Please accept the following as response to complaint ID#[redacted]On 3/9/17 customer purchased a 2008 Suzuki Forenza from our dealership. We originated a loan for her through Westlake Financial Services, then when her deal arrived at the bank their funding department rejected it because her job would...

not verify. [redacted] Family Autos then agreed to allow her to keep the car and finance it in house. The car was purchased used, as is with no warranty written or implied. After driving the car for a month, the car had a mechanical breakdown. We agreed to have it towed from Killeen to Waco at our expense and have our mechanic diagnose it. It turned out to be the timing chain, which consequently damaged the internal engine. We then offer to have our mechanic repair the car, and we would pay for half of the repair and put the other half on her note. She agreed. The mechanic took an exceptionally long period of time to complete the repairs which is her point of contention. In fact the repairs were all just finished on 7/30/2017. While I do agree that it's frustrating waiting that long and I do understand her frustration, the fact remains that she bought a used car strictly as is and we owe her nothing, not to mention the fact that we haven't been paid since 4/13/17. To date, I have offered to refund her $500.00 so that at least she can recoup something and she has refused. We have paid the mechanic bill of $1.989.59 in full.  We have advised her that the car is ready for pick up as of today and she stated that she does not want it anymore. She advised that all she will accept is a full refund or she will see us in court. I do not know what else we can do. Thanks,[redacted] Family Autos [redacted] DV     Important/Confidential: This communication and any files or documents attached to it are intended only for the use of the person or entity to which it is addressed. I am rejecting this response because:of one reason that changed this into what is happening now. Yes, Mr.[redacted] did sell me a car on the date he stated and he did sell it as it all of that is correct and true the problem in lies in the moment he agreed to tow the car and have it fixed and came into agreement with me to fix the car and pay half the cost, at that moment it became something that he and I agreed to pay for. Anyone who is practicing in a professional manner who have had the car fixed in a timely and efficient manner seeing as he himself is having to come out of pocket as well as my own. However this is not what transpired...week by week Mr. [redacted] had an excuse why the car was not fixed, let me list a few and I have each and every excuse week by week documented. Let see, one week the mechanic was sick, the next was he had a family emergency eventually he just begins to tell me he is at the mercy of the mechanic!! Meanwhile, all of this is going on I am struggling to get back and forth to get to my job in Temple which I was commuting to from Killeen. Whereas if Mr. [redacted] would have just fixed my car in a timely manner life could have went back to normal Mr. [redacted] could have added my half of the cost to the note and I could have resumed with my car payments but instead he continue to give me excuse after excuse for not just one month but over 3 months in that time I lost my job for not having reliable transportation. By this time I am relying on friends and family members for transportation which has made it extremely hard to search for new employment. I did and said everything that I could to make this man understand the urgency of getting my car back I cried I explained what was happening he would promise me on two separate occasion that yes the car was ready and made plans for me to pick it up and each time came up with more excuses. I have only asked Mr.[redacted] to do the right thing throughout this whole process. My car was picked up and taken to his lot on 04/26/2017 my family members drive past that lot everyday and for months it sat in the same stop!! I have the pictures to prove it. I have never experienced business practices as bad as this man. Today is 07/31/2017 Mr.[redacted] has the audacity to call me after over 3 months and tell me this car is ready for pick up and I need to bring $300.00 for a payment!! No sir that is not acceptable I have lost my job I have been financially hinder because of your shoddy business practices!! This goes far beyond me now though I have several other people who have had similar issues with this car lot who will also be coming forward with their complaints. I am determined to make sure this does not happen to another person. All I want at this point is a refund of my down payment which was $1100 cash my working 2005 chevy Cavalier which he gave me 500.00 and turned around and sold 1 week later and the payment of $300 I made of my first payment. I think this is more than fair!! I pray that no one else will have to go through this nightmare!!
