In response to the rejection letter received from Mr *** Sergios Automotive will not be responsible for Mr***'e, engine On July 8th we performed an oil change service on his Mazda 3speed 2.3L Our technician drained oil and installed new oil filter with quarts of synthetic 5woil as required by manufacturerOur invoice states this *** Mr*** signed on July 8th . Customer states that on October 11th he heard the engine noise and on October 12th he had vehicle towed into dealer Mr*** did not give Sergios Automoitive a call until October 18th letting us know of the problem he is having .Customer had vehicle towed into our shop on 10/27/and came to sign the work order on October 28th . On November 2nd we called Mr, *** and stated that we will not be responsible for repairs to vehicle It has been three months since oil charge and nearly miles .Customer stated he hasn't :Decked oil since oil change on July 8th until the engine started to make noise Checking the oil is mandatory at every fuel fill up per vehicles owners manual due to the performance nature of the engine I have attached documents of service history of the vehicle stating vehicle has consistently gone in to the mazda dealer for check engine light and engine noise ,and engine oil level has beer found low and dirty on all occasions, Reference invoice from Palm springs motors # ***, invoice ** *** and *** Sergios Automotive has also found on service records that the compression of the engine has dropped consistently at two different occasions Research has also shown that engine oil consumption is a very common problem with these engines Customer has known

On July 8th ,we performed an oil service to Mr*** Mazda speed ,included in service was quarts of STP synthetic motor oil ,a new oil filter and to check and record tire pressure Upon completion of service technician also rechecks for any leaks and checks all fluids At the time
of completion tech states ad fluids were full and no leaks found at this time ,tech also at the time of repair noticed no abengine noises Mr*** contacted Sergios Auto on October 18th ,and stated that his Mazda speed was at the local Mazda dealer due to a knocking/rattle in engine while accelerating above idle .Mr*** than stated that the Mazda dealer stated the engine oil was low quarts and contaminated with metal and very dark ,and dealer advise to rep ace the engine and inspect turbo for any contaminationMr*** also stated that the dealer submitted repair to his insurance company and they declined repair due to low oil level /consumption. Mr*** than states he would like to have vehicle towed into Sergios Automotive because he feels we should be responsible for repairs because we were the last repair shop to perform the oil change service.Customer came down here to Sergios Automotive on October 28th ,„after vehicle arrived to sign the repair order On October 28th Sergios Automotive stated battery is dead ,Sergios Auto proceeded to charge battery so that we may perform inspection Sergios Automotive confirmed at this time the oil level is full but contaminated .Sergios Automotive started vehicle a rid confirmed engine knocking /rattle at rpm . On November 2nd ,Sergios Automotive called Mr*** and told him that we feel that we will not be responsible for any repairs to engine Mr*** became loud and states we need to be responsible because we did the change lastSergios Automotive attempted to explain to Mr*** about checking oil e:very fuel fill up per mazda owners manual He stated he checked his own oil at miles and found low .Sergios Automotive attempted to tell customer that per Mazda owners manual oil needs to be checked at every fuel fill up and topped as necessary Mr*** continuously would not let us talk and kept cutting off our conversation .stating we need to be responsible and he did not want to hear what we had to say . Sergios Automotive will not be responsible for any damages or repairs to engine due to customer negligence ,not checking engine oil regularly , Attached is Invoice from the dealer and a copy of the two pages of the owners manual stating oil must be checked at every fuel fill up

I am rejecting this response because:
My vehicle has been at Palm Springs Motor for issues regarding detected misfires that have nothing to do with oil consumptionSergio's Automotive is correct in that the dealer has mentioned on several occasions that the oil was low and dirtyThe dealer did not address the issue it was not negligence on my part as a owner of the vehicleSergio's Automotive continues to not accept responsibility for my engine failure and points the finger for my lack of maintenanceI have all receipts for all oil changed or any other services performed on my vehicleRegardless of what information Sergio's Automotive might have on the history of my particular vehicleThe bottom line is that I had no serious issues with oil consumption which caused engine failure until Sergio's Automotive changed the oil on my vehicleI will take whatever necessary steps to correct the wrong doing of Sergio's Automotive If Sergio's is a respected auto repair shop in the community and pride their workmanship then perhaps they should have seen issues that needed to be addressed instead of blaming me for the failure of my engineThis will not be resolved until a fair agreement is made as to the repair of my vehicle
