I rented two storage lockers from [redacted], (the manager)for the month of September that required a $25 deposit for each. After discussing the timeframe at the time of rental, I noticed that there was one missing day from the time period required of 30 days. I offered to pay for the addition day and was told that he would take the addition day out of the deposit prorated at the daily rate for a 30 day rental, approximately $1.52 for each unit and then the remaining balance would be returned. I call for the deposit and he is claiming that there is a requirement of a 30 day rental and I was one day short and they are keeping my deposits for that reason. the move in date was 8/29, move out was 10/30, 31 days of rental. He refuses to pay me the $47 dollars owed.Product_Or_Service: Rented lockersDesired SettlementUnexplained and false business practices would warrant my refunded deposit of approximately $47. I was lied to on rental and now the math says I rented over 30 days so his excuse doesn't hold up. Thanks. Business Response [redacted] month to month lease paperwork document #[redacted] (units [redacted] & [redacted]) shows his commencement date and signature on the agreement dated 8/31/2015. His move out paper work show's 9/30/15. [redacted] complaint has different move in and move out dates, his complaint states he moved in 8/29/15 and out 10/30/15. If that was the case he never paid for October 2015 and in fact would have been occupying the units free of charge for the month of October. The documentation I am referring to above is available for review showing the correct dates. Secure Self-Stor can also provide a copy of the month to month lease agreement that [redacted] signed stating that "Lessee may terminate this lease by giving Lessor written notice of Lessee's intent to vacate, at least 10 days (initial __) prior to the last day Lessee intends to occupy the premises." paragraph 4 of document [redacted] initialed by [redacted]. Secure Self Stor received a verbal move out notice but not a written notice as required. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Yes you are correct I did make a mistake on the move in and out dates, I was renting for the entire month of September, 8/29 to 9/30. I filled out a 10 day notice to vacate on the day I moved in. We store motorcycles in these lockers and move them across the country, and my return flight to Reno was already booked for a return to vacate on 9/30, so we filled out that 10 day notice with your manager at the time of signing the rental paperwork. That is why the extra day was discussed at a prorated cost to be deducted from the deposit, which you still owe me.Final Business Response All that we require to process the deposit check would be a copy of the 10 day notice to vacate that [redacted] referred to in his response. We did not return [redacted]'s deposit as we have no record of a notice to vacate from [redacted]. Our company does not have a form for a notice to vacate, so we assume it was written notice from [redacted]. When we receive a copy we will send [redacted]'s deposit check to the address we have on file.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)It is a very convenient excuse, as the form was filled out at the time of rental with[redacted] due to the facts as previously stated, I already had my return flight booked and was aware of the date we would be vacating, and my copy was provided to the black gentleman on the day I moved out. First it was denied because I didn't stay a full month, then it was denied because I didn't stay 30 days, then denied by[redacted] because I didn't stay 32 days and now its denied because I didn't provide a 10 days notice to vacate, which I did twice. You are running out of excuses to keep a deposit that was designated for payment incase I didn't clean out the locker we left behind debris. Unethical Business practices.
