I am not sure why you are writing this response You and I had NO CONTACT with one another nor were you privy to any conversation that your wife, [redacted] and I had as well as my mother with her First, yes a contract was signed but prior to the signing of this contract, [redacted] agreed that we would get back our security depositSince you were not present at the time [redacted] came to my parents home for the initial assessment you cannot say that IT IS NOT IN YOUR COMPANY'S EXPERTISE NOR CAN YOU SAY THAT IT WAS EXPLAINED TO US AT THE TIME --- YOU WEREN'T THERE!!!!! My mother and I were!!!! [redacted] never said that caring for a disable family member was not in your company's expertise or she wouldn't have written it down in the assessment about his arm!!! Your statement again, talks about something you know nothing about!! [redacted] knew from the beginning that a caregiver had to be in place prior to my leaving on May 1st This was reiterated over and over again prior to Senior Helper's taking the security depositI asked her if this would be a problem and she stated she would be able to handle it Therefore, the terms of this agreement to say the least was contradictory both written and verbally as there were conflicting statements made by [redacted] that contradicted the contract She also failed to tell me that you did not have caregivers in your employee She NEVER discussed that she would have to advertise nor did she tell me she would be interviewing caregivers As addressed to [redacted] earlier the caregivers were to be CNA's or LPN's and neither caregiver had a license as such and one was obese and wouldn't be able to provide the full care for my mother You further did not address the fact that you over charged for the caregivers Your statement saying that we sent every single caregiver away is ridiculous and outrageous as you only sent caregivers The caregivers you sent didn't have the credentials stipulated in the emails back and forth between [redacted] and me Your comment that we cancelled the contract with no notice is absurd as [redacted] was aware of the deadline and she did not meet the deadline as she stated she would Plus there were days that she could have sent someone out and nobody came out I even asked her about this IT WAS YOUR DELAYS!! Again Senior Helpers of Central Texas breached the contract both written and verbal and fraudulently over charged for the caregivers We are requesting that a full refund be given, as again Senior Helpers of Central Texas failed to meet the deadline and meet the qualifications set forth in our emails regarding the credentials required from the caregivers [redacted]

Senior Helpers and the client signed a contract for senior care that specifically states that a two week termination notice be given by either party. The client also want to care for a disabled family member as well which is not our company's expertise. THis was explained to the client and we agreed...

to meet the basic needs of the disabled family member as best as we could while taking care of the elderly family member. We always explain to prospective clients that it sometimes takes time, even weeks, to find the appropriate caregiver for the family. The client understood the terms of the contract and knowingly entered into the agreement with Senior Helpers. The company expended many hours trying to please the client as they sent away ever single caregiver we sent to them. Despite this, the company continued to expend resources in advertising and interviewing candidates that might be pleasing to the client.The client cancelled the contract with no notice and sent the company's final caregiver away. Even though our contract states that the FULL deposit will be forfeited without proper notice, the company did refund 50% of the deposit. The remainder went to pay our caregivers for their time and advertising costs associated with the early termination of the contract by the client.We apologize for not being able to find a caregiver that met the expectations of the client; however, as we explained to the client, their expectations of "the perfect" caregiver were a little bit too lofty.Senior Helpers believes that we were fair in the decision to refund half of the deposit since the client did indeed breach the written contract and the company's costs far exceeded the 50% of the deposit retained.If you have any further questions please contact me directly [not the [redacted] email]:[redacted]President, Senior Helpers[redacted]
