Review: On September 6, 2013, my vehicle was towed from Camp Pendleton by San Luis Rey Auto Salvage & Towing. Upon picking my vehicle up, I noticed military gear & equipment missing. Before making any accusations, I had contacted the military police officer to ask what he had seen and recording in the vehicle prior to the vehicle being towed to confirm that the items were present in the vehicle upon being towed. Once I confirmed through the officer those items were in the car when towed, I called San Luis Rey Auto Salvage & Towing to inquire about these items. I did not even get the chance to ask about the specific items nor even give my car license plate number or a description or date of the vehicle when the receptionist was so fast to say "we didn't take anything. we don't have it." I literally did not even get to say anything about my vehicle or description so for someone to jump to the conclusion I was making any accusations clearly shows she is guilty. This is military gear and equipment we are talking about. Hard working people who put their lives on the line to protect this country and in return, people want to STEAL their property, actually its military/federal property. That is really sad. We just want our military gear & equipment back, no questions asked!Desired Settlement: Return my military gear & equipment, no questions asked!

This is in response to Complaint #[redacted]:

Approximately 10 days ago, our towing agent received the following call: This is her description of the phone call....the caller wouldn't identify the vehicle, but it sounds like it could be this one.

"A man called, said his car had been impounded a week earlier (?) and he picked it up and that there was stuff missing out of the trunk. "I told him we generally didn't take stuff out of the trunk and he said "of course you would say that". He then launched into accusations of our stealing his belongings with which I responded with "of course you would say that". I asked if he wasn't going to give the vehicle information so I could look it up and see if there was anything still here and he said "NO", he wasn't going to give me any info....that he was going to bring the police and file a report, and then he hung up on me".

I was present for the agent's end of the phone call. I remember this phone call as I expected to see someone show up with the police, and that didn't happen.

We have had no contact with [redacted]. She appears to be the registered owner but sent a Power of Attorney for [redacted] to pick up her vehicle. When this car was impounded there was the Camp Pendleton Provost Marshal's DWI and ImPoundment report showing a [redacted] as the driver. So there appears to be several people involved.

Usually when a vehicle is retrieved, the owner will verify that all their belongings are in it, and then will sign for receipt of vehicle, which was done. He certainly didn't say anything about missing belongings at the time of the pickup. I would suggest that the best way to handle this matter is for her to contact the Camp Pendleton Provost Marshal's Office and make a complaint. They would then contact us.

A police report was already filed with Camp Pendleton's Military Police. Multiple police reports were not allowed with Oceanside PD. The items were thought to have been in the trunk but the on-site officer recalled it was all in the backseat. The items were witnessed by the officer to have been present in the vehicle upon towing. In the backseat. However, the fact of the matter is those items were in the vehicle. The employee who answered the phone said that it might be there & said to not come to the yard unless a cop was present. We just want our items back. One expensive item that was present was a gas mask which is no longer present. The POA was done and give to a higher staff NCO SSgt [redacted] because I was not in California that weekend. We just want our military gear back whether you spoke to me, [redacted], Pochantas, or [redacted] The fact of the matter is the items were missing upon retrieval from your business & it's still missing & your employee couldn't even say she'd look to see if it was taken out by accident or not. She was so fast to say you guys don't have. Be a trustworthy business & return the items or directly pay the Marine Corps for it.

Review: In Dec of 2012 I sold a vehicle to a private party.That same day I completed a release of liability form with the DMV online. Three months later the vehicle was impounded by Oceanside police.San Luis Rey Towing (contracted by OPD) contacted me via letter stating that they had the vehicle and were attempting to collect towing and storage fees from me. I Informed them both on the phone and by letter that I had previously completed the release of liability and sent them a copy. Three months later I received a letter from [redacted] trying to collect the $1800.00 Debt. At the time the vehicle was impounded I was no longer the vehicle owner and had taken all steps possible to absolve myself from interest and/or liability in regards to said vehicle. I have provided proof to San Luis Rey Towing and [redacted] to that effect.Desired Settlement: An official letter stating that no further attempts to collect this debt will be made.

We are happy to respond to this complaint. There are several errors in this customers complaint that I would like to address. First off, it was not towed by the Oceanside Police, It was towed by the Camp Pendleton Military Police. Per California law, after the vehicle was impounded, and the appropriate time passed, we initiated Lien Sale proceedings. Per California DMV vehicle records, Mr. [redacted] was the only owner of record for this vehicle. The printout showed no other owners, nor did it show that a Release of Liability had been processed for this vehicle. We have no record of Mr. [redacted] call nor any letter stating otherwise. The referenced vehicle proceeded thru it's Lien Sale and there was no buyer at auction for the vehicle. Per CVC 3068.2 the registered owner is responsible for the towing and storage fees for the vehicle, less any monies received from the sale of the vehicle. There was no money received from the sale of the vehicle, and the matter was referred to our collections company [redacted]. Since Mr. [redacted] received the collections letter from [redacted], we have received nothing but harassment from him, to include slander and verbal threats, not to mention sending my driver's out on false tow calls as a matter of extracting revenge. We have all the documentation to back up all of the above, and are happy to share that with him. Sincerely, San Luis Rey Towing

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

San Luis Rey Towing's response was laughable. I sent proof of a release of liability via certified mail to both [redacted] (the collections agency) and to San Luis Rey Towing. The Collection agency did the right thing. They accepted the letter. They review the facts. They officially dropped the collection against me. They appear to have a good deal of integrity.

San Luis Rey Towing refused the certified letter. ( I have retained proof of that for my records) Apparently they would rather not be made aware of their mistake. If calling repeatedly trying to resolve the matter and sending official documentation that supports my position is "harrasment". Well, whatever.

I think this company is predatory and should be ashamed. Since the collection agency has dropped the matter, I will as well. However if San Luis Rey Towing EVER attempts to continue efforts to collect from me in this matter they will find themselves in civil court. I don't expect an appropriate response from them. They don't have the integrity for that.

If there is an error with this situation, his complaint should be directed to the DMV.
