Initial Consumer Rebuttal /* (3000, 8, 2015/10/31) */
We will accept their offer
We know there were rust issues on our trade in, but we were up front with them and told them what work had been done and what needed doneAs far as the one we bought, their salesman said "there was no rust , it's a clean truck"
This could have been resolved without a complaint if they would have took the truck back at what they sold it to us and allowed us to trade on a different vehicleI won't believe they didn't know, since we called them less than hour after leaving their lot (we were at the DeKalb/Allen County Line on SR when we called them) and asked to bring it back and trade up on a different vehicleI'm sorry they feel that truck is safe for hauling young children in it's current conditionWe will not do business with Buy Right again

On 12/10/2015 Mrs. Becks son called the dealership and spoke with salesman Zach regarding our 1997 Jeep Grand Cherokee AWD V8...

and a Subaru Wrx AWD. He was out of town and was unable to physically come and look at them so he sent his wife to look at the Jeep because she was down the road from the dealership shopping. They wanted to trade their truck which was a Chevy 1500 Crew Cab Z71. They owed too much money on his truck so we could not come to an agreeable deal. The wife looked at our Jeep before she left. Later that evening Mrs. [redacted], the mother came into the dealership and took the Jeep for a test drive. Mrs. [redacted] dealt with salesmen Ricky because Zack had already left for the evening. She stated that her son told her to come and purchase the Jeep for the Winter Months. Mrs. [redacted] did ask regarding the Loudness of the Jeep. We did say it could be that it was a V8 or the Muffler. We did not know for sure. She asked regarding a mechanic looking at it and we told her that she was more than willing but the price would not change no matter what the mechanic said. Mrs. [redacted] asked us what we did to the vehicle before we placed it on the lot. We showed her the paperwork showing that we installed front and rear stabilizer bars, we installed front steering stabilizer bar, we put a drivers side window motor and regulator, we put 2 hood struts on the Jeep. We discussed price and Mrs. [redacted] stated that she was okay with the repairs we did and chose not to take it to a mechanic. We had an original price of $3000 on the Jeep, Mrs. [redacted] Negotiated the price to $2800.00 and her trade of a 1994 Pontiac Grand Prix with 184K miles and tax and doc fee. Mrs. [redacted] wanted to pay by Credit Card which is a 3% fee so her total came to $2297.00 Mrs [redacted] was upset she had to pay a 3% fee so the next day on 12/11/2015 Mrs. [redacted] came into the dealership with her grandson to pick up a 3% credit card Reimbursement check to cover that fee. Mrs. [redacted] has cashed that check. Mrs [redacted] had no complaint regarding the vehicle and she was driving it that day. ON 12/14/2015 Mrs [redacted] came in first thing 9:15 am and spoke with the owner, about how her daughter was drinking and driving over the weekend and decided that she would rather have her daughter driving her grand prix just in case she were to have an accident instead of the Jeep because it was too nice. She stated she wanted to return the Jeep for a full refund and her Grand Prix back. The owner stated that the sale was final and had already started working on her trade in the grand prix to get it ready. The Office Manager and the Assistant Finance Manager overheard her say all this to the owner. She stated it was a bad decision on her part to buy the Jeep because she thought her daughter had changed but she had not. Mrs. [redacted] called back later that day on 12/14/2015 again wanted to speak with the owner, Stated that she spoke with her friend at [redacted] firm and tried to intimidate the owner into giving her vehicle back. The owned stated that was fine and told her to have her attorney to contact us. We are sending her title work in the Mail on 12/29/2015 Certified and we have a written agreement stating that Mrs. [redacted] would bring in the title to her Trade the Grand Prix on the following Friday 12/18/2015 signed by Mrs. [redacted] which she has yet to do. We are turning this Case over to our Attorney.
OFFER:
At this time Mrs. [redacted] purchased a $2800 AWD SUV and signed all paperwork showing the vehicle was AS IS Condition. There were 3 different papers that was explained to her that all stated AS IS and she had no problem signing them all. There is not much Profit on a vehicle priced at $2800 and having to repair her trade as well. At this time we are awaiting for her to bring her titlework to the Grand Prix or We will have to take her to court.
Initial Consumer Rebuttal /* (3000, 7, 2016/01/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Since I always buy "used" vehicles, I assumed Buy Right would be equal to K and E in Kendallville AND Evans Toyota in Ft Wayne. A car (the grand prix) I bought from K and E in Kendallville had problems. So the car dealership fixed some of them as cheap as possible for me (EVEN THO IT WAS AN "AS IS" purchase). The car dealership...never told me I can't talk to you call your lawyer. K and E was kind and helpful.
1. Ricky, the salesman said his boss Frank would fix anything I wanted on the exhaust system (before I ever walked into the office). Ricky promised his boss would do it for me. EVERYONE, look at their reply are they standing behind their "word"?...NO!
2. In the reply, it says I paid a doc fee. Yes $89. The transfer title fee is $15 (at cost at the BMV). The BMV has told me on 1/2/15 that Buy Right has NOT transferred the title! Now they mailed it certified and want me to pay another $15 and get it titled myself. EVERYONE, are they standing behind their "word"? EVERYONE, am I getting what I paid for...NO!
3. I have a 1997 Jeep that Kelly Blue Book says should have been sold for $2400 because it was not in good mechanical condition (needs transfer case, electrical work, coolant system work, exhaust system leak and the driver tire leaks). I paid $2297 plus gave them a Grand Prix that only needed tires and rear brakes. Buy Right is fixing the headliner and visors to make it look nice and pretty. THAT IS NOT NECESSARY!

