had before." ***/San Diego Roofing would cover all fees with the third party company

However, my response and offer to these two individuals still standsBut, I will give them one additional option.
First of all I need to lay out a little more foundation here.
#1- I cannot and will not allow these two homeowners to acquire bids for ANY amount of work on my behalf The last round of estimates they sought out and received later revealed their attempts to remodel all of their back yard concrete on my company's dimeThis was misrepresentation on their part, and this company does not trust them with any new estimate bidsAs a matter of fact, they received one bid (which they insisted I pay for) that included a repair to their front porch which had nothing to do with the alleged damage we causedThe bids they previously presented to me were in an attempt to defraud my company into paying for an entire back yard concrete remodel to beautify their neglected and previously damaged backyard on my company's dime, of which we have plenty of supporting photographsThese individuals have had numerous items left on and dragged across their concrete patio, including a large jacuzzi, many planters, patio furniture, bbq's, outdoor carpets and mats, and an entire zoo of animals including years of feces and urine from their small zooIt's still difficult to believe their exaggerated damage claim they claim resulted from a few drops of some unknown substance.
#2- Their attempt to defraud my company brings into question the entire validity of their claimAt this point, we believe there is a good possibility that there was no damage to begin with, and that the "drips" may have been placed there by the owners themselves, or possibly there prior to our arrival to their homeHowever, this we will never knowTheir attempts to defraud this company with their previous bids for an entire back yard concrete remodel for between $3000-has now revealed their true characterIn addition, the opinion of the concrete specialist I took to their home on my behalf in April, who did a field inspection and client interview with these two individuals (the home owners) is also identicalTheir attempts to have us pay for an entire backyard remodel is the reason for this delay in resolving this matter.
So, here are their options.
Option 1- We, SDRI will seal their entire back yard at our expense with our personnel under the guidance and supervision of our concrete specialist and the manufacturer of the sealer we propose to use which they (the home owners) have received by me via emailThey have the brand name, specs and the full MSDS sheets for the products we proposed to use.
Option 2-We, SDRI will hire a concrete specialist to apply sealant to the alleged damaged area of approximately 4' X 10'.
Again, this is our last offer in compromise, and we would be performing either option under protestHowever, we would have either task performed in a professional workmanlike manner, and we would also be taking pictures of the work being performed as it is taking place both prior to and after the treatmentThese pictures would be in addition to the pictures we already have in our company's possession documenting the poor condition of the entire rear yard concrete surface, which has been in bad condition for several yearsThe owners never properly sealed their concrete, leaving it susceptible to premature fading, damage and moisture penetration.
Also, we would prefer the homeowners and their multiple animals not be present at the time of installation of this coating, as we feel they could potentially cause damage at the install stage as the coating will need ample time to dry without any foot traffic or any other potential accidents as a result of any premature contact with the sealers prior to their correct drying and cure ratesAnd no we will not provide any cost allowance for their relocation for the day.
Any further correspondence that is not considered a part of choosing either one of those two options by the homeowners will be considered harassment at which time we will need to take the proper legal steps to end any further correspondence.
The alleged "damaged areas" are quite frankly the best looking part of the entire back yard in the opinion of our concrete specialist and in our opinion as wellWe have pictures.
However in closing, we hope we can come to an agreement in an effort to end this "battle" that seems to never endQuite frankly we are done going back and fourth, as these home owners are the root cause for this entire delay.
Although the cost for me is greater to have the entire rear yard concrete sealed using the skilled labor of our employees, I feel this would absolutely leave these two homeowners in the best place possible, at which we would allow bygones to be bygones, leaving them with a much nicer back yard than before we first arrived at their property, and we could all move on.
The warranty on the sealers would be a manufacturer warranty directly from the manufacturer which we are qualified to apply as a roofing, coating and sheetmetal installation contractor.

Thank you for sending me a copy of this complaint. I am more than happy to respond to this complaint in this letter.
 
