Dear Ms. [redacted]:I have been retained to represent Fred S[redacted] d/b/a Schultz & Sons Concrete relative to the complaint lodged against him by [redacted]. The job involved pouring a concrete driveway, constructing concrete steps leading to a patio and constructing a concrete patio. The total charge for the job was $7,500.00. It is my understanding that there has been no complaint regarding the concrete steps or concrete patio for which Ms. [redacted] was charged $1,500.00.After reviewing a video of the entire driveway, it appears that approximately 50% of the driveway is not defective in any way. The concrete from the approximately 50% of the driveway closest to Ms. [redacted]’s house appears to be slightly discolored and has one noticeable crack and some spalling. The discoloration may be due to the concrete that my client received from his supplier.We live in a climate with extreme weather changes. In my client’s contract with Ms. [redacted], there is a disclaimer indicating that due to weather conditions and other conditions beyond the control of my client, Schultz & Sons Concrete contractors cannot guarantee any concrete work will not crack, scale, chip, flake, spall, settle or discolor. Despite this clear language in the contract, which Ms. [redacted] signed, my client is definitely willing to work with the Revdex.com and Ms. [redacted] to address Ms. [redacted]’s concerns regarding any discoloration, cracks or spalling from the 50% of the driveway that is closest to her house. My client adamantly believes that the other 50% of the driveway shows no unusual signs of any defects and that the concrete steps and concrete patio were constructed properly.I am enclosing for your review the Schultz & Sons contracts relative to the job in question.
