On April **, 2015, Serious Fun notified *** *** that, per her signed and initialed and much discussed and reviewed payment agreement, her account must be paid in full by May *, 2015, or Serious Fun could no longer care for her childrenWe also let her know that Serious Fun would be happy to care for her children when her account was current*** *** made it very clear she had no intention of paying and began her 3rd dispute of her credit card chargeAfter months trying to work out a solution with *** ***, Serious Fun asked*** *** to make other childcare arrangements for her children as of May *, Serious Fun did not call attention to the fact that *** ***'s children would no longer be attending, and in fact made no mention of the departure of *** ***'s children from the program, except to express to the *** ***'s children how much we enjoyed having them in class and that we were very sad to see them goThe Site Director and *** *** enjoyed a convivial relationship and at no time did any Serious Fun staff treat or consider *** ***'s children as "chattel". I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
Answer dated 9/**/
On 8/**/the school notified all parents that the new afterschool
program provider, Serious Fun, changed their start date from 9/*/to 9/**/On 8/**/I enrolled both of my children and paid for their
full tuition online plus a $online payment convenient fee. You had to pay the tuition in full online as
that was the ONLY option. My online payment
and registration was not in effective until as noted by MsSyliva R***
that I had to come in to the school on 9/*/to complete my registration When enrolling you have the options to select
how many days you want to enroll you child with the tuition amount indicated. There were no indication of a discount given
for “X” days enrolledThe statement that states that there were a discount is
falseThe start date of the program was changed after I registered
my children online from 9/*/to 9/**/14.
Where is my credit for that??
Which equates to days that I lost and paid forI notified Serious Fun on 9/**/that I needed to change my
children enrollment from Days PW to * Days PW. I did not hear back from MsSyliva R***
until 9/**/that she will changed my children enrollment schedule but will
still charge me for days for ea child from 9/**/to 10/**/for a total of
$by stating the reason is that I needed to give a days written
cancellation. Mind you, the program has
yet to start so how do they impose a days cancellation?? I requested that she reconsider but to no
avail. I then contacted my Citi *** and
disputed the charges because they didn’t refund me the monies for the change in
enrollment for days PW to * Days PW It
wasn’t until I commenced the disputes did they refunded me. As for the $1*dispute for the afterschool days
my kids did not attend, Citi *** resolved the matter in my favor on
1*/**/14. It was arbitrated with Citi
*** billing dispute center that it was not feasible to provide a days’
notice especially when the start date has changed and the program has yet to
startDuring 3/*the instructor for the Muay Thai class that my
kids were enrolled in, resigned. For approximately
(4) weeks my kids were sitting idly doing nothing. On 4/*/I emailed the Site Director Kyle M***
to see if they have found a replacement and if still not, that my kids can be
enrolled in another class that was being offered on Thursdays and if possible
they can offer a discount. MsSyliva
R*** responded no and at that time produced a statement dated 4/*/that I
have an open balance on my account (which is the first time it has been brought
to my attention) and if not brought
current by May *, she will stop providing afterschool services to my kids. Serious Fun underhandedly on 4/*/billed
for the $that was previously arbitrated in my favor by Citi ***, as well
as credit card back charges/services fees by their Credit Card Company and fees
for Non-Sufficient Funds. I responded
that as such the $was resolved in my favor, the NSF fees and those
chargeback fees are invalid and fraudulent charges and I will not be paying
them. The Site Director gave my kids a copy of the
statement sometime in mid-April, telling them to give to me and to let me
know that if I don’t pay the open balance by May 1, they will not be able
to attend afterschool. To involve my
kids in this matter is absolutely unacceptable! My kids were distraught and wanted
to know what will happened to themI had zero intention of canceling my kids’ enrollment
as I have paid for their tuition in full.
Serious Fun’s demand for payment by May 1, is an intimidation and a
bullying tactic of using an ultimatum to pay or else she will stop providing
servicesOn April **, 2015, Ms Syliva R*** once again demanded payment. She went on to declare May *, as my
notification of cancellation date, which I did not give. Furthermore, stated I am due a credit for
days from May *, to June **, for but when on to deduct all sort of
invalid cancellation fees and back charges. On May *, 2015, I received a call from the
school that Serious Fun has denied my kids from attending their program. I was forced to leave work and go to the school
to pick them up. Serious Fun owes me
$for ea kid from May *, to June **, for a total of $520, which I have
not received that refundThey have received payment for those days from the
full tuitions paid on 8/**/14.
Rebuttal to Serious Fun responses:
As stated above, I was never my intention to
cancel the childcare program for my kids.

not what I would consider a courtesy to accommodate the parentsFour weeks
without a substitute instructor is not what I would call exceptional childcare
servicesMy children were sitting idly, doing nothingBy using my children as
a messenger to deliver the statement and to give me a message is what I would
consider chattelThey should not have been involved
A case has also been filed with Department of Consumer Affairs

What THEY have failed
to clearly mentioned are the following:
1.  1st dispute was for $120 which was
resolved by Citi [redacted] in my favor. NO SERVICES WERE PROVIDED. 2.  4/*/2015, Serious Fun underhandedly billed me
for the $120 and banking back charges fees.  Unethical business practice.3.  The $896.28 credit, I AM entitled to DUE to
switch from 3days enrollment to 2days for the entire school year, Sept’** to June’**.  So stating this refunded is “more than any
refund she was entitled to” is a false exaggeration.   Again unethical business practice. 4.  SERIOUS
FUN STOP PROVIDING SERVICES AS OF MAY *, 2015.  They then when on to further deduct 30
days tuition fees for the month of May claiming “30 days written notice was
required.”  BUT MIND YOU, they were the
one that cancelled the service when there were (2) months (May & June) remaining
of the school year. THAT I HAVE PAID AND THEY TOOK.  Once again, unethical business practice.5.  To date they have not refunded me for the months
of May and June of 2015 that THEY DID NOT PROVIDE SERVICES FOR.  NOTE THAT CITI [redacted] IS REINVESTIGATING MY DISPUTE
CASES SINCE I HAVE CLEARLY PROVIDED THEM WITH THE SUPPORT DOC AND HELP THEM TO
