I am rejecting this response because:My request for “photo evidence” (cited by Servco Customer Service) and diagrams were never fulfilled.  Dealer response fails to show how the aftermarket part was the cause of failure.  In accordance with the Magnuson-Moss Warranty Act (see screen shot of FTC website), the dealer must show that the aftermarket part caused the need for repairs before denying warranty coverage.  Simply stating that it was the cause does not “show” cause.  In addition, the Subaru Limited Warranty literature effectively states that if damage is DUE TO the installation of accessories… which also implies cause must be shown.The attached photo and diagrams show the relationship between the “forks” and “shifter”.  In the photo, where circled, clearly shows that part [redacted] can only rotate and slide in and out of the transmission body.  The rotation is what selects the appropriate fork.  The sliding in and out motion is what engages or disengages the gears.  The “universal joint”, hinge joint and ball joints are designed to ONLY allow the rotation and in/out motion.  In theory, the transmission shifting could be performed at part [redacted], by rotating and pushing in and out.  The shifter provides the leverage to make this movement easier.  Therefore, what shifter is installed does not have any impact on the shifting of the gears and imposes no additional forces on the forks, other than what is applied by the driver.  In other words, changing the shifter does not affect what goes on inside the transmission.  The installation of the short throw shifter is not the cause of the wear on the forks.

The short throw shifter is an Aftermarket part.  Please note that in accordance with the Magnusson-Moss Warranty Act, this alone should not be cause for denying warranty coverage.  I believe the documents and rationale I provided shows that the shifter has no effect on the forks.
