I have spoken to MrM*** and explained that the items were not unsolicited as we have a valid prescription and signed patient authorization (his signature) on fileI forwarded the documents to him for his review, and he states that the signature on the authorization is not hisWe of
course would not have known this, and would have accepted the signature as part of the referral from the treating doctor on good faithWe no longer have a business relationship with the referring doctor, and it is up to MrM*** if he would like to pursue any action against the doctorIn the interest of good will, since we understand that MrM*** states he did not sign the authorization, but rather someone else signed his name, and because we fulfilled the prescription as allowed by law, we would agree to meet in the middle and settle the account for $(and remove it from credit reporting), and would assist MrM*** with any further actions he might desire to pursueWe apologize for the inconvenience that this has caused MrM***, but adhere to the claim that we were fulfilling a prescription as received

To Whom It May Concern,
Our sales rep, J*** ***, called DrK***'s office in June of 2011.Josh called him to tell him about the Titan Medical TENS unit programDrK*** expressed an interest and wanted more information, so Josh faxed him the information on the TENS units and the program
They spoke back and forth until January of when DrK*** told Josh he would like to try the Titan programThe Titan program is where we place TENS units on consignment in doctors offices and Titan does all the pre-verifying and billing for the doctor
We shipped DrK*** TENS units on January 9, On January 30, Erin called from DrK***'s office letting me know that the units arrived and DrK*** was out of town but would be calling in a week to go over the protocolIn February I called but the doctor was busy so I faxed him over the protocol instructions for TENS unitsIn March DrK*** called and we went over the Titan protocolHe told us at the time that is office had been slow, but he would give it a try when he had a patient who would benefit from a TENS unit
Throughout the rest of the year we called and left messages, checking in and we also faxed him updated forms, sales promos, insurance updates etc
We stayed in touch with him through the years via phone and faxSince DrK*** has not prescribed any of the Titan TENS units, our bookkeeping department, periodically gets alerted to inactive accountsThey generate an invoice and attach it to a letter which we mail out to all inactive accountsThe letter explains to the doctor the reason they are getting the letter and asking the doctor to contact the rep for his optionsThe options are:
They can keep the units and begin to pre-verify and prescribe the units
They can return the units to Titan Medical and we will close their account
They can purchase the units and they will be theirs to do with as they pleaseWe include the invoice for the units that are on consignment
(I have attached the letter that is sent)
This is not a scam, we are a legitimate company who have been in business for over yearsWe work with thousands of doctors nation wideWe give doctors ample time to try out the TENS unit program, understanding that many doctors offices are slower and not all offices have patients who need a TENS unit, which is why it looks like the invoice is over years oldWe sent the same letter and invoice a year ago to DrK***, but as of todays date, he has never used the programBecause the units are on consignment, they were instructed to not give them out to patientsThe Titan units need to be billed through insuranceBecause it has been over years since original delivery, we sent the invoice again and informed him that it would be the final invoice and that he needed respond since it looked like he would not be using the program
DrK*** just needs to return the Titan TENS units he has on consignment in his office and we will close his accountIf he gave the units out to patients, then he owes Titan Medical the cost of the units which is on the invoiceOnce we get the payment for the units, we will close his account
