Rain Tunnel Car Spa Response to Damage Claim 11/13/*** *** Rain Tunnel Car Spa Claim(Revdex.com ID-***) On 10/9/Mr*** claimed damage to his vehicle at our Lomas Blvd locationThe vehicle in question is a Pontiac SolsticeMr*** recently purchased the vehicle
from a reseller under an as is day warrantyMr***'s claim of damage was for both undercarriage and top & front end damage involving re-painting of front end, replacement of hood emblem, refastening of the bumper (fiberglass) to the extended body (snap on fasteners)Mr*** obtained two quotes from vendors (*** & *** ***) of his choosing and damages were in excess of $Mr*** did not take the car to be evaluated by our preferred vendor for estimateAccident Occurred Mr*** brought his car in for a package washAn accident occur upon entering the conveyor systemMr***'s car did not make it past the conveyor correlator systemThe car on entry began to rub against the top of the conveyor rail and became lodgedOn recognition of same, our wash attendant and manager where left with no choice other than to proceed to back the car back off the system in identifying that it was too low for our conveyor systemUntold damage may have occurred if we had attempted to allow the car to move down track with this known contact with the underbodyOn backing off the conveyor the bumper undercarriage became lodgedManager and staff, while attempting to remove car by backing out the same way it was driven in, the bumper became separated from extended body by inches on driver sideAny damage underneath could not be fully assessedOur conveyor is covered from its base to the outer edge by High Molecular Weight Plastic (HMW) to prevent rim, bumper and fender damageCar Spa, in its wash history, has washed numerous vehicles of the same type, year make & model without a problem of entry or exit.Following our investigation, we determine that Mr***'s car frame had been lower to a critical point that ultimately interfered with our conveyor trackOur conveyor track height is inches highNinety-nine (99%) percent of individual and commercial vehicles are or more inches from the groundOur wash is process driven, we do not measure each car as it enters the wash nor do we look underneath sameWe have a clear disclaimer for cars that have been modified after the manufacturerCity curbs are inches from the ground and parking lot stops are roughly inches from the groundStreet designed speed bumps are approximately inches from the ground above baseRoad warping and heaves can be as much as to inches in heightWe believe Mr***'s is likely to bottom out in a number of scenarios beyond basic conveyor car washingWith the information that we uncovered through evaluation and manufacturer research, we could not agree to broad and sole responsibility for Mr***'s car getting caught on the conveyorSuch damage is due to vehicle modification after manufacturingIn comparison, the Chevrolet Corvette has been around foryears and produced by the manufacturer, has one of the lowest carriages in the industryWith a conveyor height of inches we wash all Corvettes without an entrance or exit problemOnce a car enters the conveyor, if it cannot travel for any reason, we have no choice but to remove sameIn that he purchased the car used (as-is), who knows what changes have been made to the vehicle over a ten year periodWe do not warrant or cover vehicle damage as a result of modification beyond that of the manufacturerBecause we desired to retain Mr*** as a customer, we offered in earnest, to assist him with repairs in the posture of very limited to no faultHowever, we adamantly refused to make repairs outlined in his quote for what is nonrelated damagesMr*** refused and insisted that we cover all damage on top surface as well as fender, paint, unknown recent or past undercarriage damage and other repairs that were not associated with removal of car from conveyorMr***'s behavior at our wash related to this claim was uncivil and to a level of "disturbing the peace" of our business establishmentHe is not welcomed or allowed on any of our properties without permissionHe has further attempted to black ball us through the Revdex.com with both half and untrue stories of the event to the point of stating that the car was brand new (a years old car is not a brand new car)He is a liar and we are not intimidated by his behavior, stated community influence or threats to harm or take advantage of our businessWe have responded to his insurance company regarding this matter and now consider the same closedBuck B***, PE MBA Managing Partner Rain Tunnel Car Spa
