Our policy with regards to a refund on a withdrawn loan is to calculate funds spent on services rendered, and to issue the refund on the remaining unspent funds This is despite the documentation signed by your client stating that the $fee was non-refundable for a withdrawn loan In the case of your client, Seckel Capital is quite in the negative after applying the $ application fee We did not charge your client for the services ordered of the appraisals, and therefore, due to Federal compliance, unable to issue credit for appraisals Any questions relating to these charges should be directed towards the vendor whose contact information is on the appraisals themselvesWe disagree with your client’s opinion of the actual facts during her refinance application In fact, these events cost Seckel Capital a very material loss including several lock extension under the verbal agreement that these loans would be executed Lastly, after sending this matter to our attorneys for review, the way we handled the loan(s) of [redacted] was 100% within compliance of all state and federal law and regulation That said, we do sympathize with [redacted] ***, the experience she felt she received, and as a result we offered credits to her loan in excess of $3,to pay for the closing costs in order to improve her customer satisfaction Unfortunately our offer was turned down as we feel that we have done all that we can do, in order to ease her concerns Thank you for your assistance.The Seckel Capital Team

This message is in regard to your complaint submitted on 8/12/3:00:PM against Seckel Capital, LLC Your complaint was assigned ID [redacted] .We need you to provide some additional information Please respond to the following points:May I please have more than days? This is a lot of paperwork to organize --- loans and hundreds of emails > Please provide an update Has the loan been completed? If not, what is the status? Neither of the loans was completed because Seckel would only close a package deal One of the loans was not worth doing, but I was willing to do it if the terms overall would be favorable But the terms kept changing, and I did my best to determine if each deal offered was in my best interest At issue were origination fees, appraisals and escrow accounts I would not sign papers without having read the HUD statement first In the end, they sent a closer without giving me time to study the HUD --- I was at work! This has gone on so long -- nearly a year If they would agree to the same deal today as I their January HUD, I would sign the terms and be a happy camper >Please provide copy of pertinent documents As I asked above, I will to do this but it will take time >Have you filed with any governmental agency? No, but I have been talking to a lawyer about a lawsuit If this "friendly" method doesn't work, that seems to be my only recourse >Who did you pay for the appraisal? I paid Universal Real Estate in Clifton Heights, PA They charged $for appraisals which were supposed to cost $820.Please return this information by within days of receipt of this notice If you should have any questions or don't have the documentation, please let us know Please attach the requested documentation within the complaint portal, or email to [email protected] or fax to [redacted] Thank you for your assistance in this matter

Good Afternoon,We have received your recent complaint and we are sorry to hear about your troubles with Kevin B [redacted] and the appraisal.Upon reviewing your file, we only see one appraisal from your original transaction in your file It does not appear that a second appraisal was ordered Lastly, it is not possible for Seckel Capital to refund charges that it has not charged due to Mortgage Banking regulations If there is an issue with the appraisal, you would need to contact to the Appraisal Management Company and/or dispute the charge on your credit card.We wish you all the best.Sincerely,Seckel Capital Customer Service

As a part of your loan pre-approval and mortgage application, credit is pulled and it is not what is keeping your score downIt is a part of the process Verbal authorization for a credit pull is a part of the pre-approval process is also industry standard, as approved by regulatory bodies

We received full authorization to pull credit report Please see attached electronically signed document by client.The delay in closing the loan has been explained multiple times by the clients loan officer Credit was run multiple times to remove items off the credit report, and we have
actually INCREASED her score during that period, free of charge After her score reaches the targeted score, as explained, we are happy to close the mortgage loan

I am rejecting this response because:  I would like to speak to somebody about this whole situation.  Why won't you call me or provide me your phone number?  What I have dealt with is unethical and I am concerned of the safety of my file and personal information.  I gave Seckel my credit card information on their credit form and they handled the charge and set up the appraisal.  I'm beginning to think this entire process was a scam and I'd really like to SPEAK with someone.  Every person that handled my file I have reached out to and all of their emails bounce and when I call the main number I get no one and the website no longer works.  You mean to tell me everyone doesn't work there anymore??  What happened to my file?  What about the fact that I never finished the refinance!  I'm just stuck now? I'm out appraisal fees with no refinance after I was told everything looked great?  What kind of crooked company is this?  I am outraged and someone needs to know what has been going on!

loan.  In the case of

The receipt from your credit card statement shows that the charge is from [redacted], not Seckel Capital.Kevin B[redacted] is no longer employed at Seckel Capital and may be the reason why your phone calls have not been returned.  I wish there would be more that I could do for you, however these charges are not from Seckel Capital and it is against banking regulations to send you a check outside of a a HUD/Closing Disclosure.
