Initial Business Response /* (1000, 5, 2016/06/21) */
we were contacted later last fall re septic installation & were given a small letter size printWe requested a full size print but never received one.Since we had trouble reading it We talked to the engineer who told us it was tight and we'd
have to work on their neighbors yardWe told client we weren't comfortable with that & they said they were new neighbors, but nice & shouldn't be a problemWe never heard that they received permission. We did not receive any down payment and do not have any signed contractThere must have been a misunderstanding about putting the system in during the winter, we never can as it has to be dry 15" down at the wettest spot where the system is to be installed and this requires a long warm dry spellAlthough they are put on a list, their soil type and location determines how quickly it dries, plus the amount of rain we receive and they are done in order of who is dry per the health deptOften systems go to the second year until they are dry so it's not unusual for the homeowner to have to extend their permit, which is the homeowners costWe never do contact clients during the winter & early spring as soils are all too wetWe had an unusual spring as the owner had testing and then open heart surgery so for awhile his time was limited at the business and is still on restricted work for a few weeksThis has made it very hard to get work and responses done in timely mannerWe are not responsible for charges to extend the permit , if needed, because we never received a down payment and also because it's not unusual for the homeowner to have to extend their permit, which is the homeowners responsibilitywe apologize for any inconvenience
Initial Consumer Rebuttal /* (3000, 7, 2016/06/27) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We do not accept Seiler Excavating's response cause pretty much everything they claim that we didn't do was because we were not asked to
We were asked for a new print cause they lost the first one we sent not because it was small and hard to readWe sent a new as soon as we were askedWe did give the ok that we wanted to use them for install and asked what we needed to do to get on scheduleThey responded, you are on schedule and couldn't give us a time frame at the present time when they could startWe understood thatAt that point we were never asked or told we needed to put a down payment down or sign a contractWe were told your're on the scheduleI did talk to my neighbor not because I was asked to, but because we talk and he had no problem during soil sampling or during install if we went over property lineI could have relayed that if I was asked thatLate Nov early Dec I had a phone conversation with *** about drive way by garage and he also asked me to get property markedHe went on to say with the mild temps and lack of perception it was possible he could get something startedWhy would I go spend money to mark property if that conversatison did not happen.I sent *** a message as soon as that was doneThen reached out week later to see if he received my message cause I heard nothing back*** then responded he got my message and said thanksWe have our whole email thread of converstion that can and will contradict everything the claim we didn't doWe asked and asked questions and when we finally would hear back all we were told we were on schedule but couldn't give us a start dateWhich we understoodNow we will have to search for new installer and im sure it'll will be another year or more before we can get somethimg startedWhich means we'll have to pull another permitSeiler Excavating has poor communication and know I feel with the blame are very dishonest

Perhaps the customer doesn't know that when you email a print, it prints out in letter size, which is why I had to request the second time for the original copy and again received an email, so I had to contact the engineerWhen I talked to them about having to work on the neighbor's property and needing permission, I assumed that they would know that I would need to knowI don't have any ideas how he would have thought that I would have any idea when the system could go in back in Nov or Dec as they never go in the winter, but sometimes if the weather get hot early and no spring rains, depending on their soil, it can go in before the middle to end of summer. In discussing the perimeter drain, the engineer stated that that it appeared it would have to go under their driveway, which was not installed when he drew up the plan., and would be very labor intensive and would cost the customer more, so I suggested getting the property surveyed to see if it would fit anywhere elsethis is not wasted money as any installer would want that. The Board of Health has a full page of installers and I would assume they contacted an installer right away, which would be over a month ago and should be on someones list.Whether it gets done this year is most likely dependent on the weather and his soil type It is not unusual for a system to have to wait until the second year to be completedAlthough no money was given to us, if we have proof that they have a contract with an installer as of today and if they have to pull a second permit but NOT due to their soil being too wet, we'll offer to pay half of the second permit cost with proof of the aboveAgain, I apologize for the inconvenienceI was not expecting to have open heart surgery with restricted work for months and deciding to reduce stress by planning not to install septic systems in Allen County
