Do know that a two-hundred-and-twenty-five-dollar down payment was made to Sean D on November 17, 2019 to create an eBook, and set it up with ***, *** and my website. In order to do the job, he requested my user names and passwords and I gave them to him. His updates reflected many conversion mistakes which were made by his software and he corrected them. Suddenly, he stopped and still thinking that he would finish the book, I waited and waited. He then demanded immediate payment which was supposed to have been executed when the eBook was completed.

Later, I saw the $225 electronic withdrawal on my checking account statement of all places'on January 30, 2019 Sean D helped himself to a two hundred and twenty-five-dollar electronic transfer which I neither approved, consented to nor had knowledge. I was advised by *** to dispute the matter with Chase and Chase sent me back to ***. On February 17, 2020, Chase Customer Service Department wrote, '? the transaction was processed correctly or was authorized.? This is absurd and does not make sense.

I am seventy-five years old and would appreciate your processing this matter as thievery and a crime against the elderly. According to ***.com, a dispute is 'a disagreement, argument, or debate? and theft'?? (the act of) dishonestly taking something that belongs to someone else and keeping it.'

Desired Outcome

Refund A Cashier's Check in the amount of $450. Thank you.

This customer's complaint is invalid and flawed on multiple points.
1. The initial deposit was made Nov 17, 2018, not 2019 as the customer stated.
2. To clarify, in regard to the sharing of her passwords, the customer was given the option to either set up her *** KDP publishing account with my assistance over the phone - or share her *** password with me so that I could login and set up her account and upload the ebook for her. She opted for the latter as she claimed to not be tech savvy. I also advised her she could change her *** KDP password once the project was complete. That was the only password shared, and NEVER were any banking or financially sensitive passwords requested or shared.
3. The customer claims that many conversion mistakes were made by my software. Not true. I am attaching copies of two author services proposals that I drafted and provided to the client. The first was a turn-key proposal to format, and correct existing and conversion flaws. The amount of the original proposal was $1,937.50. I cited numerous formatting and conversion errors due to the fact that the only manuscript the customer could provide was a very old locked PDF file. The customer indicated that was not an issue, and she renegotiated the proposal as her budget could not exceed $450. I hesitated to proceed, but she convinced me to help her "preserve her uncle's legacy in this book." So, I prepared a second proposal (attached) and removed all editing and formatting; thus, reducing the scope of the services strictly to an ebook conversion from the existing PDF and *** KDP account set and ebook upload. The second proposal was for $450. In spite of the bare-bones proposal and rock-bottom pricing, I felt I really connected with the customer during our conversations; therefore, I went above and beyond to fix some blatant formatting problems that were outside the scope of the revised and agreed upon proposal. The client felt this was an invitation to conduct a deep-dive into editing and formatting the whole project. I politely explained to her that the formatting that I did was pro-bono, and that our agreement did not provide those services. I take a great deal of pride in my work, and I'm very detail oriented; hence why I opted to fix the major mistakes, which were not caused by my software, rather the outdated, locked PDF conversion that we both knew about at the inception of the project. Had she gone with the first proposal, I can promise, without hesitation, that every effort would have been exhausted to correct every last minuscule detail. However, I had already spent three times my time allocation on the project.
4. The project was completed in late January 2019. The *** KPD account was created for the customer, with their approval, involvement and oversight on the phone and online. The ebook file was uploaded and proofed on the KDP platform by me and was mutually determined complete. I instructed the customer on how to view the book on the KDP previewer and advised her to change her password now that the project was complete, if she felt inclined.
5. I then submitted my $225 final invoice to her electronically through ***, which is the same method we used for the initial deposit. SHE, I repeat, SHE, made the final payment by credit card through the *** invoicing system. I have never had access to her credit card or banking information. The fact that this customer is accusing me of "helping myself to a two hundred and twenty-five dollar electronic transfer that she neither approved, consented to nor had knowledge..." is absolutely absurd. I'm happy to provide my *** invoice and payment receipt (attached). It is beyond offensive that I'm being accused of "thievery and a crime against the elderly." I have NEVER stolen anything or participated in any sort of fraud in my entire life. My reputation is paramount to me.
6. In closing, as per the revised author services agreement, the completed ebook was delivered to the customer and resides in her private *** KDP publishing account. She has full access to it, and has since late January, 2019. I have invested my time and energy in this project and delivered a final product above and beyond what the customer agreed to and was able to pay for. I have no intention of issuing a refund in any amount.

