Dear Ms***,On August 31, 2015, Ms*** *** contracted with my company, Seattle Tree Preservation, Incto have several trees pruned at her Shoreline, Washington home When I wrote the proposal on July 24, 2015, I told Ms*** that we had a backlog of several months before the work
could be done Ms*** decided to accept the proposal anyway, but she made it clear that she did not want to wait several months to have the work done.Based on this request, I set up a date with Ms*** to have an arborist come to her home on September 22, 2015, to do the work agreed to When Ms*** accepted the proposal, she told us that she would like to keep the wood chips generated from her job for use in her landscape When my employee completed the pruning work, he went to Ms***’s door and asked her if she would like all the chips that were in the back of the truckMs*** stood at her door and from there she could clearly see the amount of chips, and she asked that all the chips in the truck be dumped in the spot she selected My employee dumped all the chips and went on his way.Ms*** paid her invoice and we heard nothing from her until we received an irate call in November when she demanded that we return to her home and haul away all the remaining chips that she had not spread in her garden My office manager explained to her that once the decision is made to dump the truck and the chips are on the ground or the driveway, as authorized by the client, we do not return and haul the chips away at our own expense The office manager spoke with the employee who had done the work, and he confirmed that Ms*** saw the amount of chips that were on the truck and authorized the dumping of the entire load Following this interview, the office manager suggested to Ms*** that she try to give the chips away to a neighbor, or hire a landscaper or gardener to spread them around her garden We heard nothing more about this situation until we received the Revdex.com complaint last week.Ms*** claims that she did not authorize the dumping of the entire load of chips, and this is untrueHad she not said okay, we would not have dumped them Further, Ms*** claims that there is a large pile of chips left from what we dumped and that this is a haven for rats About ten days prior to receiving her complaint, I drove by her home on other business with a client in the neighborhood, and from what I could see, all the chips had been spread and there is no huge pile remaining to be spread If there are rats in the vicinity, this may have nothing to do with the presence of wood chips.The position of this company is that the responsibility to spread or haul rests with Ms*** and not with my company Further, we will not return to her property to haul or spread the chips without being compensated for our time.John H***, President,Seattle Tree Preservation, Inc
