Please be advised that I represent Senorita Bonitas and, as such, am authorized to reply to your letter dated September 23, regarding complaint ***The matter has been fully investigatedBased on that investigation, the business takes the following position:
First and foremost, we point out that according to the customer’s statement, it is disclosed that there was a telephone conversation between the customer (caller) and Ricardo (manager)Aside from all of the specific details alleged in the complaint, since it was a telephone conversation, rather than a face to face conversation, the conclusion that the caller draws from that conversation, “he would not allow me to reserve the table and I believe this was due to my ethnicity”, makes very little sense and is unsupported by any specific detail documented in the complaintUnless the caller told the manager that she was of a particular race or ethnicity, or the manager made a specific remark indicating that he was aware of the caller’s race or ethnicity, then there cannot possibly be discrimination based on the caller’s race or ethnicity and such a conclusion is unsupported, unwarranted, and unreasonable
In response to the other facts and allegations in the caller’s statement, the manager does remember the call but denies the accuracy of the incident as recalled by the callerAccording to the manager, the customer called requesting to speak with Ricardo and requested a reservation for a party of fifteen for a Friday night (the restaurant’s busiest time)Ricardo informed the customer that per the restaurant’s policy, reservations are not accepted for Friday eveningsWhen the customer was informed of this she became a bit more forceful and said that she had been told that Ricardo could arrange a reservationThe manager (Ricardo) asked who had given her his nameAccording to the manager, he was trying to determine whether it might have been a friend of his or one of his family members who had given his name to the caller and was contemplating making an exception to the policyHowever, as he was speaking with the caller, she kept cutting him off and said that she had called the restaurant earlier in the day and was told by another employee that she would have to speak with Ricardo if she wanted a reservation for a Friday nightAt this point in the conversation Ricardo again began to explain that reservations were not accepted for Friday eveningsAs he was explaining this, the caller again cut him off and said “are you going to take my reservation or not?”
It should be noted that the manager does recall at some point in the conversation that the caller mentioned the group was coming from the Cleveland ClinicFurther he denies that he was rude to the caller, and asserts that it was the caller who was rude to himHe adamantly denies that he made the statement “You people always call and book these reservations then order only chips and water” as is alleged in the complaint by the caller
Finally, my client’s position is that it has a policy of not accepting reservations for Friday eveningsThis is a very standard type policy in the restaurant business and it is one that most customers understand when informed of itThis policy is applied by Senorita Bonitas without regard to race, ethnicity, gender, etcThe policy is rooted in the fact that people make reservations and when plans change, some do not call to cancel the reservationOn the weekends when the restaurant is consistently busy, a table might be held and customers turned away or delayed only to find out that a party with the reservation is a “no show.” That situation negatively impacts the business
Senorita Bonitas is located in Solon, OhioSolon is a very diverse community and people move to Solon to embrace that diversityThe Senorita Bonita customer base mirrors that diversity on any given dayAs is anyone else in the community, the caller is welcome to dine at Senorita BonitasHowever, she should keep in mind that the restaurant does not accept reservations for Friday evenings and other high volume days and times such as weekends and holidaysSenorita Bonitas regrets any inconvenience this may cause however; this policy will remain in place for the foreseeable future

Everything mentioned in the statement from Senorita Bonita's attorney regarding my attempt to make a reservation at Señorita Bonita's is a complete and utter lie! Ricardo stated he was the owner when I asked if was the manager after he was so rude to meHe NEVER once stated that he did not accept reservations for Fridays instead he told me that "you people only order chips and water"I was not forceful about trying to reserve the table as I had never been to this restaurant so if he had of told me that they didn't reserve for Fridays that would've been the end of the conversationBut, he never made that statementThe reason I asked if he was the manager was because he was so very rude to me and I wanted to speak with someone else that's when he told me that he OWNED the restaurant! Furthermore, although we were speaking over the telephone it wasn't impossible for him to make assumptions regarding my ethnicity because I have an certain accent and I speak in a particular verbiageJust as his accent lead me to believe he was of Hispanic decent, I believe my accent and verbiage lead him to believe I was of African American decentSomething that is further noted by the fact that he called me "YOU PEOPLE"!!! He is a liar!
