The following is in response to the statements made in the complaint in the order as they appear. In the complaint Ms*** indicated that “The class didn't allow me to look at any course materials until April 10”In response the College submits that it provides to all enrolled students adequate information for consideration concerning course and time expectations throughout the enrollment processOur records indicate that Ms*** signed the enrollment agreement (Exhibit 1) on March 23, and the payment agreement (Exhibit 2) on March 24, was enrolled in the program on April 3, and also received on the same date an admission email (Exhibit 3) and an enrollment email (Exhibit 4) containing the course start date, student ID number, student portal ldirections and payment instructions. Additionally this email noted as Exhibit contained instructions and linformation for course access and for new student orientationIncidentally, new student orientation includes instructions on viewing the academic calendar which specifically lists dates for receipt of cancel enrollment /withdrawal request by the Friday of the first week of the course. Subsequently, the College sent a webinar invitation (Exhibit 5) on April 4, 2017, titled “Next Steps Information Session - Prepare to Start Your Program”, to be held on April 6, This is a one-hour online session designed to help students acclimate to CANVAS, our learning management system (LMS) with a live walk-through and to provide useful tips for their programThe webinar is designed to answer student questions to help them successfully navigate through their first weekSpecifically the webinar provides instructions on how to connect with your assigned Student Services Advisor, pay tuition, view your course schedule, update your contact information, access free unofficial transcripts, and access the 1098T tuition tax documentAttendance is not mandatory, but it is strongly encouraged to ensure they are comfortable with the system. Lastly, on April 10, after the first day of the course on Ms*** received an email (Exhibit 6) containing time-management tips related to course expectations and the contact information for student services for any questions. In the complaint Ms*** indicated that “I did my best to complete the many hours of the course work the first weekThat weekend I tried calling their student services and they told me that if I withdrew from the course I would lose the entire $I paid themI think this is a very cut throat policy as they are giving students only five days in order to withdraw from their coursesI think this is very unfairI withdrew from the course days after their deadline. For this reason I was denied any refund, not even a portion!!!!” In response the College submits that our records indicate Ms*** submitted a cancel enrollment /withdrawal request form on April 18, and subsequently on the same date received email confirmation of the cancel enrollment/withdrawal request receipt by student services (exhibit 7)In the compliant the student acknowledges submission of the request beyond the published date of proper receipt of cancel enrollment/withdrawal request for a full tuition refund as listed on page and of the catalog (Exhibit 8) and as shown on the cancel enrollment/Withdrawal request submission page (Exhibit 9). Additionally, and consistent with College policy, since the request was received after the Friday of the first week of the course for a full tuition refund, the general refund policy as shown on page of the catalog (Exhibit 8) would apply in that “he/she will remain enrolled in the course through the end of the term, and that “Students are financially and academically responsible for their enrollment in courses if they are active beyond the first week”. Therefore the statement that Ms*** was denied a refund or partial refund is incorrect as the refund policy was applied fairly and equally and within College policies and procedures. Ms*** also indicates that “Their website is confusing in this regardIn one place they have the information stated that you must withdraw within days but in another place they offer information about dropping the course and that states that you can do this weeks into the courseI was thinking I had more time with in which to drop or leave this class that is why I didn't make a rushed decision!!” In response the College submits that the Tuition Refund Policy as published on the College website (Exhibit 10) is clear in its presentation of the general refund policy, any state specific required refund policies and specifically the withdrawal from a single course instructions, with timeline for submission of a cancel enrollment/withdrawal request form for a full tuition refund and a link to access the form. Additionally, the cancel enrollment/withdrawal form can be accessed on the College Student Request Form Page (Exhibit 11) where it is posted with the following note “For new student enrollment to be cancelled, form must be received by Midnight PST on Friday at end of the first week of the first term” The Tuition Refund Policy is also posted and electronically acknowledged when payment is submitted through the student portal as described in the referenced new student orientation message received prior to course start. In conclusion the College thoroughly investigates all concerns or complaints received from its students and makes changes and corrections if such concerns do indicate that operational procedure is erroneously inconsistent with College policiesHowever, after investigation of the concerns noted in the received complaint, the College has determined that there were no misrepresentations or inconsistencies with application of College policies, or extra-ordinary student circumstances to consider that would substantiate honoring the request of a full or partial refund of the tuition submitted for payment. In the received correspondence dated June 1, Mr*** *** stated …”My withdrawal from ACE was processed on the 28th of AprilI called ACE a few weeks ago, spoke with an ACE representative, and was informed that I would be refunded by the fourth week of MayI have yet to receive my refund regardless of e-mails and phone calls made to ACE”. Upon receipt of the complaint, the subsequent investigation determined that Mr*** had submitted a cancel/withdrawal request form on April 27th, The request was processed by the College on April 28th, and Mr*** was unregistered from class and the enrollment record was moved to Cancelled on that dateThis would have placed a credit on the account for a refund to be issued within fifteen business days pursuant to the College’s Tuition Refund Policy as published in the catalog. However, the subsequent investigation determined that due to an error in the system the refund of $due to Mr*** was erroneously delayed, and was not issued until June 2, Additionally this error could have contributed to an ACE representative providing information that reflected the incorrect status of the account as indicated in the received complaint. The College acknowledges that this refund was not issued in compliance with the published Tuition Refund Policy and appreciate that Mr*** has brought this to our attentionThe College has taken immediate steps to identify and correct the errors that contributed to this individual delay and to ensure that all refunds are processed in compliance with the published Tuition Refund Policy. In conclusion, and as stated above, the College takes all concerns or complaints received from its students very seriously and will investigate promptlyThe refund of due to Mr*** of $dollars has been processed and sent to Mr***, and the College has corrected the errors in the withdrawal and refund processes that contributed to this individual’s refund delay.
