Ms. [redacted],   We have received your response from the Revdex.com and take your complaint seriously.  In an effort to assist you we have already cancelled your account and you will not receive any further charges. Since the time your account was canceled, you have contacted your credit card company and initiated a charge back.  Because of the charge back, we cannot issue you a credit at this time because you would then end up getting a credit twice for those purchases.   We apologize for any confusion, and always do our best to resolve any customer complaint or concern in a timely manner. April 16, 2016 and shipped your package the next day.   The terms of the offer that you agreed to at the time of your order clearly state that you were to have a one week trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $94.31 eight days from the date of your order processing for the product.”     When you ordered the product you also checked a box indicating that you had read and agreed to the terms of the offer. When a customer checks that box we must assume that they have actually done what they are stating they did. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.   According to our records the first contact we had requesting the cancelation of your account was on April 16, 2016. At the time you canceled your account, we issued you a return merchandise authorization number (both through a live customer service representative and through a follow up email) so you could return your shipment to avoid any further charges. August 17, 2016 and shipped your package the next day.   The terms of the offer that you agreed to at the time of your order clearly state that you were to have a 8 day trial period starting from the date of your order processing in which you could cancel your account to avoid further charges.  They also indicate that “you must take affirmative action to avoid further charges or you will be charged in the amount of $94.31 eight days from the date of your order processing for the product.”     These terms were presented to you in multiple places on our website when you ordered our product. Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to.    When you ordered the product you also clicked a button indicating that you agreed to the terms of the offer. When a customer clicks that button we must assume that they have actually read what they are agreeing to. If there was any confusion with the terms you could have called our customer service team and they would have been happy to assist you.   Since we did not hear from you during your trial period, you were charged $94.31 on August 25, 2016.   Since the time your account was canceled, you have contacted your credit card company and initiated a chargeback for the full charge. Because of the chargeback, we cannot issue you a credit at this time because you would then end up getting a credit twice for those purchases.   Your account remains canceled and you will not receive any further shipments or charges.     Thank you,    Evan C[redacted] Spark Whitening

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.

After receiving the response from Spark Whitening, which had incorrect  information, I contacted them both by phone and email to correct the information.  I am still awaiting a reply.  That is why I did not accept or reject the response they sent to the Revdex.com. Spark claims that they can not credit my account because I have already been credited through my VISA dispute.  This is not the case, as I stated in my original complaint.  The VISA credit had been reversed on Dec. 31, 2015.  It was after that when I filed my complaint with Revdex.com.  So Spark  Whitening is not correct in the assumption that I have already been made whole on this issue.  There did not appear any way through the Revdex.com message to indicate this which is why I did not respond immediately.Please advise.[redacted]

8/11/2016Not excepting there explaination, as of today I was sent another box of the product! If they sent me a cancellation of this product, why am I still receiving it, I called them and told them I will be sending the product back!!!!!!!!!!!!!!!!!!!! Do you need a copy of the email?

I did not click to accept the agreement. A woman from the company called and said I did not complete the order. I explained that that I wanted to cancel. They are running a scam.

Additionally, you were sent an order confirmation email after your order was completed that provided a full written version of the terms you agreed to.   The first time we heard from you regarding the cancelation of your account was on May 2, 2016 when you canceled your account with a representative. Your account was immediately canceled and you have not received any shipments or charges since then.   The representative reminded you of the terms of the offer that were agreed to at the time of your order and offered a 60% refund on your charge in lieu of returning the product for a full refund.  You accepted that offer and a refund of $56.59 was issued on May 2, 2016.   Thank you,    Evan C[redacted] Spark Whitening
