On 12/1/2019, I sent a letter to the landlord notifying them that I would be moving out on December 31, 2019. I received a letter form them stating that they would be entering the premises on February 1, 2020. But, they entered earlier, and the new landlord call and accused me of taking a washer and dryer. I explained that they did not belong to the landlord, I brought them with me when I moved in the apartment. I also had my lease acknowledging that I did not need to rent one from the landlord. I called and asked about my deposit and whether or not he was going to honor the lease. He said ok. The next letter that I received was dated January 21, 2020 that included a list of charges. They charged 50 dollars to install a towel bar that was never on the wall the entire time that I lived in the apartment
The charged 235.95 for carpet cleaning, when the lease specifically states that there would only be a 90 charge for carpet cleaning. In addition, they charged 100, to clean the stove and refrigerator. I personally took everything out of the refrigerator and scrubbed it clean. My mother is a witness, there was no food or food stains left in the refrigerator. And the stove is a self cleaning. They are charging 75 dollars for washer leak clean up. According to the landlord the water was leaking from the washer hook up, we turn the knob as far as it would go without breaking it off.
The landlord is charging 50 per hour to clean. That is not in my copy of the lease. The only cleaning is to the carpet. The apartment was clean nothing was left behind. There was no filth as he stated in his letter.
He kept my deposit of 730 dollars and now wants me to pay an additional 460.95
And now he refuses to talk to me about the charges.
I did not sign a less with the new owner and was unaware of all of the additional language like filth and 50 per hour for cleaning.

Desired Outcome

Billing Adjustment The lease reads that the 730 would be used as payment of utlity bills and cleaning of the apartment. No where in the agreement does it say that I would be charged for anything but the carpet. I want him to honor the agreement. Nothing was broken that needed to be fixed, nor was any trash left behind.

We received the complaint letter regarding Case #: ***: ***.
In response to Ms. complaint, she gave us a letter that she dated 12/1/19 stating that she would be moving out on 12/31/19. Per her original lease agreement, she was required to give 60 days written notice of her intent to vacate. In the section entitled "Security Deposit", it clearly states that the security deposit will be returned only if all of the terms of the rental agreement are fulfilled. By only providing 30 days of notice, Ms. violated the terms of her rental agreement. We notified her of this in a letter dated 12/9/19, as well as stating that she was still responsible for the January rent unless the unit was re-rented.

In regards to the additional charges, we sent her a letter dated 1/21/20 in which we detailed the costs. We also showed where we were willing to use the security deposit to pay the final month of rent. We are aware that the lease states $90.00 is to be withheld for carpet cleaning. However, the carpets had to be professionally cleaned due to their condition. The washer leak clean up was due to improper shut off and capping. The caps for the valves were in the unit when we went to conduct the inspection after Ms. vacated the property. She did not secure those to the valve, which resulted in a substantial leak. The stove was left in poor condition, and required a thorough cleaning due to grease build up, and the oven had grease and ash inside. The issue of being charged for cleaning is addressed in the "Security Deposit" section as well: "...cleaning the apartment at termination of rental agreement..."

The issue regarding the washer and dryer was resolved as we admitted we were mistaken.

Please review the attached Rental Agreement, along with Ms. 30 day notice letter, our response to her notice, and the final letter showing the outstanding balance.
