Scott Gardner, Attorney

I was unfortunate to be assigned Mr Gardner as a court appointed attorney In a criminal matter ,, I found it nearly impossible to contact him and when I did get a chace to speak with him he never listened or answered questions . He literally provided no defense for me . He repeatively told me to shut up in court everytime I attempted to tell him about the untruthful statement being made by the officer , he failed to question the chain of custody of the substance found in someone elses vechicle I was driving he wouldnt call the only witness I had.

he failed to make a motion of discovery he failed to get my coerced statements thrown out of court, he basically threated me like I was the lowest trash on the face of this earth, he refused to file an appeal stating you have to be in jail before you can appeal a quilty verdict. If you get him as a court appointed attorney just go ahead and plead quilty because you dont have a chance ,

Review: Mr. Gardner was hired for a will dispute case early in December of 2012. It appears a check was issued him for 2200 dollars on 12/14. He took the case and I never heard anything from him. Sometime early in the year I asked him if he would change to contingency in April of 2013 and he said his contingency rate was 30%. I said I would raise that to 50%. He agreed to that and again I heard nothing. Finally I called and asked any unused amount of the 2200 be refunded before the contingency agreement which was verbal. He agreed. I heard nothing. Finally months later I was asked to go to his office to sign a counter offer he prepared. Fine. I signed and went back to work. I hear nothing from him and two phone calls and two emails later and I can not find out where the case stands, or any advice or input from him at all. I find he has closed his Salem office a few months ago. He still has a website, but does not answer the phone number given and does not answer the email given. Why would a lawyer with an active case close his office and not inform his clients?Desired Settlement: Mr. Gardner could provide the service he advertises on his website. He should return phone calls concerning his law practice and service the clients he has. I do not understand this at all. I have never spoken harshly any word to this person.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. Please note that Mr. Gardner did contact me and finished negotiations with the other party January 2015.
