I am rejecting this response because: Dr [redacted] has been approved as a "service contractor" by the state for evaluationsHe is appointed by the court if both parties and the judge agree He was my lawyer, Dr [redacted] s’s third choice at the time, but if memory serves correct, was the only one available at the time Dr [redacted] has confirmed in writing that the only contract that exists is what his office provided and I signed Dr [redacted] implies or seems to think that since he is court appointed he has some sort of court protection and assumes he has no obligations to full fill his own contract with the persons paying the bill Dr [redacted] has failed to provide test data, witness transcripts, child drawings, his notes and methodology despite several requests Both parties counsel dates Mr [redacted] has made reference an old email of mine concerning my sons pets True to form Mr [redacted] has omitted much of the information so has to make a impression or innuendo I would be happy to provide the entire email to the Revdex.com so they know the whole story But suffice it to say Mr [redacted] does not seem to comprehend the ramification of his own reports Dr [redacted] report has been life altering for both of us My son and I are living miles away from our previous home My son’s horse was sold, his pet chickens could not cross state lines have agreed and requested that he turn over my test data and he has not obliged Dr [redacted] has not delivered the complete product in its entirety which I consider to be a breach of his own contract I paid for the service and ALL the information that has been assembled to write the report Per his contract Dr [redacted] owns the original information but I am entitled to a copy of the complete file This is basic contract law that Dr [redacted] needs to familiarize himself with I have supplied a copy of Scripps Psychological contract that I signed to the State Board of Psychology Dr [redacted] quoted me verbally $for both parties and I was required to pay half the amount up front as a down payment before the study began I am compelled to state that this is also illegal in the state of California as a service contractor can only charge 10% upfront as down payment on a service contract per California Contract Law, and it also goes against accounting laws You can't account for something you have not done Dr [redacted] seems to be out of touch with current state laws, rules and regulations For Dr [redacted] to state that $was not the quoted amount is nothing short of fraud I am happy to provide a copy of my initial check for half the amount as “proof” of what Dr [redacted] quoted There are now four different versions of Nancy Bloom and [redacted] s relationship per my x wife written statements and Dr [redacted] written statements 1) They worked at the same business for years2) They worked in the same building in the 80's and were friends 3) They worked in the same building but never met 4) They don't know each other at all I have no idea which version is true or untrue All I can say is that the day I heard version one my x wife was gloating and she packed up her furniture and my son’s belongings and loaded them into a large shipping container and had them shipped to Florida It was very large container according to my son [redacted] is not old enough to lie about such details Somebody obviously tipped her as to the outcome of the report This flies against regulation The Revdex.com can contact the container company and subpoena a copy of the container rental to confirm the effectively railroaded to Florida without the judge ever hearing a discussion or argument Mr [redacted] 's comment about my sons pets in themselves show a complete lack of compassion for a year old child Truthfully I am more than a bit shocked that he would make lite of such thing I realize he grew up in the concrete world of San Francisco and has disdain for anyone who owns a horse or likes cowboys, but his comment is far beyond odd and awkward, to borrow his own phrase and/or projection Perhaps if Dr [redacted] knew the importance of his work and took it more seriously, he would not make over errors and omissions in a page report Dr [redacted] recommended to the court that [redacted] spend less time with his father than a convicted criminal is granted with his family while in prison I have no criminal record, don’t smoke or drink and have no vices I have an engineering degree and was in senior management for General Electric and W [redacted] I built my own successful electrical testing and engineering company and employ a dozen engineers I passed a battery of psychological tests at ** and W [redacted] Dr [redacted] , Dr [redacted] and [redacted] ***, MFT all have given their written support on my behalf Every witness and person in my corner believes that there is foul play involved or incompetence on Dr [redacted] part We all make mistakes but nobody in my field makes over seventy (70) in a page report To summarize Mr [redacted] is in breach of contract His comments and my response will be sent to the State Board of Psychology who is considering assigning an investigator from Southern California to review the case Based on comments made by Dr [redacted] and retired Superior Court Judge [redacted] and my own attorney Dr [redacted] , I do not think I am the only father to be subjected to a lack of "bias control" Based on Mr [redacted] ’s reputation in the industry, there is mother favoritism or perhaps a core father issue in play I am not a psychologist that is what review boards are for I am considering filing a complaint with the Sacramento Grand Jury

Mr*** contends that he has a contract dispute with me although this is not trueThe Placer County Superior Court ordered a child custody evaluation involving Mr*** and his ex-wife and son and appointed me to conduct the evaluationThus, my "client" in this case was the courtI did have
Mr*** read and sign a "Child Custody Evaluation Agreement" which outlined the procedures and costs involvedMr*** does not like the custody recommendation made to the court (primary custody to the mother) and this is the reason I believe he has filed this complaint with the Revdex.comThe fees for the evaluation were consistent with the fee schedule he signed prior to the beginning of the evaluationThe cost did not double "at the last moment" as he claims, since I bill at a standard hourly rate which always remains the sameMr*** was well aware of the hourly rate as he signed my fee scheduleMr.*** readily paid his portion of the bill and is only complaining now due to him not liking the outcomeSome of my specific comments to his complaint are as follows: The evaluation did not take a year to completeThe evaluation began on 1/13/and was completed on 7/24/I was not paid in cashFull payment in the form of a cashier's check is due prior to the report being sent to the court which is the norm with child custody evaluationsMr*** also signed an agreement acknowledging this was the procedureI have never had any type of relationship with *** ***Mr*** signed a written authorization allowing me to interview her as part of the evaluationI have never recorded any telephone interviews with collateral witnessesTo do so without their knowledge would be illegalIn summary, there is no contract disputeMr*** is a disgruntled litigant in a child custody matter and this is the reason for his complaint to the Revdex.comMr*** signed a fee agreement in my office prior to the evaluation commencing and there will be no refund unless instructed to do so by the Superior Court Judge who ordered the evaluation

Review: Dr. [redacted] failed to control bias while performing a 730 child custody evaluation. The evaluation took almost a year to complete and he doubled his price at the last moment. He refused to deliver the report until he was paid in cash. According to our review his report has over 70 errors and omissions including mistatements or omission regarding a 6 years old hand sketches. Dr. [redacted] failed to disclose a five (5) year relationship he had previously with Ms [redacted] who was our marriage counselor prior to the evaluation. Full disclosure is required as part of a 730 evaluation. Dr. [redacted] recorded telephone conversations which is against California law when done without consent.Dr. [redacted] agreed to provide test results and transcripts of his recording(s), then reneged on his commitment. He has also failed to turn over copies of the child's drawings.Desired Settlement: Per my letter to Dr. [redacted], I am requesting the following:1) A full refund of $7500.2) A written apology addressing the 70 errors and omissions listed in his report.3) A copy of my test results.4) A copy of transcripts for all of my witnesses with his hand written notes.5) All of my sons hand sketches.