Herewith is my response to your letter of May 8, 2020--the company's response is unequivocally .
More precisely, his Invoice Number *** is dated November 16, 2018; on November
17, 2018 *** Manhattan Bank Credit Card Statement documented a charge for $225
through *** to SEAN DONCOMT; on the January 30, 2019 checking account statement
shows that through ***, SEAND*** electronically withdrew $225 with neither my
permission nor knowledge. Yet, I am humbly appreciative of his acknowledging
that he received the $225 that was demanded of me. So, between November 2018 and
January 2019, he received the down payment and the balance for the eBook in spite of the
fact that he knew it was not completed.
Mr. D is indulging in creative writing here--he had stated, "l need the passwords in
order to setup the accounts and upload the eBook." Ignoring my intuition and better
judgment, I very reluctantly gave him the passwords to my *** and *** Accounts.
The attached documents are a confluence of misdeeds which are contrary to what he
writes now. I had not heard from Mr. D for weeks and when I called him, he stated
that he was sailing and would call me when he got back. Suddenly, I received an invoice
the balance of $225 must be paid immediately. I did not initiate any payment because it
was due when the book was completed. As time went by, I was bothered about the
demand for payment and began searching my statements and lo and behold, I saw
where Sean D took $225 out of my checking account. Wow! He had to have used
the password that he claims that he needed to perform his job to get into my ***
Checking Account. My statement is more reliable than what he has related.

I no longer bank online because Mr. D and his associate programmer hacked my
credit union website and canceled my health and life insurance payments. Also, they
vandalized the picture for the foreword that I wrote, and disabled the pagination of the
eBook that I learned how to create online which was extremely stressful for me. I was at
the point of just having to proofread it when the page numbers were scrambled to my utter
frustration which was very frustrating. My conclusion is that they do not want me to
succeed and so, they sabotage my work and computer almost every day. One of my
customers wrote to let me know that the very same book on which Mr. D was
working was delinked at my Website.
3. I spent 5 years editing this book which was published years ago by the Oliver C
Cox Online Institute. There is mendaciousness also in Item 3. At the onset, Sean D
was correcting the excessive mistakes which were awful and overwhelming. His
Unprofessional-ism allowed him to upload the book to Kindle Direct Publishing with many
mistakes which were made by his software and were so bad that they sent me an
email which is attached. For the record, every time Mr. D sent me an update, l
emailed all the mistakes asking him to correct them. I even asked him for the name of the
software so that I could buy it and make the corrections; I was ignored.
He never informed me that there was something wrong with the PDF. I respectfully submit
that Item 3. is a poor defense attempt which was written to present himself as a decent
human being and for the consumption of the powers that be at the Revdex.com.
He is not. He and his programmer business associate conduct business using the tools of
the dark side of computer knowledge. From the onset, they have been going through my
computer, invading my privacy and vandalizing.
4. Sean D never advised that the book was completed! Instead, I waited for him to
call me because he told me that he would when he returned from Sailing. Sorry, but
Sean D is a liar and a con artist. Please see the attached *** documents.

It is my hope that my complaint is clearer and the attachments are acceptable. Your
assistance is appreciated.

