On Thursday, May 1/2014 went to pick up my income tax. Noticed my [redacted] form was not completed for my car allowance. Questioned the lady who filed my income tax why she did not complete my [redacted] form, she told me that I was already getting car allowance for my mileage and she could not file this because it was illegal. I explained to her and showed her the [redacted] form and said it was right from my employer and if it was illegal then they would have not given it to me. Once again she declined to even look into the issue [redacted] I still had to pay for the service provided and was not satisfied with the customer service. I had to call another income tax service company and explain my situation and they were more then happy to help walk me through the steps. [redacted]. I had to file a ** adjustment form and mail in my [redacted] form myself because Save way tax refused. On June 18, 2014 I received my claim from the government of canada with a credit!! I called Saveway tax to inform the person who orginally filed my income tax that I had to do their job and that I was correct and she was not. I told the company I was not happy with the service and I would be filing a complaint. The lady said she did not say it was illegal and I did not have the proper documents. If that is so then should of asked for the proper document (which I had) and if it was illegal regardless if said or not why was it I was approved??? [redacted]Desired SettlementI would like my $55.00 refunded [redacted] Business Response [redacted]The customer in question was new to Saveway Tax Services Ltd. for the 2013 tax year. She dropped off her paperwork to our office on May 1, 2014 for preparation of her personal income tax return. Along with her T4 from the [redacted], she included a completed Form [redacted] ([redacted]) as well as a hand written note outlying vehicle expenses and percentage of use dedicated to employment duties.Licensed to electronically file tax returns with Canada Revenue Agency, our duty is to prepare and submit complete tax returns while at once adhering to the Income Tax Act and strictly following the rules outlined by Canada Revenue Agency. Given our years of existence and client base, [redacted] forms are certainly not new to us. Based on this fact, it is not out of the ordinary for us to see [redacted] forms that have been filled out in part, ambiguously and/or incorrectly by payroll departments or managers. Also, having a completed [redacted] from an employer does not automatically give right to the taxpayer to claim offsetting employment expenses on the tax return. As the name of the form implies, a [redacted] indicates that the employee has certain conditions tied to his/her position. As per Canada Revenue Agency, motor vehicle expenses can only be deducted if four conditions are met. Specifically, one of these conditions reads: 'You did not receive a non-taxable allowance for motor vehicle expenses. Generally, an allowance is non-taxable when it is based solely on a reasonable per-kilometre rate.' Based on the interpretation of the customer's [redacted] by one of our tax preparers, and as verified by me, one of the owners of Saveway Tax Services Ltd., it appeared that the customer was receiving a non-taxable allowance from [redacted] - hence non-deductible. Also, the percentage of vehicle use outlined by the customer seemed out of line with the allowance documented on the [redacted].When interpretation of this nature leads to a grey area, it is our practice to not include the item(s) in question on the tax return and to proceed with an adjustment after the fact for ruling by Canada Revenue Agency. Essentially and for the benefit of our clientele, we prefer to proceed with this approach. The opposite, making an initial claim on the tax return based on paperwork that we are not one hundred percent confident in, could result in a claw back of a large percentage of benefit in a post assessment review by Canada Revenue Agency.The relationship with the customer quickly deteriorated when she came in to pick up her tax return. She recognized that vehicle expenses were not deducted on the tax return. Following a short discussion with our full-time receptionist, who has tax training and experience, I spoke with the customer recognizing that she was not happy with the result. I explained to her that it appeared to us that the allowance was non-taxable and as such, non-deductible. As mentioned, the relationship rapidly deteriorated as the customer expressed very strong emotion for her position. [redacted] The proposed remedy of following the initial submission with a ** Adjustment for consideration of motor vehicle expenses was presented.[redacted] T[redacted]Given our approach to the customer's tax return, she was not charged for employment expenses. Employment expenses are subject to a slight surcharge because of the time involved to prepare the return. In short, the customer was charged our current fee for basic tax return preparation of a single taxpayer ($50 + tax). At no time prior to receiving this complaint was a refund requested by the customer. However, payment was proportionate with services rendered - preparation and electronic submission of a basic tax return.[redacted] In the end, we are quite happy that Canada Revenue Agency ruled in the customer's favor but stand by our approach.
