Complaint: ***
I am rejecting this response because:
Thank you for your emailed response There appears to be some miscommunication on the events that transpired.
I did not receive any email messages. I did receive the referenced phone call in January 2015, and explained to the caller that:
1)I was unclear of the services being invoiced, and therefore,
2)asked that the invoice be sent to my mother's address - both for clarification as well as to expedite a response since I was soon to be off-islandI received a follphone call from the company letting me know that they had contacted my mother and that she was upset that she was being billed for services she had not contracted I instructed the caller to send me the invoice so that I could review
Upon receipt of the invoice I followed up with a phone call to the business owner for further clarification The business owner told me that I was being billed for a meeting I had with him in My understanding was that the meeting was an initial consultation to understand the services that could be provided by this business
The issue is simple: I do not believe that I received any services from this company I have no documentation There was no contact (if email was an issue, then perhaps a phone call would have been a better way to contact me.) The company was not even aware of my father's illness, hospitalization, and passing in How could services have been provided without knowing this?
When my father was hospitalized, if I was aware that these services were contracted/available to us, I would have contacted the business to request assistance As it was, there was no contact from the company - for yearsThis is not a reasonable request for payment of services I am pursuing this issue because I sincerely believe that other caregivers may be subjected to this - and it is wrongI almost fell prey to this Upon receiving the first phone call in January 2015, I had offered to pay the bill in full over the phone with my credit cardFortunately I was told that the company did not accept credit cards Thank goodness - I've learned my lessonPlease do not hesitate to contact me if there are any questions
Sincerely,*** ***

Dear Revdex.com,

Thank you for allowing me the opportunity to respond to complaint ID# [redacted].  This complaint is bewildering.  My hope is to prove the services my company provides, is not a “scam” as the Complainant claims it to be.  We have helped many families as well as prominent individuals in our community.

In 2011, my office received a call from the now Complainant, requesting for a Medicaid Consultation in regards to her aging parents.  A quote of $500.00 plus tax was issued and the appointment date was scheduled over the phone.

On May 27, 2011, at 8:00AM the Complainant attended the Medicaid Consultation appointment at my office.  In attendance was the Complainant, an associate of mine and myself.  We exchanged business cards and proceeded.  Per our case file notes, this meeting was a "consultation only" and the following information was discussed in detail with our client:  Medicare vs. Medicaid, different levels of care, income and assets limits, asset spend down rules, Medicaid Lien on primary residence, five year look back, gifting penalties, and options.  She was given our company's brochure which has the explanation of Levels of Care along with a list of documents that would be necessary for the Medicaid application process should the situation arises.  She stated that she would email the documents to us.  The meeting ended with no dispute about the service fee.  The Complainant asked that we email her the invoice, as email works best for her.

After several email attempts and not being successful in receiving any response, a phone call attempt was made on January 22, 2015.  With success this time, the Complainant had stated that this should have been taken care of.  The Complainant then instructed that we mail the invoice to her mother's home address.  Now, if the Complainant had addressed her concern about the invoice at that time, I know it would have been settled amicably.  However, that was not the case.  As a result, the invoice was mailed to the Complainant’s mother’s home address.

On January 29, 2015, the Complainant’s mother contacted our office and spoke with my manager.  She conveyed that she knew nothing of this meeting and did not feel obligated to pay the invoice.  My manager apologized for the misunderstanding and explained that our office was following the instructions of her daughter.  She understood and gave us the Complainant's address, so we could mail the invoice to the correct address.
It is clear that the Complainant is a professional with a busy schedule, therefore may have a vague or little memory of our meeting.  She claims there were no services provided when she was going through the Medicaid process when her father was ill.  To counter her claim, back in May 27, 2011, Scott Gardner & Co. was hired to provide information and understanding of Long Term Care Medicaid only.     The Complainant never requested for additional assistance, nor did she provide documents to us for the Medicaid application process.  As mentioned, she did not respond to our email attempts, so we had no knowledge of her father's situation at that time.

Going forward, despite the circumstances, Scott Gardner & Co., LLC has decided to bless the Complainant and forgive the entire $523.56 bill.  However, I will keep my case file, should it be necessary for your investigation.

Should the Revdex.com find Scott Gardner & Co., LLC blameless, I kindly ask that the inappropriate "scam" comment be expunged.  We have helped thousands of families, which they find value in our service.  Interesting fact, we still receive referrals and inquiries from the support group that the Complainant is associated with.

I sincerely hope this statement will bring clarity.  Thank you again for allowing me to share my side.  Should you need more clarification, please do not hesitate to call me directly at [redacted]

Sincerely,
[redacted]
