Had hardscaping and landscaping work done last year. He planted the shrubs and plants mid fall, some of the plants didn't look like they would survive. Notified Mr Schuster of the conditions of the plants and was told they would be okay for the spring. Well, it is spring and I had 15 dead plants/shrubs. Tried calling Mr. Schuster multiple times with no return call until my fiancé called with his phone requesting work. Was told that his phone got wet and that is why he didn't return my multiple calls over 3 weeks. I was told on the phone that he would reimburse me for the plants that died since I had already purchased new plants and because his plant supplier went out of business and are not honoring any warranties. He said just email him the receipt (which I did). Then I get an email from him asking for "Do you have anything from me the states a guarantee on your plant material", which I do not, but I did tell him that I don't know of any landscaper who doesn't guarantee the plants for a year. And, now he will not reimburse me for the plants I had to replace because they died. Besides purchasing the plants, I also had to plant them.

To Whom It May Concern:
The homeowner reached out to my company with concerns of 10 and not 15 dead plants as was indicated to you. At the time the homeowner had reached me they had already purchased and picked up plants to replace what they believed to be dead. The homeowner informed me that she was planning to plant them herself because she had not heard from me. I was unable to utilize my phone during this time as it had been damaged in the rain.
I also explained to the homeowner when we spoke, that the nursery, ***, where I had purchased the plants has closed their business due to the owner ***. Therefore, a warranty through them was not possible. The homeowner seemed to pass off my explanations as lies and insisted I pay for the dead plants that I had not seen and had already been removed. I requested that she send me copy of the receipt to see what, if anything I could possibly do for her.
Upon returning to the office I reviewed the receipt from her email, the original quote, as well as the invoice and notes taken from the jobsite. I noticed the quoted and invoiced price that was given to the homeowner did not reflect a price that carried a guarantee.
The homeowner requested, and my company accommodated, multiple change orders deviating from my original design with no increase to the price. I asked the homeowner if they had a copy of a guarantee to see if I had written one and forgot. As I suspected, I did not offer a guarantee. Instead, I had passed along a wholesale price in an effort to keep costs low. What feels like retaliation, the homeowner lashed back with threats of extortion and insults (please see attached emails).
After 17 years of business and running a successful landscaping company, I have never lost more than 1 or 2 plants on a single job. In my professional opinion it seems to be either an act of God or negligence and lack of proper care on the homeowners part.
