I am rejecting this response because: The reason why we went to the Revdex.com to help mediate our complaints instead of contacting the business directly is because our experiences rose to a much higher extent than just trying to settle a minor issue. We felt using a sober platform to communicate would be in our best interest if we have any hope to be made whole. Let me expand a bit on the issues with the road. On the day I paid [redacted], it turned out that he left our road in such an unacceptable condition that we sought opinions from two other road contractors about it. We had agreed, by contract, that: “not to exceed” 7 tons of “Type-D hot mix” would be used to fill in “cut outs” of areas where the pavement had fallen away due to age, then the areas would be “vibra-packed or rolled with a riding roller”. The two road contractors concluded independently of each other that only a half ton of hot mix was used on the entire job, leaving many of the holes unfilled. No cutouts were made and the material was so loosely applied into the potholes that did get filled that the material can be brushed out with one's foot. No rolling or vibra-pack took place. “High Quality rubberized crack filler” was to be spread a quarter inch thick, into the extensive number of cracks that riddle the road. There is little evidence that this was done. A solid layer of sealcoat was to be applied to the - debris free – road as the final treatment. It was applied thinly in most areas, and sprayed over loose gravel, grass sprouting out of the pavement fringes and in one location, cow manure! The ratio of materials used vs what we got charged is substantially off, in favor of Jim Edge.[redacted] said he'd be back out the week of the 5th of June. That didn't happen.About the payment. The 7,500.00, as stated in my original complaint, was on a debit – not credit card. Under NO circumstances would it be permissible to charge a “use fee” for a debit card, even if we were in a state that allows “use fees” on credit cards. Once I found out that credit card “use fees” are illegal in the State of Texas, that became another major layer of complaint that adds to the need to address our issues in this forum.About the math. [redacted]'s explanation of how he applied the 3% is confusing – at best – in his answer. I will go with the conversation we had where he said he was going to apply 3% to my personal card. According to the contract, he was still owed 8,721.80. Three percent of that is 261.65. Even if I go with the larger number and assume he charged 3% of the entire 16,221.80 of the contract amount, that would be an additional 468.65. He charged my card 786.95 over the contract price!On the invoice I finally received the Monday after the payments were made, the bottom line clearly states: “Total after taxes $17,008.75”. So which is it, did [redacted] charge us sales tax and if so how much was it? Was he just preoccupied with something else when he wrote that and it's just a mistake and he really did wind up “paying the taxes on it” himself? My opinion is that he just made a bunch of answers up as he wrote without thinking that anyone reading it would analyze it for its gross inconsistencies. How embarrassing for him.As of Tuesday, June 13, [redacted] has agreed to come back out to [redacted] and finish the job starting June 15. He has agreed to a final inspection at which time we will negotiate payment. Payment by check is predicated upon [redacted] agreeing to Discover Card to the reversal of the payment he extracted from my card under false pretenses. Once I receive notification from Discover.com that the chargeback is permanent AND a detailed invoice on Company Letterhead indicating the amount already paid, a subtotal and a remaining amount owed – not to exceed – 8,721.80, I will approve the payment from [redacted] I Property Owners Association's business account in the form of a paper check.About my attorney's fees. To date, I have incurred a total of 975.00 in attorney's fees in my attempt to compel [redacted] to reverse the charges on my Discover Card. He is well aware of these fees. As these correspondences indicate, he has not made any attempt to expedite my demand nor has he agreed to do so either verbally or in writing. I am adding to my Revdex.com complaint here that Sealcoating & Striping by Jim Edge is now in debt to me in the amount of 975.00. Sealcoating & Striping by Jim Edge is hereby on notice to promptly tender a check made payable to Mr. Michael L. Thornton in that amount and mail it to the address that is at the bottom of the emails Mr. Thornton sent to [redacted]. Failure to do so will result in additional attorney's fees as I will be forced to seek further council.

We still have yet to get the $9,508 due to the fact of the chargeback even with this happening we have gone back 3 times to fix issues with there failing road . We first told them we thought that it needed overlaid but due to the price difference they choose to go with a sealcoat instead . We sealed the road the same as we would any other job but the failing chipseal road continues to tear up due to the bad road not due to the sealcoat job that we did . The sealcoat is a coating that goes over the road to put the minerals and oils back into the asphalt . It is not a miracle cure to fix the bad road that was existing . We have continued to try to make them happy with the job but I can't help if the road continues to fail since the road was existing . I have attached a screenshot of the email from one of the hoa  members that proves we have been back 3 times to try to make them satisfied with the job .

To whom this may concern ,We had already talked to [redacted] about the issues with the road and had already scheduled fixing the issues . The contract that was signed stated check on completion and the check wasn't ready on completion. I asked if they had a credit card to process the payment and was...

told that yes they did when I ran the credit card it would only allow $7500 not the full payment for the job . The lady I was talking to offered to pay the remaining balance with her person credit card and I was very upfront that there would be an extra 3% charge for the use of another card. I'm sorry if you had an issue with this after the fact and wish you would have called me personally for us to work out a solution.  I will continue to do everything in my power to make sure that you are happy . I even was paying the taxes on it myself since I felt bad for two 3% charges since they used two different cards to pay with . I feel that I was trying to be as compassionate as I could with the situation . Thank you and Please contact me if you have any other problems .
