Complaint: [redacted] I am rejecting this response because:I filed with the post office the forwarding address as of 5-21-The complex also had the correct phone number on file to contact myself in the event of mailing error or confusionIn the attachment, it shows the billed items, however it does show that it was undeliverable, or even that it was attempted to be mailedThere is no way to authenticate the veracity of the complex's claim that it was mailed, much less that it mailed in a timely manner Regards, [redacted]

The attached Statement of Security Deposit Account (the "SODA") was mailed to the address shown on the SODA on June 17, by the corporate office. It was not returned to the corporate office by the U.SPostal Service as undeliverable. This account was turned over to ResidentCollect
for collection on July 30, 2015. Payment arrangements must be made with ResidentCollect

I am rejecting this response because: the statement is typical of the manager of the Sandcastle ApartmentsThe lies and deception of *** ***, the manager, are just staggeringI have tons of supporting evidence showing deadly black mole growing on the walls, flooding of the apartment, eye witnesses, photographs, accounting records, and moreI feel I have more than enough evidence to support a legal partitionSo, see you in court ***

The residents in apartment 2701, [redacted] and [redacted] called on 4/29/2017 to let us know that they were having problems with roaches. We let them know that we would put them on pest control for Tuesday. By law the property is unable to provide any type of pesticide to an occupied...

unit which we informed them. Mr. [redacted] asked if he could buy his own pesticide and was told that would be up to him if he feels it warrants it. On Monday, 5/1, both residents came in and had pictures of some dead and live roaches and were very concerned. Again I explained that we were just told about the problem on Saturday and that we need time to get the problem taken care of and assured them we will. My lead maintenance, [redacted], went over to inspect the apartment (5/1) to see if there might be some holes or cracks he could fill in. He only noticed one live baby roach and a few dead ones. Mr. [redacted] told [redacted] that he had used roach bombs and boric acid through out his apartment with the exception of the den and bedroom. We are not doubting at all that they do have some roaches, but as I stated we were not given sufficient amount of time to get the issue taken care of. I know that my supervisor has been in contact with them and is trying to come to an agreement to this. Out goal is to make sure the residents are taken care of and happy. We are also going to refund them for the pesticide that they had purchased. On 5/5, [redacted], my assistant property manager and myself, [redacted], Property Manager, inspected the apartment and found no live roaches in there.

I am rejecting this response because:On 5/6 when I visited the unit to grab some of my belongings I still saw live baby roaches on the walls of the kitchen, and live larger roaches on the floors. When I returned on 5/10 I found more dead baby roaches in the kitchen cabinets, and large live ones in the kitchen drawers. Although the roaches are still an issue in the unit, we have been contacting the regional property manager and she has been taking care of us as far as our lease and getting out of our unit on good terms.

Response to [redacted] letter:   1.  The $150 was not a deposit but rather an administrative fee as set out in the Addendum to Rental Application he signed.  He paid a $100 pet deposit and a $300 non-refundable pet fee as shown on the Pet Agreement he signed.  He transferred...

from a 1 bedroom to #3207 and the deposits were handled in the same way for the 1 bedroom and he did not complain.  The staff does not tell applicants/residents that the $300 non-refundable pet fee is for future pet charges, instead the staff tells residents that it is a fee paid for the privilege of having a pet in the apartment.   2.  A copy of the final water bill is attached.      3.  He was never promised a dishwasher or new countertops, however he did receive a new stove.   4.  He is welcome to visit the Sandcastle Leasing Office to view the 60+ pictures we have supporting the cleaning charges.  FYI, his apartment was NOT clean as the pics show.  We will not remove any charges.   5.  He was not charged for carpet replacement as it was 3 years old when he moved in.  He was charged for the pad replacement due to pet damage.  There are pictures of the back of the carpet and padding and it smelled of pet pee.  The $54.21 was labor and materials for kilzing the concrete underneath the carpet padding.      6.  The 10 day notices of tag expiration are mailed out by certified mail to the record owner of the vehicle as shown in the records of the State of Texas, to the address shown In the State of Texas records.  Sometimes residents don't receive the 10 day notice because they fail to go to the post office to pick up the certified letter in response to the pink notice left by the mailman in their mail boxes, or they never receive a pink notice because they are not the record owner of the vehicle and/or do not live at the address shown in the records of the State of Texas.  Our contract with the towing company allows them to legally tow vehicles in accordance with all applicable towing laws.  If he feels there was a wrongful tow, or the towing company damaged his vehicle during the tow, then he can pursue in court.  We will not reimburse him.

Per our corporate office, the reply stays the same. The statement did have the correct mailing address on it and that is where it was mailed.
