Hello, I do not have a contractA representative of Sergio Pools demanded a check for plastering my poolThe contractor I hired told me to do itSergio pools did not perform on this verbal contract and the pool was never plasteredI am asking for a refundThere is no paper contract, it was a simple verbal contract They needed to either perform services for this money or return themThey did not perform so they need to return Thank you ***

We were hired by a contractor on March 21st based out of New Jersey; Dennis S***, owner of *** *** pools, to perform a renovation for two of his clients; Mr*** *** and a relative of ***Under a contract with Dennis for $12,and similar amount for his
relatives contract to prep the pool surface and replaster with a high quality, delicate pebble finishOur company provided and received electronically signed contracts from Dennis of *** *** pools. Performing the same renovations for both pools under the contract we had with Dennis, it was required and agreed upon that we receive $3,deposit along with the signed contract. Following the deposit a first payment of $4,was required when we began work on the pools, all of which Dennis and our company had agreed on the payment method on the signed contractAs stated on the signed contract, it specifically says that the first payment shall be received on the first day of work, which was agreed uponWe had purchased all the material that was needed before we began working on the pool and it was stored in our warehouse ready to useOn April 6th, 2016, we began the renovation of Mr*** ***’s relativeWe completed the first step of the renovation at ***’s relatives’ poolDennis did not show up at the jobsite to hand us the check on the day of the prep along with the deposit of $3,as we agreed onOn April 8th, we began to work on Mr*** ***’s renovationAs we begin with every prep, we first drained the poolWe proceeded with our daily routine when prepping the pool until the foreman discovered that the pool was painted, they called us immediatelyWe reached out to Dennis S*** and mentioned this to him since as he stated; was not aware of the pool being paintedThis did change the procedure of the renovation order on the signed contract because the pool now needed sandblasting to remove the paintHowever, Dennis asked us to proceed with what was possible at the momentHe also had mentioned that there was tile and he had asked us to remove the existing tile (also not mentioned in previous conversations with Dennis)We preceded the work and tried to complete as much as we could regarding the limited work arrangements that Dennis had provided with us withThe day of the prep for Mr*** ***’s pool, as stated on the contract, we had a scheduled payment of $3,which Dennis was not present to provide us with the checkDennis had asked us to contact the client, Mr*** *** to hand us a check with the amount of $7,to substitute for the payment that Dennis could not provide us with since he said he did not have the timeThe check that Mr*** gave us with was not a complete payment for both deposit and first payment due that was scheduled for the day upon arrivalThe original amount was totaled for $8,We accepted the check since it was not Mr***’s misdeedWe were not able to complete the project for the day and we had our crew leave; Dennis was contacted and aware of the situationDennis had previously contacted us letting our company know that he was going to sandblast the paint off the pool to get it ready for our crew so when they arrive to the job site they can move forward with the jobOur crewmembers returned to Mr*** ***’s pool on April 20th, When they arrived, the men noticed that the sandblasting was not completeAgain, our crew members had no other choice but to leave the jobsite due to miscommunication of Dennis and providing us with limited informationWe did get into contact with Dennis shortly after the second trial for the preparation of the pool to be able to go back and complete itDennis had mentioned that the sandblasting was complete and all the paint is now removedOn Thursday May 5th, our crew members arrived to the jobsite and acid washed and applied the bond coat to the pool as we do for every preparationOur men completed the prep for the day and leftAfter the day of the preparation we haven’t heard anything from Dennis to let us know when we would be able to complete the plaster installation for both *** *** and his relativeFor about 2-weeks we tried contacting Dennis via e-mails, text, and phone calls and he would not respond any of themWe kept trying to be in contact with him so we could have a date ready for the plaster installations since it was a very busy time for us*** ***’s relative had called us and e-mailed us regarding the plaster and why it was not completeHe was very unhappy with us and we tried to explain to him that we weren’t allowed to give him dates unless told otherwise by DennisUnfortunately since they are not our direct clients, we are not able to give them dates of work or information that Dennis is not aware of first since they are under contract with *** *** pools not Sergio’s pool service We wanted to continue the work on our own to make Dennis’ clients content but we cannot break contracts/agreements between our company and the contractorWe did perform work on both pools and we only got paid for a portion of one job which was not a complete payment regardlessWe want to do what is right and we are hoping to resolve this matter in the best way possible
