My security deposit was partially withheld when it should not have been. Owner refuses to contact me and rectify the situation.November 18, 2014 at 11:40 AM from [redacted] to me"Please understand that an outlet that trips is not considered non-habitable and the owner is not required to repair it. Having said that I have sent an email to the owner asking him if he would like us to send someone to inspect it."November 20, 2014 at 9:25 AM to [redacted] from me in response to above"Most things could be argued that they are not considered non-habitable, but you have to admit that this is something the owner should repair. Part of his obligations are to "promptly repair all facilities and appliances, if any, as may be furnished by the Landlord as part of the Premises, including electrical." Why is he not required to fix the problem with the electrical? The breaker box is clearly part of the Premises."November 20, 2014 at 2:27 PM from [redacted] to me in response to above"A gentlemen from [redacted] will be calling you to schedule a time to look at the outlet in the garage. Regarding the HVAC, we will send Temp Control out to the house and inspect the unit. However, if they determine that there is nothing wrong then you will be responsible for the service fee."November 20, 2014 at 2:31 PM to [redacted] from me in response to above"I'm not saying there is anything wrong with the HVAC. I'm only telling you how it is behaving which is not normal. I will not be paying any service fee."November 20, 2014 at 3:12 PM from [redacted] to me in response to above"The owners are not responsible for service fees if there is nothing wrong...I cannot allow for him to pay any unnecessary service fees. However, if there is something wrong he will be responsible for the repair cost." With the messages above, I understood that [redacted] was contacting the owner to see if he wanted someone to come and inspect the breaker. The very next message I got from [redacted] was that [redacted] would be calling to schedule a time to look at it. What did that mean to me? It meant that the owner must have wanted someone to come inspect it as he said prior. I didn't authorize any repair work and even said in my response back that I wouldn't be paying any service fee. Never once did I get a response that said I would be responsible for it. The response I DID get said if something was wrong, the owner would be responsible for the repair cost. Obviously, something WAS wrong that needed repair and had nothing to do with the freezer. For that matter, I mentioned (in those same string of emails) that the freezer was not the only thing I had plugged into that outlet that caused the breaker to flip. On November 17, 2014, I said:"It has tripped with other things plugged into the same outlet is what I was saying. As in unplugging the freezer and plugging something else in. I did this a few days ago with a small compressor (yes, one that requires 15 amp). With the freezer unplugged, the breaker (not the GFI outlet) flipped twice before I could put some air in a couple bike tires. This happens with NOTHING else on that outlet and there are NO other outlets in the garage. If there is something else running to the same breaker, I have no clue what it is."With all this, the freezer was not causing the breaker to flip because:1.The breaker flipped with the freezer unplugged. 2.The freezer never flipped a breaker for years prior to living in [redacted] while also plugged into a 15 amp breaker. 3.The manual states it needs a 15 amp breaker. 4.The repairman told my wife the breaker was old and needed to be replaced I did not authorize any repair to be made and am requesting that the information above be honored and I be refunded my full security deposit of $1,950. I left [redacted] a voice mail to call me about this prior to Easter and have yet to receive that call. Desired SettlementI would like the $92.65 remaining of my security deposit that was wrongfully withheld to be refunded.
