Contract signed and sent deposit but once I agreed on service considered contract invalid and issued a new contract/quote.[redacted] of Seegars Fence Company, Durham Division came to my home location to give a job quote on May 11, 2014 for a vinyl fence install. Measurements were taken and discussed the project. A quote wasn't email until May 28 after calling the office 2 times after not receiving a quote. Finally received a quote on 5/28 with an option for 2 gates and one with 1 gate no fence.Corresponded with [redacted] via email from 5/28-6/4 about the project. Called the office and spoke with a female asked if the quote was still valid because it was past 5 days like listed on the unsigned contract and I was told yes. She had [redacted] return a call to me to confirm this information she gave out. This it was late afternoon on same day when he returned called and said yes that quote was valid. Told him still waiting on HOA approval. Few emails exchanged during this time regarding the job about latches on the gate and he confirmed with me that I was going with the first project listed on the contract (2 gates plus fence). Emails were then forwarded to [redacted] on 6/11 when I asked about warranty information on the fence. He forwarded my email to [redacted] of [redacted] to send samples to match color. Samples were then received on 6/13. I emailed [redacted] on 6/19 and to follow up with questions on the color samples received. And how far installation was running and was told 3 weeks from the receipt of the contract.On 7/23 I called the office spoke to [redacted] D to say that the HOA has almost approved my request to install the fence and that is what I am waiting on. He couldn't find the job in [redacted] stack. Was on hold for a few mins he found it.. Was told that's fine the quote is the SAME! I was told they are currently scheduling 1 week into the first week of Aug once I send the contract over and pay a deposit.I faxed the signed dated contract over to this office on 7/25.Called the office on 7/28 to pay the deposit but the lady (I'm not sure if it was [redacted] or [redacted]?) couldn't find this contract. I told her that I would email it, so I emailed it directly to [redacted].Within a hour received an email from [redacted] D. he got the contact and that he was looking over the paperwork and it was confusing and he was going to stop by the site to make sure it is clear to him. The contract listed 2 sides of the fence install for $1289.00 (2 gates plus 18 length of fence.The contract also listed 1 side of the fence install for $686 (1 gate only). I circled the 1st option on the signed contract.I had discussed with [redacted] and with [redacted] that I was going with both sides on the original quote. I had asked for both quotes from [redacted] incase both was not approved by the HOA.On 7/30, I finally heard back from [redacted] D via email with a new quote. He had been to the property but never asked permission. I assumed he was going to call me to schedule a time to come by my home. He had unauthorized permission to be on my property. In the email he sent today the price for 2 gates and the length changed from 18 to 19. All other info was exact, except the original quoted price. The new quote price was listed at $1837.00. Not the $1289.00 that was on the original signed contracted sent to the office.I called [redacted] D via a phone call around 10:45a this morning and was told that [redacted] made a mistake and it was a typo after previously being told by the office that the original quote was VALID. Basically, [redacted] told me he wasn't going to do anything to correct the problem. Yes, his employee made a mistake but he doesn't work there anymore. After no resolution to the situation, I stated that I would contact the Revdex.com and [redacted] stated "we do over 2,000 projects and one complaint isn't going to make a difference". I AM NOT going to honor this contract. Was told its invalid, expired and he will not be honoring it for $600 in price difference. I told him to have a nice day and ended the call.Desired SettlementAs a consumer I feel it would only be fair that this company honored the price I was quoted. I signed a contracted and payed a deposited. As explained the paperwork once I reviewed did not appear to be right and did not match his proposal and advised I needed to visit the site myself.Once I visited the site what I had suspected was true. I explained this to Mr. [redacted] and advised him when I sent him the updated quote. When he originally asked for a quote he asked for a breakdown of doing both sides separately and that is how the job was quoted (1 gate on each line)and the second gate was a typo.When I figured both lines together and priced it at my cost to do so. The original price separate was at $1975.00 and my updated bid to do together dropped his total by $138.00. The original quote also had expired in the first of June as well and could not be honored.In closing his statement of he is 1 of 2000 jobs is not correct. I take every job serious small or large and do care of each outcome and why I figured at my cost to do so to offset what had been previously figured on the expired bid.No deposit was ever charged to the client as with the contract being wrong we could did not process the order and would not do so until the correct proposal was signed.My offer still stands to do the job at my cost if he chooses to accept it provided there are no price increases through the manufacturer.Consumer Response /[redacted]/I saved all emails and have a signed bid contract. Why was it never considered invalid until [redacted] visited the site unauthorized? I was not contacted for him to access my property, he went without my consent. To all consumers reading this compliant and to the Revdex.com [redacted] the owner of Seegars of Durham is unethical and deceiving. [redacted] agreed that his former employee made an error and he was not willing to match the quoted bid. For anyone that values ethical and fair business practices, you will not get this treatment from this company. I have contacted another branches of Seegars in Wake county and asked two questions 1) if a quote is valid if signed and submitted even past the bid date and 2) if an error was made on the bid would they match or honor it? I was told by these two branches that if his company made this mistake they would honor the bid. Final Business Response /[redacted]/I am neither unethical nor deceiving and do not appreciate the judgement of my character as he does not know me or how I run my company. I have only spoken to him briefly. I visited the site after telling the client there was something that did not look correct with his bid. He acknowledge this in his previous complaint and as well in an email dated 7-28-14 where he quoted "You will understand when you see the site"that I needed a site visit. I do have a copy of half of a incorrectly signed proposal on 7-24-14.The proposal has two sheets and only one was returned. The bid was originally written on 5-28-14 and had expired on 6-2-14 so it was invalid. If you did contact the branches in Wake County as discussed above I will speak with them and go over the details that I feel you may have failed to speak with them about. I explained previously that his bid was incorrect and that I priced at my cost. If I were unethical I would have simply said that I could not honor due to price increases and not been honest about a typographical error. Mr. [redacted] was aware the quotes were separate and a typo had been made. I offered to do this at my cost and it was not to his liking. I do my best to make a positive from a negative however Mr. [redacted] was unwilling to compromise and wanted me to adhere to a incorrect expired bid. I would hope that the thousands of satisfied clients I have worked with over my 18 year career would attest to my morals and ethics called into question. I wish Mr. [redacted] the best in the pursuit of getting his fence. Final Consumer Response /[redacted]/(The consumer indicated he/she DID NOT accept the response from the business.)Of course, anyone reading can formulate their own opinion of dishonesty of this transaction. The company has signed contracts via fax and by email and wishes not to disclose either (there are two pages both signed and dated). I was not offered a compromise, I was offer a take it or leave it offer. If at anytime you decide to visit someone's private residence without permission you should first get authorization, which he did not have my approval for. When Mr. [redacted] realized that there was a said error after visiting the site, he should have called me to apologize and offered a fix. I was emailed a new quote and evaluated price. First, it was his employee that made said mistake and then it was the material pricing that had increased. Just one cover after the other during our brief phone conversation.I cannot attest to ones personal ethics or morals that I do not know. I can only refer to the unethical and deceiving practices of this business that I received as a consumer.