First of all, we did complete a small roofing repair on the [redacted]' home in late 2013. Upon completion, we were...

notified by them that there was an issue with a few droplets of primer on their concrete. They proceeded to pay us in full for our roof repair. 
 
Within a month, the homeowners approached us with a repair order of over $4000. 
 
Upon closer inspection of the work bid by a concrete company of their choice, it appeared that the homeowners wanted their entire backyard completely repaved, and not just the few square feet of previously stained concrete from which we had already removed the stains. 
 
Then, upon a site visit I took many photos that show their entire backyard in disrepair and not being maintained properly therefore causing all of their concrete to be unsightly. These are from hot tubs, bbq's, planters, picnic tables, outdoor carpets, pet stains etc. These homeowners have allowed their back yard to become weathered worn and stained over the years of their own abuse and they simply wanted to have their entire backyard remodeled at our expense. 
 
I contacted a concrete professional, had them come out to the site and run an evaluation of the "problem".  They literally saw no issues with the concrete in the area they claimed we stained. In fact, this area was the best looking part of their entire back yard, and he insisted we take this to court. 
 
So, in order to appease the owners, I agreed to have the entire rear yard concrete sealed with a product that would make their yard look better than it ever had before. They declined. 
 
They still want their entire back yard concrete removed and replaced. To this I say absolutely not, and we now have the testimony and field observations of the concrete company we hired to evaluate the site a couple of months ago and we feel we have what we need in order to prevail in a court of law. 
 
However, we would like to extend the original offer to re-seal the ENTIRE back yard concrete with a beautifying sealer, but we will NOT scrape out the entire back yard of concrete and re-pour it for them. This demand on their part is ludicrous. 
 
We would perform the sealant application with the direction of the manufacturer. If they would like that option we would be more than happy to oblige.

Unfortunately, [redacted] still continues to distract from the core issue. Regardless of any inspection or permit they claimed to have done. Regardless of a rodent problem, the fact of the matter is the roof was not completely sealed. There were large holes in several areas under eaves that were not sealed and constructed to code. Every other issue mentioned in his response is completely irrelevant. Not to mention false. I have full evidence showing where the roof was not completed and they actually came out and saw it first hand.My electrical panel is not relevant to a roof install. My solar project was done to code by the leading provider and not a single "hole" was put in to the roof. My home was rodent proof and I have an inspection report as proof of that. Rodents showed up and walked right in to the attic through holes SDR created.  This is fact with plenty of evidence to support it.  [redacted] is in a "win" mentality. Instead of just doing the right thing he wants to battle. Just read his [redacted] reviews. There are terrible ones and [redacted] just continues to blame everyone else but himself. This is a pattern.

Thank you for the opportunity to reply.  We are still trying to understand why items he alleges were done two years ago and were not brought up then, has any relevance to today. I believe he is only trying to paint a bad picture of us, which would be inaccurate.  So, I will only...

address the current issue.  This homeowner purchased his home, which was in very bad condition, poorly constructed and needed many structural enhancements in order to properly maintain the home's integrity. We did our part by reroofing his home. There were many structural issues which we had to modify in order to meet current building standards. The county inspected and passed a final roof permit after we completed the reroofing project. That will more than show compliance with all building codes.  We also had to assist the homeowner in an illegal electrical condition at the property. We assisted in the correction of that particular item for the homeowner.  Our company went above and beyond the call of duty on every aspect of his project.  Now the homeowner expects our company to have protected his home from rodents, which any home is at risk for rodent intrusion.  He lives in a very heavily wooded area, therefore is very prone to rodent infestation. He is expecting this company to have taken the role of a pest control company. Furthermore, the insulation in his home is decades old,  and he is simply trying to extort the expense for new insulation. Furthermore, this homeowner has decided to have solar panels installed by a third-party, p poking dozens of unauthorized holes into his new roof,  therefore voiding out his entire roof warranty. We are sorry that he has made bad decisions. Thank you.

I dont need the owner to respond...I just want this clearly documented I will be taking other legal and state board action.