4. I had a Grand Prix that suited my needs as a "backup car" when my good running car needs to go in the shop. Now, I lost my "backup car" and $2297. I am left with a Jeep with alot of problems that is just parked in the garage.
OFFER: Process the title which I paid for! Fix the exhaust leak your salesman promised 2 times before I ever walked into the office. Change the fluid in the transfer case to see if that fixes the transfer case (turn problems). If the Jeep still locks up while trying to turn sharp, give me a refund of $300. (1/2 of the cost of fixing the transfer case). Then I will mail the title for the Grand Prix certified to Buy Right. OR give me my Grand Prix back plus $2000 for the Jeep.

Final Business Response /* (4000, 9, 2016/01/09) */
Contact Name and Title: Frank [redacted], President
1. In regards to the Doc Fee of $89. We never stated that it was for us to do the titlework. The doc fee is for all the documents that we have to use by the Indiana state guide lines. If you look up the guidelines for Indiana Doc fees we would have charged up to $475 but we try to keep it as low as possible for our customers at $89.
2. In regards to the Exhaust, Mrs. [redacted] never asked Frank while signing all her paperwork to fix anything. She did however ask about the sound which Frank stated it could be that it is a V8 or the muffler. Mrs [redacted] never asked it to be fixed. She signed a Due bill that stated she would bring her title work to her trade by Friday Dec. 18. It also Stated NOTHING DUE and NOTHING PROMISED> Mrs [redacted] never questioned this and signed it.
3. In regards to Mrs. Becks trade, yes we are making improvements that need to be made so that the next customer who purchases it has a dependable car.
4. If Mrs. [redacted] had such a nice car ( her trade the grand Prix) why did she trade it in for a new vehicle. We were told that she wanted to trade it in because the headliner was sagging, needed Front and rear brakes, and new tires and that she did not want to put any money into that old of a vehicle. And in regards to Kelly Blue Book, they are just a guideline which is no different from NADA.
OFFER:
In regards to this complaint here is a customer that doesn't know what she wants. She has made false accusations and claims and has a different story each time she responds between the Revdex.com and the Indiana Attorney Generals Office. What ever happens between Mrs. [redacted] and her daughter (drinking problems) and the fact that Mrs. [redacted] was the first to bring up contacting her attorney if Buy Right Auto Sales did not comply with her demands should have no effect on the purchase of this vehicle. All claims on Revdex.com are available for anyone to read and they can clearing see that Buy Right Auto Sales has always come to a reasonable agreement to make the customer happy. We cannot comply with Mrs. [redacted] because we have spoke with our attorney and we have all our paperwork that was signed that the state of Indiana requires. Again we are going extend the time to Mrs. [redacted] to bring or send the title to her Grand Prix that she traded in on Dec. 10, 2015 by January 22, 2015. If we do not receive the title by that day our attorney as advised we move forward.
