None of the 3 doors installed and what drywall was installed was not flat, smooth and free of tool marks and ridges. Contract was signed on Oct 2015 and paid a deposit of $4500. Was told that work was to take 2-3 weeks. The first day of work was Dec 2nd. Work was never completed. Last communication was Mar 5th. Section 2 of the contract states that you will install "Two (2) Custom Pocket /Hidden Doors Including Wainscoting and One (1) InvisiDoor Hidden Book Case Door." As of March 12, 2016, the doors have not been installed. Also, per contract you state "Direct Labor: Includes installation, planning, equipment and material acquisition, area preparation and protection, setup and cleanup. Fit and secure drywall, tape and mud joints with 2 coats of joint compound, cover fasteners with 3 coats of joint compound. All dried joint compound shall be flat, smooth and free of tool marks and ridges. Installation of Doors is included." Installation was never complete. Area preparation and protection was not performed and grout was ruined and has to be redone. Joint compound was not flat, smooth or free of tool edges as can be seen from the numerous pictures attached. All seams in the ceiling can be seen and multiple areas around light fixtures, switches, fans, smoke alarms, vents, and corners are not smooth or free from tool marks as show in attached pictures. All cleanup was performed by the homeowner to keep a safe environment.Desired SettlementIn light of the preceding, I will not be making further payments nor do I wish to continue utilizing your services.Business Response Contact Name and Title: [redacted] PresidentContact Phone: XXX-XXX-XXXXContact Email: [redacted]@superiorhm.comSBT Construction, Inc dba Superior Home Management(SHM) acknowledges some of the concerns as outlined by this customer and has provided appropriate credits for work that has not met her standards. SHM absolutely denies ever indicating that the final invoice was going to result in a collection issue as stated by the consumer. As a matter of fact, as a standard operating procedure with any project, SHM sends out finial billing at the close of any project. It was the customer who sent SHM an email from a lawyer and made threats to have a lawyer involved directly after receiving our invoice. (documentation can be provided) The customer also threatened to get the Revdex.com involved. Although SHM has not attempted to pursue collection at this time, SHM believes this customer is using this forum to negotiate a means to keep from paying their final invoice. SHM has always worked with our customers when and if an issue were to arise. SHM has spent more man hours than the construction industry deems acceptable to rectify this issue. The facts are, nothing we did was acceptable from day one. SHM has tried for months, at a loss, to rectify any and all issues as described by the customer. SHM finally suggested that the parties part ways after the customer made inappropriate comments. (Documentation can be submitted) At that point SHM realized that the situation was escalating and it would be better for both parties to part ways. In regards to the consumers complaint:The consumer requested that all men be taken off the site and her father would finish aspects that were not to her specifications. SHM insisted we would stay however, that was not an option per the customer. The consumer has provided out dated pictures that do not currently show our attempts and the completion of said work. The consumer has missed stated the door installation. There were only two openings, SHM again, to make the customer happy was doing work outside of our scope by providing a bathroom door and modifying framing. In regards to the doors not supplied, Superior was told to wait until the floors were laid prior to installing the doors. This was a customer delay. SHM has issued a credit for those openings. In regards to the drywall, SHM tried to complete this work, however we were told the father was going to fix the issues. SHM has provided a credit for these corrections as preformed by her father. Many attempts were made to resolve these issues. In regards to the time frame, SHM had to modify several areas of the framing to accept the drywall which was not included in our scope. The time frame was increased do to the multitude of issues raised on a daily basis by the customer. Every attempt was made to keep the customer informed of our time line. The consumer indicated on many occasions that time was not of the essence. In regards to the protection of the flooring. The areas where the flooring was laid by the home owner was directly underneath a drywall sanding project. The home owner was aware of the debris that this project would entail and involved. We protected the area where SHM was sanding as directed and specified by the consumers husband. The installation and coordination of the flooring was not brought to our attention. The consumers comment regarding that "all" cleanup was preformed by the home owner, is simply not true. SHM on multiple occasions advised the home owner that the debris would be and was cleaned per standard construction practices. SHM even removed items that were the homeowners personal trash.SBT Construction, Inc. dba Superior Home Management has completed hundreds of projects. SHM has never had a compliant with the Revdex.com, we are a top rated company with [redacted] top rated company with [redacted] and with [redacted] SHM is an active member with [redacted] and with the [redacted] of [redacted] SHM and its employees take these projects seriously and with the upmost respect. Every attempt was made to alleviate any and all issues with this customer to no avail. This is obvious in the amount of time we spent trying to make the consumer happy. SHM feels that the consumer, by pursing this means, is a blatant attempt at torturous conduct and defamation in regards to SBT Construction, Inc and Superior Home Management. Therefore, SHM will keep our options open to pursuing collection and mechanics liens on the consumers property until this issue is resolved.
