RE: Complaint ID# [redacted] - [redacted] R [redacted] Mr [redacted] had completed a rental application for an apartment community called Eilicott Shores thatwe manage in Celoron, New YorkAt the time Mr [redacted] completed his application we were in theprocess of completing the repairs to a unit so that is could be shown to prospective residentsAbout thetime the unit was completed, another applicant with better credit applied for the same unit and we rentedthat unit to that individualShortly thereafter, another unit was becoming available which Mr [redacted] would have been eligible forUnfortunately, when that unit became available, another applicant, againwith superior credit, applied and we rented that unit to that individual.While Mr [redacted] was approved for residency at Eilicott Shores, his credit was marginalAs alandlord, we are allowed to rank new applicants based on their credit and employment and we have theoption to pick the superior applicant based on credit, not simply on when they appliedAfter thishappening twice to Mr [redacted] , I can understand his frustrationWhen I spoke to him at the end ofJuly, we were going to have a third vacant unit coming up in the near future, but I worried that onceagain, a superior applicant would be approved and Mr [redacted] would be bounced to the back of thelineIn order to bring some resolution to this, I agreed to refund their application fee and I did so on July29,2015.I am sorry that Mr [redacted] was confused by the process, but the fact of the matter was that superiorapplicants kept applying for the vacant units and we exercised our option to select those people over Mr[redacted] We are sorry that he lost time while looking for our units, but I decided that it was ineverybody's best interest for us to refund his application fee and encourage him to look elsewhere forother housing opportunities.If there are any additional questions, please do not hesitate to contact me.Sincerely,Mark CS***President