Had Seegars fence installed company used old parts and some parts not painted/finished properly. Called several times and have been promised fixing. Purchased Seegars Fence which was installed on layout we designed and fence looks good.However we feel that the fence is hung backwards because we are trying to keep a 100 lb dog in the lot not keep other animals out of his lot. Told it was hung to fence standard. Don't guess there is anything I can do about the standard but looks like it would hold his weight better if the fence was flipped so that the chain would push against the polls and top rail if he jumped against it. The way it is now it is just being held with tension wire at the post and rails. Also the woods don't care how nice it looks on their side and I would rather see the finished product on the inside of the fence. Second thing we have noticed is that some of our hardware is black and some galvanized. It was all suppose to be black. Third thing is that one of our tension rods that the fence connects to at the corner post is a used and damaged rod. Fourth is that one of the gate latches cannot be opened without scraping the post which in time will damage the black coating. Paid a deposit of half ($1,000.00) before the fence material could be order and then paid the full amount on August 4, 2013 ($989.00) within 10 days after the fence was installed. Guess I should not have paid the remaining funds until the work had been corrected. Called and spoke with [redacted] the Owner/Manager and he assured me it would be corrected. Waited three to four weeks and called back and he said he thought this had already been handled and would have it handled the next morning. Called back around October 7th or 8th and [redacted] assured me it would be handled the next morning. It has now been over a week and we still have not heard anything. Desired SettlementThe Used/old Tension Rod to be replaced with a new one. The hardware all be painted black. The gate latch fixed so that it does not scrape the post. BEING THAT SHE IS NOT CLOSE IN I TOLD HER I WOULD CALL AND SCHEDULE DUE TO SHE LEAVES HER DOG IN THE FENCED AREA WHEN SHE IS NOT HOME. THE UNFINISHED NUTS AND BOLTS ARE NOT COATED AS THE FINISH TEARS OFF DURING INSTALLATION AND WE PAINT THESE. I EXPLAINED WE WOULD PAINT THESE ON THE SAME TRIP. WE CAN ADJUST THE GATE ON THE SAME TRIP AND TOUCH THE PAINT UP ON THE POST AS NECESSARY.THE CONSTRUCTION OF THE FENCE IS BUILT PER ASTM SPECIFICATIONS AND WAS NOT ASKED ABOUT THE FABRIC INSTALLATION UNTIL AFTER THE FENCE WAS CONSTRUCTED. WE CAN MOVE THE FABRIC TO THE INSIDE FOR AN ADDITIONAL COST THAT THE CUSTOMER IS NOT WILLING TO PAY. IF SHE CAN PROVIDE ME WITH HER SCHEDULE FOR THE NEXT TWO WEEKS I WILL ATTEMPT TO HAVE THE WORKMANSHIP ITEMS CORRECTED FOR HER WHILE SHE IS HOME.

Mobilization charge we were never told about. We have a signed contract for services that were provided which were paid. I feel we did everything to accommodate the client as possible. We initially went to meet with the client and were to move the existing fence then install additional new fencing. Upon the start the customer decided not to move the old fence and just put a new fence leaving us with ordered materials and scheduled time to adjust. Then the client decided to add three additional sections of fence requiring another order. After our third trip we finally finished the fence. We had bid to do this work in one day but due to the multiple changes and non decisions we made two additional trips for my two man crew. On her final invoiced I simply figured for additional travel and labor expenses to cover our costs. Typically we would charge a mobilization fee of $350.00 per trip but simply charged actual time and travel used. I only mentioned a lien after our third invoice was sent back with a check that stated balance paid in full. I explained I could not accept the check with this on it and would have to put a lien on it till it was paid in full. We credited the client $1091.00 from her contract although we did not have to do so and simply want to cover our expenses. I sent her multiple emails and mailing describing the charges without a response until I mentioned a lien. I feel we were fair and did everything the client requested of us and just want to be compensated for our time.
