return and personal returnThere were no issues with his personal tax returns for all years, all the issues arose due to his businessMr***'s original financial reports provided to us were not suitable for filing a tax return, and we filed for an extension at the IRSThis gave Mr*** more time to work on the bookkeeping to get his financial records in order so that we could prepare the tax returnWe recommend that we work on his books to reconcile his accounts and have them properly allocated, but he did not take us up on this offerWhen it came closer to the due date of we were provided the updated bookkeeping recordsWe provided Mr*** with his tax returns before the due date, and have a record of him downloading the files from our client portal on We gave him an email with instructions to file the tax return as wellWe know that the client followed our instructions, because the is on record at the IRSMr*** did not provide us with any notices or problems with his tax return throughout Similar to his tax return we had to extend his tax return to to give him time to get the bookkeeping readyRather than mailing in the extension like he had in previous years we electronically filed itThis is where the problems with Mr***'s business account at the IRS came to lightIt turns out that the EIN number that Mr*** provided to us, and had been using was not a valid EIN number at the IRSWe would not have known that this was an issue because all of his prior year tax returns provided to us dating back to 2009, which were prepared by his prior CPA, used the same EINAdditionally, for the rest of the year no notices were given to us that would indicate he had a problem at the IRS until we received the rejected electronic extension requests from the IRSWe sent an extension request to the IRS for his invalid EIN number (not known to be invalid to us at the time) on (Submission ID: ***) and again on (SubmissionID: ***)The IRS sent us back a rejection noticeThis is what prompted our investigation with the IRS where we found out that he had been filing tax returns under an invalid EIN numberWe have records of speaking to two IRS agents on to investigate his issue and to get the extension request granted, however because his EIN was not valid the IRS has no record (how can they make notes on a file that does not exist)Over the course of the next one to two months (the speed of the IRS) we were able to recover his working EIN number and merge the invalid tax id to his valid working EINThis involved supplying the IRS with all of his prior tax returns that we had on file.Now that the IRS had an address and working EIN for Mr***, he began to receive notices of all of the issues with his account at the IRS.When it came time to file his tax return we had resolved his EIN issue so that the IRS could accept our electronically filed tax returnA month later the IRS sent Mr*** a notice that he would owe money because the tax return was filed lateThis notice was generated by a computer which did not take into account the extension that we had submitted in April of We contacted the IRS after Mr*** provided us with the IRS notice and we spoke to IRS agent ***The agent agreed that she could see our activity in the summer to merge the account, but they had failed to record the and the extension request we sent in April of We then put together a package with all of the information the agent requested to clear up his account on 10.27.15, and sent it to the IRS by certified mailGenerally, anything mailed into the IRS can take six to ten weeks to be processed, in this time period Mr*** would continue to receive letters from the IRS of his late filing penaltyWe had provided him with all the documentation that we had sent to the IRS, because he wanted to call them himselfWe did not hesitate and provided him with all the information he needed to speak with the IRS to resolve the issues for his account.It is our belief that he is displacing his frustration with the IRS upon usAs a result of Mr***'s EIN and mailing address issues with the IRS being resolved, Mr*** is now receiving notices of the problems on his accountWhen we were made aware of those issues we responded in a timely manner to the client and the IRSSomething we explained to the client is that the processor at the IRS could have very well missed Inputting the tax return, or even overlooked itAlso his original file of the was submitted under an invalid EIN which could have also been the issueRegardless, everything has been sent to the IRS on multiple occasionsThe computers at the IRS sent out notices without taking into account items that are pending processing (which can take six to twelve weeks), or a notice may have been sent out but by the time the client receives that notice the issue may have already been addressed.We prepared Mr***'s tax returns based on the information he provided to usWe gave good faith effort in preparing his tax returns, and gave due diligence by indicating the issues that we saw with his financialsEach year he was our client we filed extensions with the IRS in order to give Mr*** more time to get his books in order to file his tax returnsWhen issues came to light we took appropriate action to help Mr*** resolve the issue at the IRSWe have spent countless hours on hold, and speaking with IRS agents to resolve Mr***'s issues that were growing long before he was our client (most of which have been resolved at this point)It would be completely unreasonable for us to refund our services for all the work we put into preparing his tax returns and then pay for mistakes not of our doingWe prepared the tax returns in a timely manner and delivered those returns to Mr***The IRS not processing his forms
