Sawyers Cluster Association is a volunteer board comprised of homeowners who agree to take on the fiscal responsibilities of the cluster, including managing landscaping and trash removal contractsThe board collects quarterly dues from homeowners to pay for routine community maintenance and upkeep, as well as capital improvement projectsIn addition, board members sometimes agree to take on special projects, such as updating cluster guidelines.In the past, previous boards have been asked by homeowners to remedy ongoing parking issues within the clusterAll homes were originally given one marked reserved space and the rest were simply open, first come- first served spacesTo ensure all homeowners had equal opportunity to park in the lots, the board instituted a parking tag program and updated parking regulationsThis program was agreed upon by a quorum of homeowners, who also agreed to allow the board to make nominal changes to the parking policies without specific input from the community.The cluster parking regulations are listed in a document on the community website, and were also redelivered to homeowners, along with new parking tags for distribution to residents and/or tenantsIt is a position of the board that homeowners are responsible for ensuring any renters or non-homeowner residents adhere to cluster policy.The regulations state, among other things, that the lots are patrolled by a third party towing company, who has been contracted to enforce the parking rulesThe rules require vehicles to display proper DMV registration and inspection stickers at all timesIt does not make any claim or suggestion to homeowners as to how to ensure the validity of vehicle registration, as this is up to the vehicle owner.The vehicle in question was warned on October 18, due to registration that had expired in August of the same yearThe owner of the vehicle did not renew the registration until October 26, The DMV website states renewing expired registration online does not extend the registration and new stickers could take up to days to arrive via the mailThe vehicle in question was towed on November 1, 2015, five days after online registration was completed but before stickers were received or placed on the vehicle.The cluster does its best to respond to every resident who contacts us by phone or e-mailThe board member manning the phone during this time frame does not recall a message (or several) from this renter regarding this particular vehicle issue, although there were other complaints from residents about illegally parked cars around the same time.We have also experienced some issues with one of our e-mail addresses not forwarding messages to the main accountThis has since been remediedThe first e-mail correspondence of record with this renter was received close to midnight on November 1, and responded to on November 2, 2015.The board has asked for documents proving the renter's statement that vehicle registration could not be obtained in a timely manner at the time of expiration in August due to county tax lien confusion, and also proof of the times the renter attempted to renew registration prior to or after being warned in OctoberTo date, we have received an indication the driver has a valid license and proof the DMV mailed renewal stickers on October 29, No other information has been provided supporting the renter's position.The complaint hints that other cars have been towed illegally, however the board has not been made aware of any other instance of a car towed from the property when displaying the required hang tag or adhering to parking regulationsIt is the position of the board this vehicle was not towed illegally and the board has denied the request for reimbursement
