Our rents run month-to-month from the first day to the last
day of the month. I don’t think the Renter
understands the Month-to-Month concept. She
rented the unit on 3/7/2015. Since she
wasn’t in the unit on the first day of the month, rent for March was
prorated
for only the days she would use the unit $a day for only days =
$44.25. This was explained to her at
rental time. In addition, she was
charged a onetime Security Deposit of $55.00.
Rent and Security Deposit collected for March totaled $99.25. It is a Month-to-Month lease and she received
a copy. Her rent would be $per month thereafter
due on the first of every month Again our
rent is from the 1st day of the month to the last day of the
month. Below is a record of what she paid:
Date
received Rent Security Deposit
3/7/15 $ 44.25 $
4/7/15 $
5/7/15 $ 55.00 _____________
Total $ 154.25 $
Shortly after the First of April I received a call from her
that she couldn’t understand why she had to pay rent on the first of April as
she has rented on 3/7/15. I explained to
her that our rents run from the first of the month and the first month’s rent
was prorated. She called on March 27th
saying she couldn’t pay her rent until the rd of April. This Renter called me numerous times saying
she was leaving and then called back in a few days saying she still needed the
unit. She called me at one point and
said her daughter wanted to rent the unit I said that was fine but her daughter would need
to complete a new lease in her name and pay the appropriate security deposit
and rent upon her (The Renter’s) termination on May 31st I did
not tell the Renter her daughter couldn’t put items in the unit while her
Mother rented. That is between
them. (I called the Renters daughter and
she said she didn’t want the unit for June.)
I was notified in writing she was
leaving on May 1st or before.
On 4/22/we sent a statement #
to the Renter stating that our understanding was that she would be out of her
unit by April 30th according to the lease agreement. Please call me when you remove your lock from
the door. Broom sweep the unit and do
not leave any trash. We checked the unit
after the first of May and her lock was still on the door. The person checking the units can verify
that. The unit was checked on May 6th. On 6/2/the Renter called with threats of
contacting the Revdex.com of Wisconsin and getting an attorney. I tried to explain to her why rent money
wouldn’t be returned and that she should review her lease. She gave me no opportunity to talk with her
and unfortunately, she hung up on me. On
6/3/her security deposit was returned to her Check #*** in the amount of
$55.00. No rent was returned as the unit
still had her lock on it after the first of May. She states in her complaint she was still in
the unit in May. On 6/5/I received
a call from this renter very mad as she got her deposit back but no rent
back. She made accusations that we cut peoples
locks off their door, take their property and rip people off. I’m keeping the phone messages. She also told me I need to read the bible and
should be honest. We have been in business
for years and have never had a complained against our company. We treat people fair and run an honest
business.
Our contract states: Lessee must give written notice days prior
to the end of the current month renting.
(She was still in the unit in May.)
Our lease also states that we do not prorate rent when you vacate a
unit. If your unit is not vacant on the
first (1st) day of the month, a full month’s rent is due. There are no exceptions. Tenant’s lock must be removed upon
termination of occupancy. Failure to
remove lock will result in your being charged the next month’s rental and
fees. The unit must be vacated on or
before the last day of the month for which rent has been paid and all terms and
conditions of this agreement are met by the Tenant.
We have not cheated her.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I received my deposit finally of $55.00. The only reason, I feel, I even received my deposit back was because of this complaint. [redacted] did tell me my daughter could not use the storage because she believed she had it rented, but the person ended up not renting the unit. I still stand by my complaint about this company. [redacted] also told me the check was written on the 1st, but the check was written on the 3rd of June, the same day I had filed. To me a month to month bases is a person rents a unit on the 21st, 30 days from this date the rent is do again. I did write her a note the same day I paid April rents stating, I will be out on the 1st. I also called her to explain my Landlord was placing carpet down in my unit, and need the unit for a few extra days in May. I was out of the unit with the lock removed around the 4th maybe the 5th. [redacted] held my deposit for a month after I had been out of the storage with no intentions of returning my deposit until action was taken. If that was a renter of the unit, [redacted] would of cut my lock and seized my belongings if the company was made to wait 30 days upon receiving rent. The business, I believe, needs to understand the same rules are applied to them as well. They expect rent on the 1st of the month, most companies will give you a grace period of 10 days. Not this company. And deposits should be returned within 10 days of leaving their storage. Did this company try to cheat me, I believe yes they did. Did they get by with it oh yeah.
Regards,
[redacted]
