Per our telephone conversation this morning as I mentioned... I would send a response to the complaint issued to my company. First of all, I would like to state that I am the owner of my company and my leasing agent is [redacted] who is licensed. [redacted], leases all of our 60 properties in the San...

Diego State University Area. [redacted], has never had a problems with any College students or tenants renting properties from any of our 60 properties we manage to college Students. This is the first time we have ever had to evict a tenant from our properties we manage.On or about May 13, 2016, [redacted], leasing agent met with [redacted], was looking for a place and was desperate need and reached out to [redacted], stated that he rented a property on Mohawk street and he met a lady she collected $4500.00 for deposit and she never contacted him and he lost his money. [redacted], felt really bad for [redacted] because he told [redacted] he was a cancer survivor and he was a victim of fraud and never received his money. [redacted], also told [redacted] he was living in a hotel until he could find a place. [redacted], being the nice person he is he felt sorry for [redacted] and really wanted to help him out. [redacted], showed him [redacted] Ca921.15 and informed him the rent was 3200.00 and the deposit would be the 3200.00 and informed him our company policies. We normally collect $1000.00 for initial deposit as an agreement to not show the property and reserve it until the entire deposit is collected. [redacted] also was nice enough to allow [redacted] to give him only $900.00 on 5/11 and the balance would be when he moved in. [redacted], was in an accident and he could not meet [redacted] for the move in inspection so I met [redacted] being this was all last minute while [redacted] was in the hospital the property was not cleaned and prepared as soon as arrived on May 14, 2016 immediately contacted my employees to clean the house and install smoke detectors my staff was at the property within 20 mins while I was with [redacted] doing move in inspection. [redacted], was so happy and complimented me on how quickly got things done and was very please....at this point [redacted] handed me $100.00 he owed for initial deposit and a cashier's check...after this [redacted], had many discussions with [redacted] and knowing only [redacted] and Robert would be renting the property [redacted] suggested that since he is showing properties and has a huge database of tenants that are looking to rent a room he would reach out to him once he would find someone. On or about June 3, 2016, [redacted], found a girl name [redacted] and contacted [redacted] and informed him she could take the smallest room and pay 600.00 a month but since she was obligated to her current lease she could not move out until July 1, 2016. At this point they all made Contact and set up appointment with [redacted], her boyfriend, mother they all met at the property and [redacted] was okay with everything and agreed to her moving in witness by [redacted] Mother and boyfriend. [redacted], informed [redacted] that [redacted] would not move into the property until July 1, 2016 but would move some of her personal things into the room she would be renting. [redacted], had agreed and said that it was okay only thing was that [redacted] was to reach out to him before coming to the house so she did. [redacted], never stayed at the property. [redacted], had reached out to [redacted] and asked if [redacted] was going to give him her 600.00 security deposit he was expecting it. [redacted], wanted all control of all rents coming into the property. [redacted], explained to [redacted] that our company policy does not allow this all security deposit and rents must go thru our company. After this conversation this is when [redacted] turned to another person and we met the real [redacted], started sending me texts and was very upset and stating that [redacted] took money he shouldn't of and [redacted] added [redacted] to lease without their authorization. He said he wanted control of all rent and security deposit. called him and he said that [redacted] said he could do this and he never gave [redacted] authorization to let [redacted] move in to the property on July 1, 2016 or to add her to lease... I asked [redacted] to come into our office and have a meeting about the tenant and no pet policy. [redacted] and Robert came into our office and we all agreed that [redacted] would move in on July 1, 2016 and the pet they had Pitt bull was a service animal so asked for certification of the pet and doctors notice that they needed service dog. After the meeting a couple of days later spoke with [redacted] he was upset because I told him that [redacted] had to pay the rent to us for July and we had to retain her security deposit in our trust account. [redacted], did not like my answer and said he did not want [redacted] to move in. He also started giving [redacted] negative input which made her feel uncomfortable so spoke with her and explained that received an email the morning of her move in that he was going to sue me my company for illegally moving in [redacted] into the property. I reached out to [redacted] father because could not contact [redacted] to inform her that [redacted] was suing me and felt that it was not a good plan to move her in. When heard [redacted] yelling and Swearing at me he did not sound stable. [redacted] and her boyfriend were already picking up moving van to move her furniture finally contacted [redacted] and informed her that it would be best that she remove herself from the lease and property and would return her rent check that had not cashed and refund her security deposit. I had [redacted] sign a document stating that she wanted to cancel her lease and did not want to move into the property and was going to pick up all her personal things. I had my manager and two employees go with me and we stayed outside while [redacted] and her boyfriend went into the property to start removing her personal things this was on July 1, 2016. She never moved into the property only stored a few things their. We waited and she finally came outside and starting moving her things out. [redacted] and her boyfriend said that [redacted] asked them to stay and they could make a lot of money if they stayed in the house with them and didn't pay rent. They did not feel comfortable so they passed on it... I have attached the documents that [redacted] signed proving that she cancelled her lease and received her rent check and security deposit from our Company.I reached out to [redacted] many times to collect rent and he never paid. [redacted], has not paid the rent since July 1, 2016 and we have hired an attorney and will proceed with eviction. [redacted], has threatened me and [redacted] and has sent many texts. [redacted], has sent me emails saying his will move out if give him back his security deposit and half a month of rent and give him a good reference. spoke with owner we agreed to give him deposit but wanted the property empty and wanted to meet him and obtain keys. [redacted], changed his mind and said [redacted] was harassing him and stalking him. [redacted], drove by the property and took a couple of photos of all the vehicles outside of the property along with photos of a huge pit-bull. No pets were stated on the lease. I received an email and text from [redacted] threatening me that he was calling the police and calling an attorney and was suing me for harassment and stalking... [redacted], only went one time to the property, asked [redacted] never to return because [redacted] was not stable and witness this behavior so did my workers and they were right next to me did not want me alone with [redacted] because he was unstable and capable of doing things with the temper and yelling and pacing back and forth. He really scared me that contacted the police myself. At this point the owner is now in touch with [redacted] and was told that [redacted] gave me the rent in the July in cash and that I have the money. Owner asked [redacted] for proof of rent given to my company but never responded.I have attached copy of the 3 day notice to pay rent or quit, Deposit holding agreement signed by [redacted], letter signed by [redacted] canceling her lease and proof of security deposit refund and voided rent check she gave me. [redacted], never moving into property. Letter from a current tenant that [redacted] sublet to and who also moved out because he felt threatened by [redacted] and is still waiting for his deposit refund.[redacted], currently is renting the rooms out to different tenants and he getting well over 4400.00 for rent and not paying the rent… At this point we are moving forward with the Eviction and will go thru the process and deal with all of this in court. We have done nothing only try to help someone that said he was in need but pretty much was taken advantage of...
