Complaint[redacted] When I purchased my new 2010 lancer gts [redacted] from saskatoon mitsu in dec 2011/jan 2012,[redacted] I was promised by the sales manager [redacted] that I would recieve the X-XXXX factory rebate for buying the 2yr old car. Wasn't given a 2nd set of keys, didn't get the required delivery inspection or the full tank of gas,and I had all documentation with me to buy the car that day when they had a $1000 visa gift card for xmas season. The manager, [redacted] informed me that I had missed the deadline when it was he who called me back a week later and then another week later asking for photocopies of the paperwork I had brought in the first place. [redacted]Desired SettlementWould like the promised factory rebate back plus interestSecond set of keys [redacted] I would like to recieve the $1000 visa card [redacted]Business Response [redacted] Mr. [redacted] purchased his 2010 Mitsubishi Lancer on January 12, 2011. He is asking for a $1,000 pre-paid Master Card but does not qualify because he made his purchase after the program deadline of January 3rd, 2011 [redacted]. As well, Mr. [redacted] does not qualify for any factory rebates because he chose to finance (APR) his vehicle instead of purchasing in cash [redacted]. There were no programs available in January, 2011 that offered a $3,500 factory rebate for 2010 Mitsubishi Lancers. As per Mr. [redacted]'s request for a second key and full tank of fuel, it is our policy to give 2 sets of keys to every customer that purchases a new vehicle as well as a full tank of fuel, therefore, I informed Mr.[redacted] that he could come by the dealership at his convenience and I would have a second key cut for him and fill up his vehicle with fuel, in which he agreed and fulfilled on November 22nd. [redacted] Sales Manager[redacted] Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)[redacted]Yes I [redacted] received my second set of keys for my car almost two years after I purchased it, but I haven't ever received a 'tank of gas' as stated by Saskatoon Mitsubishi in their response. [redacted]I was promised by the sales manager ([redacted]) at the time that if I purchased a 2010 GTS, I would get an amount of three to four thousand off the MSRP as this car was already two years old [redacted] When I came prepared to Saskatoon Mitsubishi to buy a vehicle, I had with me the credit report, a letter of employment, and several paystubs as I was ready to buy the vehicle that day. I filled out the paperwork to buy the car, but didn't get a response back from [redacted] at Saskatoon Mitsubishi until the next year when he asked me to come by and drop off a copy of my pay stubs. A week and a bit later he called me back and asked for the copy of the credit report [redacted]Final Business Response As stated, Mr. [redacted] was informed that he could come by the dealership to receive a second set of keys and a full tank of fuel at his convenience. We had key cut for him on November 22nd, but I am uncertain if he asked to have someone provide him with fuel while he was at the dealership. If this has not been provided, I again invite Mr. [redacted] to come by the dealership at his convenience so he can receive a tank of fuel for his lancer. Engine blew on febuary 28th, warranty denied for suspicion of tune and abuse of racing. Cannot prove as magnusson moss act states they have to.I had bought my 2012 Mitsubishi [redacted] in June of 2012 with ~5000k already on it (it was a demo car)and it had already had an aftermarket exhaust and blow off valve installed. When I bought the car, I was informed the warranty would not be affected having these on the car. The engine blew on febuary 28th 2014 when it was -32 without windchill, while I was passing someone in third gear going ~60km/hr. Car was towed to dealership that night and I dropped off my key and maintenance records the next day. Mitsubishi sent away ecu information to head office for a readout. Readout came back saying maximum ambient air temperature was reading 122*f, which was indicitive of a tune, and that there were 125 total seconds at maximum redline, indicating abuse of racing. I have a picture I took on july 9th of 2012 of the thermometer inside the car reading 50*c, which is a direct conversion to 122*f. I also have a witness from the test drive of the car who saw how our salesman drove the car, which was hard, so there is no telling how it was driven before I bought it. I also noticed the maximum boost pressure was 20 psi. This is only a couple more psi than stock, and being it was -32 at the time of engine failure, overboosting is without a doubt a possibility. I performed all maintenance on time and have record of it. Contact with mitsubishi has been a game of phone tag and the service manager at our local dealership is not responsive to emails. [redacted] Desired SettlementWould like engine replaced under warranty as according to the magnusson moss act, they have to prove that such and such caused a failure, before they can deny it. I have proof of why the ambient air temperature is reading 122*f, and being the car was bought with 5000k I have no idea how it was driven before I bought it. I was also told when I bought the car that the exhaust and blow off valve would not affect warranty. In the manual it says any modification to the exhaust, intake, etc. present while there is a problem with the car will void warranty. [redacted]Business Response In response to [redacted]'s complaint, accessories were installed on the vehicle but had no contributing factor to the engine failure. According to the Mitsubishi Canada Warranty Department the data saved in the vehicles engine ECU determined the vehicle was held past the MAXIMUM RPM (7837) for over 120 seconds, which according to Mitsubishi's Warranty Department is considered as abuse or racing, neither of which are covered by warranty.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)According to the readouts given to me on my car by Saskatoon mitsubishi, the ecu had a total time AT (not over) 7837 rpm (the factory governor put In place to protect the engine) for 120 seconds; not over 120 seconds OR over the maximum red line of 7837 rpm. Given the fact all maintenance was performed on time or early, with manufacturer recommended fluids, and the fact that 120 seconds out of the total ~53000 km accounts for approximately .01% of the total driving, how is that abuse? Given the nature of the car, how it is marketed and sold, how it was driven by my salesman for me and my witness who was also there (launched, hit rev limiter) and the fact it had modifications installed by the dealership themselves prior to my purchasing of it, can only lead me to believe it was abused prior to my receiving of ownership. How is it possible to so quickly rule out that the aftermarket blow off valve and exhaust were not the cause of failure? Can the dealership be positive, and prove, that these parts that they installed themselves (told me would be warrantied) did not cause the failure? [redacted]
