I purchased a 20-class yoga package on 7/18/2019. The package stated the classes were good for 12 months (I have an email stating this). I have used 12 of the classes and have 8 remaining to use. I found out last week that the studio is no longer offering yoga classes. They are still operating out of the same building which includes other services such as skin care and saunas. I spoke with the owner yesterday and requested a refund on the remaining 8 classes. She told me she would not refund me but would allow me to transfer my credit to her other services, which I do not want. I believe these services are all operating under the same LLC and she should refund me my money. She stated she emailed her customers in October saying that she was trying to find another person to run the studio and then again in mid-December saying she was closing the studio. I did not receive either email from them. I have received other emails (including my receipts), but did not receive these emails notifying about the business. Additionally, the notification period would not have been long enough for me to use my purchased classes either way.

I am writing in response to a complaint that was submitted by
Ms. on 1/23/2020 (ID # ***) regarding Sapphire Yoga & Wellness,
LLC. Although the business has closed, I
appreciate you reaching out and allowing me to respond.

With deep consideration, I decided in October of 2019 to step
away from this business on 1/1/2020. Running the business for 7 years had taken a toll on my health, energy
and family, so my decision was based on this. Although I was stepping away, I was 100% committed to keeping yoga in my
community. I sent out an email to all my clients (967 total) on 10/25/19 indicating
I would be actively seeking someone to take over the business and remained
hopeful yoga would continue @ Sapphire – just with a different owner. This gave students ample time to use up their
class passes. While seeking a new owner
to take over, I worked for months for free offering my clients this option to
use up any remaining class passes. In addition to the initial email, on
10/25/19, an announcement was posted on the front page of the studio’s website
as well as the studio’s Facebook page encouraging clients to check their emails
for an important message from Sapphire Yoga & Wellness. It was also later noted on the website “no
further yoga classes would be offered after 12/31/2019”.

Although
there was quite a bit of interest, I was in serious discussions with one
individual who was very interested in taking over the business. The discussions started at the end of
November. Fast forward to December 15th,
I wrote to ***. letting her know I would be willing to continue running
the business into January to give them time to transition for a comfortable and
successful takeover, but that I was committed to update my instructors and students
by the next day on the status. Unfortunately,
this person couldn’t commit to ownership within the time frame I was hoping
for. The very next day, on December 16th,
I sent an email update to all my staff and client base that I would be closing
the studio on Wednesday, January 1, 2020. I spoke to my attorney not too long after with questions on how to
properly dissolve the LLC.

I spoke with Ms. on 1/22/2020 who claimed she never
received my emails and was unaware of the studio closing until a week
prior. I verified the email we had on
file for her and she confirmed that was the correct one (please note the email she has provided to the Revdex.com is different than what she verified over the phone as a valid email). I resent the 2 emails along with a time and date stamp
of when the emails were sent. She insisted she never received them. She also said she did not see the Facebook or
website announcements.

Ms. claims I am still running a business under said name,
which I am not. The only reason the site
is still up (https://clients.mindbodyonline.com/classic/mainclass?studioid=33678) is because I am paid through 2/3/2020. With 1/1/2020 being a holiday, I called to
cancel my subscription with MindBody on 1/2/2020. I can provide the account cancellation
confirmation, if need be. I can also
provide my termination request from ADP (payroll company), which was also done
within the first week of closing. All classes and services were taken off the
schedule.

In addition to sending out the 10/25/19 and 12/16/19 emails,
I updated all platforms (website, *** business software) and put
a notification on the studio door. I
also informed the other studio owners in the building as we shared many of the
same clients. Ms. last attended a
yoga class on 11/1/2019. The
notification was posted on the door at that time. She claims she didn’t see that either. I have
several people including previous staff, clients, tenants in the building, and
persons interested in taking over the yoga studio who would confirm this was
posted.

Seven years in business and only 1 complaint has ever been reported to our local Chamber of Commerce, the Revdex.com, or
the Department of Agriculture, Trade, and Consumer Protection – all from her. The studio, which had over 900 followers on ***,
maintained a 5-star rating, and the business was voted for years in a row as
one of the best businesses in the area (Reader’s Choice – local newspaper). Clearly, the business was in good standing.

With the exception of personally calling over 900 people to
update them on the status of the studio, which is unrealistic, I can assure you
I was very transparent with my previous staff, clients, and community with
updates and did my due diligence by reaching out to as many people as possible
(a few months in advance) about my decision to close the studio on 1/1/2020 if
I couldn’t find the right person to take over by then. Again, out of that many people, she is the
ONLY person who has indicated they did not receive the emails, see the website
& *** updates, or the notifications posted on the studio door. The business is closed. No refund will be given.

I have reviewed the response made by the business in reference to complaint ID and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Sapphire Yoga's response is dishonest. Additionally, the following is what is required of Sapphire Yoga & Wellness according to the Wisconsin Department of Agriculture, Trade and Consumer Protection and the Wisconsin state statutes: "If any facility or service becomes unavailable at any time during the length of the contract, the consumer is entitled to choose an adjusted refund or a transfer of the unused portion of the membership to another affiliated center. If you choose a refund, it is the center’s responsibility to provide you with the adjusted refund." Based on this, Sapphire Yoga & Wellness actions are not only unethical but also illegal.
