To whom it may
concern-
In regards to the
complaint #[redacted] that you have sent us, the following is our response-
It is first most important to know that Mr. [redacted]
has never...

contacted us regarding this complaint. He has not called nor emailed
his issue to us and we have never heard from him after the inspection performed
on December 2, 2011. After receiving your letter, we contacted Mr. [redacted] and
discussed with him his complaint he filed with you. He stated that he did not
contact us because he thought we would not do anything about it. We had about a
20 minute conversation on June 23, 2014 at about 8:00 PM. This was the Monday
after receiving your letter. We left messages with him 4 times during the day,
and I called him again that evening. He has explained the issue to me, of which
I took notes on.
In Mr. [redacted]’s inspection, we rated his windows as “Maintenance”,
which is describes thusly in our report rating- ‘The component indicates a lack
of or need of general maintenance.’
This informs the client that he needs to maintain the non-maintained
component. In our comment section on his windows, we stated- “Finish deterioration and / or mold is present
on a few windows. Clean and re-finish windows to prevent further deterioration
or health issues.” This comment directed him to correct
the condition of the windows at the time of the inspection, not years later.
When discussing the
problem of the windows, Mr. [redacted] stated that he did nothing with the windows
for 1 ½ years. This means he ignored what we directed him to do about windows
that already showed issues we discovered. He claims that 2012 was a “drought”
year. Clearly, it rained and snowed all throughout the 2012 year, as well as
2013. The fact he did not find water penetration until 2013 would be attributed
to the fact he did not perform maintenance on the windows as he was directed 1
½ years earlier by our company. Now, 2 ½ years later, he doesn’t even contact
us directly, he complains to you so it will damage our professional reputation.
He was directed to repair the windows, he does nothing, and they rot out, now
it is out fault 2 ½ years later.
Additional
information Mr. [redacted] provided me in the phone conversation-
He called the
manufacturer who sent out a representative. That person told him the windows
were no longer under warranty, but there is a repair kit for the windows. Per
Mr. [redacted], the manufacturer repaired his two worst windows for free. He
obviously could have used the repair kit on other windows, but he chose to
replace them instead. He stated in total, there were 6-7 windows involved. So,
two repaired by the manufacturer for free, makes 4-5 he had to repair, not
replace. He also stated he was going to replace all the rest so they “all look
the same”. How does a repair kit for 4-5 windows add up to $30,000? Where is
the paperwork to show the expenditure, the repair / replace costs?
Other important facts-
1-
Our
inspection contract Mr. [redacted] signed at the inspection in 2011 states that we
have the right to review a complaint or problem before it is repaired. This is
common sense; if we cannot see it, we do not really know it happened, as well
as this allows us to determine the extent of damage as well as potential
corrections. Since he signed and agreed to this contract, be broke the contract
by repairing / replacing the windows without allowing us to view the problem. Repair
/ replacement of the components is all completed now from what I understand
from him per the phone conversation. Now, I am supposed to believe him in all
aspects that all this was necessary without me ever being able to review the
windows.
2-
The
State of Wisconsin Standards of Practice for Home Inspectors has a two year
liability limit on an inspection. Mr. [redacted] is complaining about issues he
failed to correct 2 ½ years after the inspection. We hold no legal liability
for this issue whatsoever.
3-
Mr.
[redacted] makes a derogatory comment about any competent home inspector would
have caught this. I did. He just did nothing about it. Also, for the record, I
have inspected over 15,000 homes, over 25 years in business, to never have a
complaint filed with you before this. I am a member of American Society of Home
Inspectors(ASHI) for over 14 years, a member of Exterior Design Institute(EDI)
as a certified moisture specialist since 2007, a member of Wisconsin
Association of Home Inspectors(WAHI), of which I am currently the Fox Valley
Chapter President, (I founded that chapter), as well as I have served on the
Board of Directors for WAHI for over 15 years, and am currently the State
President. I appear to be very much a “competent” inspector.
4-
Again,
Mr. [redacted] states that I should know about Semco window issues from 2000. Pray
explain to me how I could do that? There are hundreds of window manufacturers. Hundreds. We look at windows from
150 years old to brand new, yet somehow, I am supposed to know 14 year old
windows are known to have “problems”? Semco windows are very rarely used in
Wisconsin; I have maybe seen 10 houses with this brand on houses.
5-
Where is
the paperwork on this complaint? I ask that not only of Mr. [redacted], but of you
at the Revdex.com. Do you just send out a complaint letter without
researching the complaint, without even reviewing the facts, the background,
asking for proof? Or do you just send out, as you did to me, an unfounded,
non-researched complaint letter?
Here
ends our response to this complaint.
While I feel for the
man and his situation, and understand there has been some costs incurred and
discomfort and inconvenience, that does not excuse him from being responsible
to follow our recommendations to upkeep his windows. At a minimum, contacting
our company should have happened so we could investigate and help him. Now, we
have no proof, no knowledge or access to review and determine the cause, extent
of the potential damages. Our response is that we have no more involvement in this
complaint.
Respectfully
Submitted,
[redacted]