I stand by every word of my initial response.
The consumer is making outlandish, baseless accusations. I have absolutely never requested passwords to or access to her ***, *** bank, or any bank for that matter, or her computer. I simply needed to login to her *** account to set up her publishing profile and account through *** KPD, which is linked to her existing *** account. I do this for almost all of my publishing clients. This was part of our proposal, and she, in her own words, wasn't tech savvy, and couldn't do it herself. I did everything while she was on the phone with me and I even advised her to change her password when we were done for peace of mind. My "programmer" that she's referring to is at an arm's length from her and all of my clients and does not have any access to any client information at all. The only thing a subcontractor of mine has access to is the working manuscript document in static, native form that I send them directly.
Interestingly enough, at the onset of the project, in a phone conversation with the consumer, she expressed to me that a relative had hacked into her computer and was stealing/altering her documents. She even cited that she believed that to be the reason that the original book manuscript PDF was in an altered/incorrect format and state. I explained to her that it was highly unlikely that a 'hacker' could or would do this to her. Furthermore, I explained in great detail verbally over the course of several conversations with the consumer that the formatting issues and edits were a result of the fact that the document was created some time ago on older versions of software that were not conducive to re-formatting or smooth file transfers.
The "errors and mistakes report" she is mentioning is one that I generated from the *** KDP publishing platform showing existing spelling, grammatical and punctuation errors. These errors had nothing to do with anything I did and were outside of the scope of the proposal we agreed on. I did, however, address the editing and reformatting of these issues, that I knew were going to be present from the very beginning, in the first proposal I presented to her that she rejected, renegotiated and struck from the scope of the final proposal. It seems that she wants a five-course meal, but only wants to pay for the appetizer.
I do not appreciate being called a liar and a thief. Honesty and integrity are at the top of my list of core values. I delivered what was promised in the mutually agreed upon proposal, and she made the final payment to me on her own, with no coercion or harassment from me.
I am more than prepared to defend my position in a court of law, and if the consumer continues with her absurd accusations, I am also prepared to pursue avenues to defend myself from her slander, libel and defamation.

Thank you for the opportunity to consider a new offer and rebuttal response.

With all the respect to which Mr. Sean D is worthy, nota bene that my complaint to which he referred to as "invalid and flawed on multiple points" is indisputably supported by *** Manhattan Bank statements.

1. Thank you for acknowledging that the initial deposit was made on November 17,
2018. Furthermore, on that very day through *** "*Seand***" processed the payment; I only gave you my credit details.

2. If someone is setting up an online marketing system, the passwords are needed. I am surprised that you, of all people, would make an issue about passwords. Hackers like you and your programmer friend know that hackers do not need passwords. Since I met you, you hacked and vandalized my computer on numerous occasions--even changing information in my will which most would deem sacrosanct. Retrospectively, I trusted you and now, you empirically proved I ought not to have done so!

3. May all know that I shall not tolerate the mendaciousness of Mr. D's statement that he "... cited numerous formatting and conversion errors due to the fact that the only manuscript that the customer could provide." Actually, "Race Relations Raw and Uncensored" was re-created in Word and republished in 2010;
Mr. D received a PDF of the book. Please note that Item 3. is simply creative writing. For the record, when updates were received, I was the one who recorded the mistakes, made corrections and sent them to him requesting that changes be made.

4. This item has nothing to do with my current position. What is important is that I paid Mr. D a $225-downpayment by credit card to create an ebook. Every update was filled with conversion errors that were made by the software that he was using. It was so bad that I received an email from Kindle Direct Publishing in which they stated that it has too many errors. Because my standards are high, I could not do anything with the ebook that Sean D said that he could make.

When Mr. Sean D decided to abandon this project, he stopped corresponding; when I called him, he said that he was sailing and would call me when he returned. It was when I saw $225 missing from my *** Checking Account, I knew that I would never see a finished book and my money. Yet, prior I thought something had happened to him.

5. You naughty young man! I know exactly what you did! You submitted the
Invoice which disappeared from my computer; however, the initial deposit went
through my *** Credit Account and the final payment was processed through pay and the money was taken from my *** Checking Account. Both transactions are documented by *** Manhattan Bank. To substantiate the payments, attached are statements.

6. Sean D never informed me that the project was finished. He uploaded the book and I am still waiting for him to make corrections--thinking of it now, he never made any according to Kindle Direct Publishing. At one point, I asked for the name of the ebook software so that I could make the corrections myself and he never responded. He is concerned about this matter being in a court of law. He should know that the penalty for hacking is jailtime for 10 years for a first offence, and a recidivist gets up to 20 years in prison.

Sean D is still in fighting mode. The first step to a resolution is that he and his partner must immediately stop hacking my computer.
