Dear RevDex.com:This letter  is in response to the complaint received from [redacted] Larez, ID#: [redacted].[redacted] and [redacted] moved into  San Martin apartment on March 3, 2015  and signed an 11 month  lease, which was scheduled to end...

on February 2, 2016 . [redacted] and [redacted] moved out on July 14,  2015  after we filed for eviction  for non­ payment  of their July rent. They decided to turn in keys prior  to court to avoid having to go to court for the eviction filing. In doing so, they voluntarily broke their  lease agreement  with San Martin Apartments. When a lease is broken  voluntarily, they are subject to lease break fees, which are described in the lease agreement.We were not notified until July 14,  2015, the day they turned  in their  keys, that they were having any issues in the apartment. They wanted us to waive their lease break fees by stating they had unresolved issues in their  apartment.We were informed when they were turning in keys to their  apartment that  they had found a leak, which was previously repaired, under the kitchen sink. The work order that was placed for leak under their  kitchen sink was completed in March. We were not notified of any further problems  until  they moved out. It is the resident's responsibility to notify the office if there  are any further work or ders needed. At no time after the original  repair, per Tisha's own admission, did she leave a voicemail  or an online  work order request  to have service done. I informed them that we would be happy to make any necessary repairs to the apartment, but they wer e moved out of the apartment.Any time we were contacted  for pest control or work order services we responded, as we would  with  all residents, to make repairs and schedule services. Their apartment was treated on multiple occasions for pest control services, per Tisha's request, and we would have continued to treat  the apartment for them had they decided to stay at San Martin Apartments.At San Martin apartments we take our maintenance  and pest control issues seriously and would gladly have scheduled  service and made repairs if we were properly  informed of the situation.At this time, we will not be waiving  any voluntary  lease break fees for [redacted] and [redacted]. They chose to vacate their  apartment to avoid being evicted for non-payment of rent. The situation with  unreported work orders and pest control issues has no bearing on the status of their  lease and rental payments. We have offered  to make payment  arrangements  with  [redacted] if she contacts us within 30 days of her move out.

Before moving in I had requested information about pest and sorts. I was notified that pest was not an issue and if it had become an issue they have pest control every Monday. The first week I moved in my 6 year old daughter finds a baby scorpion. That same day another was found in the first bathroom. Frantic about the issue I call the office and there response was that, that it was a normal occurrence, and they will have a pest technician come Monday morning which was 3 days from than. Come Monday no one showed up. A few days later a scorpion falls from the kitchen light on top of a guest. At this point I had called a local pest control and told them about the issue and they said for me to actually leave the apartment that there could be an infestation since I was seeing baby ones as well as big ones. I contacted the the office once again about this issues and they had refused to help in any way. I would have had to pay an enormous amount to break my lease which had seemed to be the only option they were giving me. I researched they don't like citrus so for two weeks my home smelled heavily of lemon pine cleaner. I have not seen one since, which brings me to issue two. The air conditioning unit has been broken since I moved in and all four times they have come they have "fixed" it. As I am writing this it is 111 degrees outside now can you imagine what its like in this Apartment. It has been a week after calling multiple times about it. I have even sent my daughter away to a family member due to the fact its cooler outside in 100 + weather than inside our apt. Lets also include bed bugs, rude behavior over the phone, as well withholding information such as pest issues and parking. I was not informed that there was assigned parking until I got a letter on my windshield stating they were going to tow my vehicle. At this point I just want to get out of this lease and far away from this place. The office staff although bright and cheery face to face are no help at all.
