Thank you for your recent correspondence. The Stardust Vacation Club is a timeshare members' Association established in 1986. The rules and regulations that we operate under arise from the California Bureau of Real Estate, formerly known as the Department of Real Estate. Before timeshare could be...

sold at the Stardust location, a public report, which in effect is a permit, is issued by the State of California after all requirements are met. As a result of the rules and regulations of the California Bureau of Real Estate, a Declaration of Timeshare Use is recorded against the property. This lengthy documents outlines the obligations and duties of everyone that participates, including the Association and its members. Article II of the Declaration provides that each deeded owner has certain rights and obligations. They have, for example, the right to make a reservation to use their timeshare annually. Article V states each timeshare member, by accepting a deed for a timeshare interval, agrees to pay annual maintenance assessments. Nowhere in the Declaration is there an obligation or requirement for the Association to accept the return of any timeshare interval. A member that decides not to own, must sell their interval to another party or each some other agreement that might be mutually acceptable. The purpose of the Revdex.com is to address issues generally of consumer fraud, product defects and the like. There are no such issues here. The complainant is demanding that the Association simply take back her timeshare interval and be excused of further obligations under the Declaration in which she agreed to many years ago. We hope that the complainant re-engages the Association to seek a solution that is mutually acceptable, but as it presently stands, she can continue to exercise her rights as a member and fulfill her obligations. The Stardust Vacation Club consists of over 4,000 members who enjoy the resort and abide by the rules and regulations as established by the California Bureau of Real Estate and as expressed by its governing documents.  Sincerely,[redacted]Assistant General Manager
